Areas that must be kept clear are in the shape of a triangle and outlined in red on the site plan. Additionally, per FWCC, Sec. 22-1602(d), no sign shall be so located so as to physically obstruct any door or exit from a building. No sign shall be located so as to be hazardous to a motorist's or pedestrians's ingress or egress from buildings or parking areas. No sign shall be located within the clearview zone. 2) SPECIAL CONDITION- setbacks -- Setbacks for both signs must be a minimum of five (5) feet from the property line. 03,MONUMENT LOCATION CONDITION -- Subject property shall be considered lots #1 and #2 for the Village Green Apartments. Phase I has been approved through Use Process III, for lot #1. Construction for lot #2 has not been approved, however this condition will allow placement of the monument to be located on lot #2. The monument shall be located on the northeast corner of lot #2. Cleraview zone condtions will apply. If for any reason Phase II for lot #2 is not completed and/or lot #2 is sold, the owner of Village Green Apartments shall remove the monument and relocate it on lot #1 (A seperate sign permit would be required). A Use Process III was approved for Phase I of a multi phased project consisting of independent and assisted living units for seniors. The site is zoned residential (RS) and is composed of two separate lots. Construction for Phase I has been approved for lot #1. Construction for lot #2 has not been approved. Senior housing is recognized as Special Needs Housing, which means housing that is not specifically defined by the Federal Way City Code (FWCC). This type of housing will be processed under the classification most closely related to the proposed use, as determined by the Director of Community Development Services, per FWCC Section 22-1. Since special needs housing is not recognized by the Federal Way City sign code, the classification most closely related to this particular sized project is Multi -Family Complex. The criteria set for signs under this classification allows signs to be located only in an RM zone. Any proposed signs for this permitted use must meet the conditions set forth for a multi -family complex, and will be permitted in an RS zone by this interpretation. A special condition shall be set, upon approval of the submitted sign permit (#SGN97-0011), to allow a sign to be located at the northwest corner of the subject property. If lot #2 of the subject property is sold at any time, the sign shall be moved to lot #1. Subject property is defined as the entire lot or parcel, or series of lots or parcels, on which a development, activity, or use is or will locate, or on which any activity or conditions regulated by or subject to this chapter is or will occur or take place. This interpretation is based on the size of the project and the similarity to multi -family sign needs. This decision will not set a precedent for future development.
