Your letter states that while you have "finals" from Federal Way Water and Sewer and the King County Fire District, your landscaping contractor is approximately two weeks from completing landscape installation required for a certificate of occupancy. In addition, you stated that U.S. Bank holds an assignment of funds for, "the specific performance of completion of the landscaping contract". Stephen Clifton, Senior Planner/Urban Designer, and Deb Barker, Associate Planner, conducted a site visit on August 10, 1994, to inspect the landscaping. Installation of landscaping on the east and west perimeters have not begun and there are additional landscaping items that need to be addressed before the landscaping installation is accepted. 1. According to the Federal Way Zoning Code (FWZC) 90.20.2(a), (in effect at the time of application), living plant material which will cover 80 percent of the area to be landscaped within two years shall be planted. The size of the ground cover planted requires spacing of 30 inches on center. Additional ground cover shall be added to meet this requirement. The plant spacing under the stairways is a good example of how the spacing requirement has been met. 2. The installed birch trees do not meet minimum planting specifications of 2 inch caliper and 8 to 10 feet in height (landscaping plan reference number 11). In addition, some of these trees are dead or dying and may require replacement. 3. The Japanese Garden Junipers (landscaping plan reference number 6) planted on site do not meet the approved 12 to 15 inch size spread (landscaping plan reference number 6). These should be augmented with additional juniper or replaced with plants that meet the requirements. Mr. Faruq Ramzanalli August 11, 1994 Page 2 4. Several plant species have been mixed within the planting beds. Similar ground cover should be installed in the same planting beds. 5. Ground cover along the south side of the building does not meet minimum spacing requirements. Placing the plants in the center of the bed will allow the plants to spread to the bed sides, promoting effective coverage. The Federal Way City Code (FWCC) section 22-1569, Performance and maintenance standards, contains criteria for issuance of a CO prior to completion of the required landscaping. Based on this code provision, your request for a final inspection towards a Certificate of Occupancy prior to completion of required landscaping isrg anted subject to the following conditions: 1. The landscaping must be installed by November 10, 1994. Failure to complete the required installation by this date shall constitute a zoning violation under FWCC 22- 1569(a)(6). 2. If the landscaping is not installed by the required date, the City shall access the assignment of funds to complete the required landscaping and bill the applicant accordingly. Please be advised that satellite dishes are not permitted in the required 20 foot front yard setback.
