Those requirements are summarized below or are enclosed with this letter. Department and agency comments with staff contact are listed with each summary. Land Use Division, Contact Deb Barker, 661-4103 I. Use Process I - Short plat applications are reviewed using Process I (Federal Way City Code [FWCC] Article VI). This is an administrative review process that requires public notice of the short plat proposal and a public comment period; however, no public hearing is required. The final decision on the short plat is made by the Planning Official. Short plat fees for 1995 are $1333. 2. SEPA - Based upon a recent code interpretation by the Responsible Environmental Official, short subdivisions are exempt from State Environmental Policy Act (SEPA) review. Therefore, environmental review will not be required as part of the short subdivision application. A copy of the interpretation is enclosed. 3. Open Space - Short plats must comply with the regulations set forth in the Subdivision ordinance (FWCC Chapter 20). The applicant must provide on-site open space in the amount of 15 percent of the gross land area of the full short plat site or, if the site is five acres or less in size, an alternative fee in lieu of providing the open space may be sought (FWCC 20-155, 19-41). The payment amount is based on the square footage of open space which would have been required to be provided, times the then current market value per square foot of similarly situated property (FWCC 22.60.30). Buffer Requirements - Article IV, section 20-178 concerns Landscape Buffer Requirements and calls for "ample buffers" to shield new residences from established non-residential land uses. The proposed short plat abuts a vacant lot on the south. Both the subject site and vacant lot are zoned RS 7.2, Residential Single Family. If the vacant lot is developed with a non-residential use before a formal short plat application is received, a Type III landscape buffer 10 feet in width would be required along the short plat's southern border. This could impact the land available for subdivision purposes; see section 5, Landscape Modification, below. The Type III buffer is intended to provide partial visual separation of incompatible land uses. FWCC 22-1565(c) details Type III Buffer elements that must be depicted on a landscape plan submittal. The plan must be prepared by a Washington State licensed landscape architect pursuant to FWCC 20-186 and 22-1563. 5. Landscape Modification - FWCC Section 22-1570 provides for flexibility within landscape designs. The Director of Community Development Services has authority to modify specific requirements or impose additional requirements in unique or special landscape circumstances to assure stated purpose of the subdivision chapter. The applicant may request a modification of the landscape buffer requirement stated in item 4 above. A modification may be granted subject to the criteria listed in FWCC section 22-1570(b). In addition, criteria sections 22-1570(d) and (f) could apply. If a modification is desired, I recommend that you submit the request for landscape modification before formal landscape plans are prepared. 6. Existing Structures - The existing residence on the middle proposed lot must conform to the residential setback requirements: front yard, 20 feet; side yard, five feet; rear yard, five feet. Lot coverage is limited to 60 percent and includes all impervious surfaces. 7. Significant Trees - Any trees and vegetation on the site meeting the definition of significant must be retained to the maximum extent possible in accordance with the city's subdivision ordinance (FWCC Chapter 20 sec 20-179). Existing conditions: The subject property accesses to the east onto Tract 'X ' of King County Short Plat No. 178007, a private road provides access between So. 288th and 29th Place So, known as 30th Ave So. The northern 204 feet of Tract 'X ' is improved with 14' of asphalt and rolled curb along the west side boundary. 29th Place So. is fully improved with curb, gutter and sidewalk, and full width paving. The subject parcel has one existing home with access along the above described street. The street storm drainage system terminates at 29th Place So. from the north. R -O -W IMPROVEMENTS 1. An additional 10 feet for right of way for 30th Ave So. must be dedicated to the City at the time of short plat approval. 2. Section 22-1473 of the FWCC requires 30th Ave So., a residential collector, to be improved full width with 36 feet of pavement to match existing conditions. This includes vertical curbs, gutters four foot wide landscape strips, street trees at 30 foot on center and five foot wide sidewalks on both sides. 3. 30th Ave So./29th Place So. shall be improved full width in conjunction with the development of the plat of Janssen Estates to the east of this site. If the development of the Janssen plat is delayed then; a. Tract "X" must be dedicated to the City of Federal Way prior to any development occurring on the site. Signatures on conveyance form to the City from the property owners of lots in KCSP #178007 to the north of the site must be obtained. To date 2 of the 4 property owners have signed such forms. b. Tract "X" along the east side of the property along with a dedication area of PP\.doe 10 feet of wast side of the site shall be improvaith a minimum of 20 feet of pavement, extruded concrete curbing, and associated storm drainage facilities. c. Any design drawing for the street improvements shall be done on 24"x36" sheet sizes at a scale of 1"=20'. STORMWATER 1. Storm water runoff from the site will need to be controlled through the use of facilities designed and constructed in accordance with the requirements of the latest edition of the King County Surface Water Design Manual (KCSWDM). The manual recommends infiltration systems as the preferred method of runoff control. Soil conditions should be investigated to determine the feasibility of using an on-site infiltration system for stormwater runoff control from impervious surfaces. Soil logs and infiltration rates shall be prepared by a professional engineer or geotechnical engineer, licensed in the State of Washington, or by a certified septic system designer. If determined to be feasible, please submit a design for the infiltration system for review. If determined unfeasible, the plans need to show a tightlined system from the house to another appropriate storm drainage facility. Provide information on soils classification in either case. 2 The street improvements will require a storm drainage system separate to on-site storm drainage requirements. The system must be designed in accordance to the KCSWDM. At the time of the site plan review submittal a narrative addressing the relevance to the project of the 7 core and the 12 special requirements of the KCSWDM will be required. A Level I downstream analysis shall also be provided. The city has available V=100' 5 foot contour, planimetric maps that must be used for basin analysis. The unobstructed width of a fire apparatus access road shall be not less than 20 ft. and all turns and/or bends shall be designed at not less than a 32 ft. inside and 40 ft. outside turning radius. All fire apparatus access roadways which have dead ends exceeding 150 ft. shall be provided with a cul-de-sac at the dead end. All such cul-de-sacs shall be not less than 80 ft. in diameter. All fire apparatus access roads serving a single residential property which have a dead end in excess of 150 feet in length shall be provided with a turn around approved by the chief. The proposed improvements consist of a 36' paved asphalt roadway with curb and gutter, and sidewalk on both sides. You are a record property owner of one of these lots. To construct the road, Tract X of Short Plat No. 178007 will be required to be dedicated to the City. We have enclosed copies of Covenants, Conditions, and Restrictions and certain notes on the face of the subject plat, recorded under Recording No. 7809130796 on September 13, 1978, with the King County Office of Records and Elections. These recorded documents require you to dedicate Tract X to the City upon its demand. The proposed plat and road improvements are anticipated to be constructed in 1993.
