This letter is intended to clarify relevant policies and regulations used to consider Mr. Eidal's building permit application. I also reviewed the application with the City Attorney, Londi Lindell to ensure that staff interpretations were consistent with the law. (1) Shoreline setbacks: The Washington State Shoreline Management Act (SMA) defines the ordinary high water mark (OHWM) as "that mark that will be found by examining the bed and banks and ascertaining where the presence and actions of water are so common and usual, and so long continued in all ordinary years, as to mark up the soil a character so distinct from that of the abutting upland, in respect to vegetation... " Revised Code of Washington (RCW) 90.58.030 (2)(b) and Washington Administrative Code (WAC) 173-22-030 (6). The OHWM at Mr. Eidal's home is the waterward lip of the existing shoreline bulkhead. This was confirmed by the Washington State Department of Ecology, Shoreline Division. The City's Shoreline Master Program (Program), King County Code section 25.16. 100 (c), establishes a 20 foot setback from the OHWM to any new construction. As approved by the City on September 19, 1994, Mr. Eidal's proposed work is 20 feet from the OHWM and therefore met .this requirement. (2) Non -Conforming Aspects of the Existing Site: Portions of the existing house encroaches into the 20 foot shoreline setback. Also, the east side of the structure encroaches into the five foot sideyard setback as measured from the property line to the building wall. These 0 • Mrs. Jean Burbidge October 24, 1994 Page 2 elements do not conform to current SMA or Federal Way City Code (FWCC) requirements. WAC 173-14-055(2), allows nonconforming developments to be continued provided they are not enlarged, intensified, increased, or altered in any way which increases its nonconformity. Similarly, FWCC states additions or alterations to the existing structure must be done in such a way so as not to make the building more non -conforming. As approved by the City on September 19, 1994, the proposal did not increase either of the above non- conformance. (3) Shoreline Permits and Variance: The SMA regulates all development within 200 feet of shorelines of the state, in this case, Puget Sound. Certain developments are categorically exempt from obtaining a shoreline permit (RCW 90.58.030(3)(e)). Other projects may require a shoreline permit and/or shoreline variance. Mr. Eidal's proposal is categorically exempt because it is construction within the shoreline jurisdiction by an owner, lessee or contractor purchaser of a single family residence for his own use or the use of his family (WAC 173-14-040(g)). Although a shoreline permit is not required, the development and all normal appurtenant structures must otherwise conform to all applicable development requirements of the SMA and the City's Program (RCW 90.58.030.3vi). Thus, a shoreline permit was not required for the project to change from a flat roof system to a pitched roof system provided it met all applicable shoreline design criteria, which it did. A variance is necessary when a substantial development proposes to exceed any specific bulk, dimensional, or performance standards set forth in the Program. A variance was not needed because no relief was sought to exceed any dimenensional requirement. (4) View Protection/Height Limitation: The protection of views is set forth by RCW 90.58.320 and can be applied to view protection on adjacent land. This is the most specific policy regarding the protection of views: "No permit shall be issued pursuant to this chapter for any new or expanded building or structure of more than 35 feet above average grade level on shorelines of the state that will obstruct the view of a substantial number of residences on area adjoining such shorelines except where a master program does not prohibit the same and then only when overriding considerations of the public interest will be served. " There is no additional requirement in the FWCC or King County Shoreline Management Program that goes beyond, strengthens, or clarifies this requirement. Federal Way City Code (FWCC) section 22-631 limits the 110 Mrs. Jean Burbidge October 24, 1994 Page 3 height of a structure to 30 feet above average building elevation, five feet less than the height limit allowed by the SMA. In summary, Mr. Eidal's building permit met all applicable design requirements and was approved with conditions.
