PRIVATE IMPOUND CONTRACT
This contract entered into on this day/0 ('5 20 I' ,between the undersigned person or persons having control of the real
property listed below and Al's Towing,authorize Al's Towing to impound unauthorized vehicles from said property 24 hours-a-day,7
days a week.

Any Police or Facilities Supervisor is authorized to call for and sign for impounds.
Al's Towing agrees to indemnify,defend and hold the City, it's elected officials,officers and employees,agents and volunteers harmless
from any and all claims,demands,losses, actions and liabilities(including costs and al attorney fees)to or by any and all persons or
entities, including,without limitation,their respective agents,licensees,or representatives, arising from,resulting from,or connected
with this Contract to the extent caused by the negligent acts,errors or omissions of Al's Towing,its partners,shareholders,agents,
employees,or by Al's Towing's breach of this Contract. Al's Towing waives any immunity that may be granted to it under the
Washington State Industrial Insurance Act,Title 51 RCW. Al's Towing's indemnification shall not be limited in any way by any
limitation on the amount of damages,compensation or benefits payable to or by any third party under workers'compensation acts,
I disability benefits acts or another benefits acts or programs.
The City agrees to indemnify,defend and hold Al's Towing, its officers,directors,shareholders,partners,employees,and agents harmless
from any and all claims,demands, losses, actions and liabilities(including costs and attorney fees)to or by any and all persons or entities
including without limitation,their respective agents, licensees,or representatives,arising from,resulting from or connected with this
Contract to the extent solely caused by the negligent acts,errors,or omissions of the City, its employees or agents.
If the City is found in violation of chapter 46.55 RCW,it may be held liable for the cost incurred by the vehicle owner plus towing,
storage,or other impoundment fees.
This agreement shall continue for a period of 4 years and can be terminated in writing by either party; however even after termination,
this agreement shall continue in effect with respect to any claim,cause of action,or judgment which may have arisen or which may arise
by reason of this contract
This agreement is to follow State fee schedule.

HOURS UNLESS A SIGN IS POSTED NEAR EACH ENTRANCE AND ON THE PROPERTY.. INA CLEARLY
CONSPICUOUS AND VISIBLE LOCATION TO ANY WHO PARK ON SUCH PROPERTY ."
