This correspondence is in response to your letter of July 11, 1990. Please

This letter is in response to your verbal denial for the sign
applications you have at 1610 South 344th Street and 34323 Pacific
Highway South.
The buildings in question are multi-tenant buildings with over
10,000 square feet each for business use. The property at 16th & 344th
has 215 feet of street frontage and the property at Pacific Highway has
130 feet of street frontage. The 344th Street location presently has one
readerboard and the Pacific Highway South location has two readerboards.
My clients are proposing to remove these visual distractions and replace
them with signs that would enhance the visual character of that area. We
feel these proposed signs meet the requirements of Sec. 95.10 of the code.
In addition, as these signs are in category E, section 95.30 #3 of the
code "specifically" states that monument signs are allowed in those
categories. Again in section 95.35 #3, this clearly shows I am allowed one
sign per access. Section 95.40, #3b-#2 again states what has been clear all
along, that each business is allowed not more that 80 square feet of
signage. As for section 95.40 #3c, this does not apply because these uses
do not contain more that seven tenants.
The property owner is requesting the permits be issued based on
this and if not he wants written clarification of the denial and where the
code specifically states these signs are not allowed. He is being pressured
by his tenants attorneys and needs a solution. My client also wishes to
express that they chose to wait for the new sign regulations to avoid any
down-the-road problems with conforming to the new code and according
to the code, we feel this isn't an unreasonable request.

Dear Mr. Hindman:
I have re-examined the sign permit for Preservative Pain:
following_ a conversation with Sam Jacobs , attorney who drafted
the sign code for the City.
Monument signs are allowed provided certain criteria are met .
Specifically, .the center which includes Preservative Paint ,
34323 Pacific Highway South, as a tenant may have a monument
sign if the following plan corrections are provided and very - Pd.
1 . Maximum monument sign_ structure dimensions are 9 . 5
feet wide and 12 feet tall , landscaped) as detailed in
the attached section 95 . 85 , municipal code .
2 . Total copy area for this monument sign is limited to
yy6 square feet , including both sides of the sign.

3 . Sc le drawings must be provided for all existing
Preservative Paint wall signs . These drawing will be
reviewed to insure no more than 35square feet of wall
sign copy is installed. Wall signage in excess of 35
square feet must be removed as part of the monument

property lines and located outside all sight

Preservative Paint located at 34323 Pacific Highway South,

only two tenants . Chapter 95 . 40 . 3 . c Municipal Code allows
monument signs only if the multi-use complex has seven or
more tenants . Accordingly, I ' m unable to approve this
permit .
Emerald Electric located at 1610 South 344th Street , permit
number 90-8095 has also requested a monument sign .
Following a site visit it was found that Emerald Electric
appeared to be the sole tenant of the building. Again,
Chapter 95 . 40 . 3c allows monument signs only if the multi-use
complex has seven or more tenants . This sign permit must
also be denied.
You may request an exception for necessary identification in
' invited and unusual circumstances under the provisions in
