I am in receipt of your March 28, 2000 letter regarding the proposed replacement of your
carport roof. Your letter states that the existing flat roof carport is 25 years old and the roof
needs to be replaced. You propose to rebuild the carport roof with a gable roof.
According to photographs and available data, the existing carport intrudes into the 20 -foot
front yard setback of the subject site, which is zoned RS -7.2. This creates a nonconforming
condition under Federal Way City Code (FWCC) section 22-334.
According to your plans, the gable carport roof would be built on the existing carport supports,
would be the same horizontal dimensions as the existing carport roof, would not intrude any
further into the required yard setback area, and would not increase impervious area. If the
carport were to be relocated further into the site to create a conforming front yard setback, the
existing drainfield would be impacted. Many existing carports and garages on SW 300' Place
also intrude into the front yard setback required in RS zoning districts.
Your request is reviewed under the provisions of FWCC Section 22-334(6) (enclosed), which
states that if the applicant is making any alteration or changes or doing any work other than
normal maintenance, in any one consecutive 12 -month period to an improvement that is
nonconforming and the fair market value of the alteration, change or work exceeds 50 percent
of the assessed or appraised value of the improvement, the structure must be brought into
conformance with code standards.
The definition of normal maintenance includes roof repair and replacement per FWCC Section
22-1 (enclosed). Therefore, the work proposed to the carport roof would be permitted as
normal maintenance and the nonconformance would not have to be corrected. In addition, the
roof work is approved because the nonconforming setback will not be enlarged, expanded,
increased, intensified, compounded or in any way made greater.
Please submit three sets of plans for the carport roof replacement to Development Specialists.
A handout on residential alterations is enclosed.
