ORD 18-854 - Terminating the Moratorium on the Expansion or Creation of Self-Service Storage ORDINANCE NO. 18-854 AN ORDINANCE of the City of Federal Way,Washington,terminating the moratorium on the expansion or creation of self-service storage facilities imposed by Ordinance 17-838, and repealing said Ordinance. WHEREAS,on September 5,2017,Council passed Ordinance No. 17-838,which imposed a 12-month development moratorium on the expansion or creation of self-service storage facilities in p p g the City of Federal Way(the "Moratorium"); and WHEREAS, Council desired to review the potential impact of a rapid influx of self-storage units upon the City of Federal Way, and to review the existing development regulations related to self-service storage facilities to determine whether current zoning and development regulations were adequate to implement the vision, goals, and policies within the adopted Comprehensive Plan; and WHEREAS, the Moratorium is set to expire on September 5, 2018; and WHEREAS, on August 14, 2018, concurrent with this action, Council adopted new zoning and design guidelines for self-service storage facilities via ordinance, Council Bill No. 742; and WHEREAS,the adoption of the Council Bill No.742 eliminates the need for the moratorium to continue until its expiration date; and WHEREAS,Council desires to terminate the Moratorium early to coincide with the date the new self-storage facilities regulations will go into effect, August 24, 2018. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The Federal Way City Council hereby terminates the moratorium imposed by Ordinance No. 17-838. Ordinance No. 18-854 Page 1 of 3 Section 2. Severability. Should any section,subsection,paragraph,sentence,clause,or phrase of this ordinance,or its application to any person or situation,be declared unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining portions of this ordinance or its application to any other person or situation. The City Council of the City of Federal Way hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clauses,phrase,or portion thereof,irrespective of the fact that any one or more sections,subsections, sentences, clauses,phrases, or portions be declared invalid or unconstitutional. Section 3. Corrections. The City Clerk and the codifiers of this ordinance are authorized to make necessary corrections to this ordinance including, but not limited to, the correction of scrivener/clerical errors, references, ordinance numbering, section/subsection numbers and any references thereto. Section 4.Ratification.Any act consistent with the authority and prior to the effective date of this ordinance is hereby ratified and affirmed. Section 5. Effective Date.
