2018-11-20 Council Minutes - Regular CITY OF � Federal Way CITY COUNCIL REGULAR MEETING MINUTES Council Chambers - City Hall November 20, 2018 — 7:00 p.m. 1. CALL MEETING TO ORDER Mayor Ferrell called the meeting to order at 7:06 p.m. City officials in attendance: Deputy Mayor Susan Honda, Councilmember Lydia Assefa-Dawson, Councilmember Jesse Johnson, Councilmember Hoang Tran, Councilmember Mark Koppang, Councilmember Martin Moore and Councilmember Dini Duclos. City staff in attendance: City Attorney Ryan Call and Deputy City Clerk Jennifer Marshall. 2. PLEDGE OF ALLEGIANCE Mayor Ferrell led the flag salute. 3. PRESENTATIONS a. Recognizing the General Federation of Women's Club - South King County (SOKICO) for their donation to purchase K9 Ballistic Vest Chief of Police Andy Hwang recognized the General Federation of Women's Club-South King County (GFWC SOKICO) and introduced four club members in attendance well as Ms. Pat Malone. Ms. Malone recognized the need for K9 Officer Vader to have a ballistic vest and approached the Police Department expressing a desire to help with this purchase. She then partnered with GFWC SOKICO and together they donated$3,000 for this purpose. Officer Andrew Sederberg was in attendance with K9 Officer Vader to accept this donation. b. Hachinohe 25th Anniversary Sister City Art Gallery Arts Commission Chair Daniel Hershman announced the opening of the Hidden Gems joint photo exhibit. He shared the origin of the exhibit and that it celebrates the 25th anniversary of the sister city relationship between Hachinohe and Federal Way. c. Proclamation: Adoption Month — November 2018 Councilmember Moore read and presented the proclamation to Amara Community Engagement Specialist Caroline Brandau. Ms. Brandau spoke regarding Amara and expressed gratitude for the recognition of their 97 years of service. d. Certificates of Appointment: Federal Way City Council Regular Minutes Page 1 of 12 November 20, 2018 • Youth Commission Councilmember Johnson read the Certificate of Appointments and presented them to newly appointed members: Daniel Chung, Iris Hamilton, and Ankita Sharma. • Planning Commission Councilmember Koppang read the Certificates of Appointment and presented them to both the appointed and re-appointed members:Wayne Carlson,Tom Medurst, Hope Elder, Dale Couture, and Eric Olsen. • Historic Landmarks Commission Deputy Mayor Honda read and presented the Certificate of Appointment to the first Historic Landmarks Commissioner, Jason Ludwig. e. Mayor's Emerging Issues and Report • Draft 2019 Legislative Agenda Discussion Mayor Ferrell introduced the Legislative Agenda indicating that this is for discussion only and that it will be brought before council for consideration and approval at the December 4 City Council Meeting. Senior Advisor Yarden Weidenfeld overviewed the Legislative Agenda indicating that it will include requests for funding and legislative actions. He shared he had spoken with the mayor as well as department directors to create the proposed legislative agenda which speaks to Education, Crime and Public Safety, Homelessness, Land Acquisition, Aircraft Issues, Economic Development, and Transportation. Councilmembers asked clarifying questions regarding the funding for state road projects and the impact of the Sound Transit Light Rail Station. There was additional discussion on potential funding if money is not allocated from the state. • Holiday Tree Lighting at Town Square Park Parks Director John Hutton announced the tree lighting will occur Saturday, December 1 at Town Square Park at 4:00 p.m. • Jingle Bell Brunch at Federal Way Community Center—Saturday, Dec 1 Parks Director John Hutton announced the Jingle Bell Brunch is scheduled for Saturday, December 1 at Town Square Park at the Federal Way Community Center at 10:00 a.m. • Report of Community Events: Mayor Ferrell attended the Veterans Day event on November 10 at Todd Beamer High School which was hosted by Kiwanis; he was honored to be in attendance and speak. He also participated in the Foundation House event. He expressed pride for the love our community shows our veterans. • City Council Meeting Schedule Mayor Ferrell explained the second meeting of December(12/18)has been cancelled, Federal Way City Council Regular Minutes Page 2 of 12 November 20, 2018 with the next meeting scheduled to take place January 1. Due to holiday closure and per Council Rules it has been moved to January 2 (following business day). f. Council Committee Reports • Finance, Economic Development Regional Affairs Committee (FEDRAC) Councilmember Duclos announced FEDRAC will meet on November 27 at 4:30 p.m. for their final meeting of the year. • Lodging Tax Advisory Committee (LTAC) Councilmember Moore shared he is looking forward to promoting future tourism during the off-season in Federal Way; they are studying to develop programming for next year. • Land Use/Transportation Committee (LUTC) ( ) Councilmember Koppang an reviewed items that will be considered at the next LUTC next LUTC meeting scheduled for December 3. • Parks/Recreation/Human Services/Public Safety Committee (PRHSPS) Councilmember Johnson shared regarding conversations had at the PRHSPS meeting on November 13. • Deputy Mayor Report Deputy Mayor Honda shared that Council has worked hard to come a point where they can all agree on the budget document which will be discussed tonight. She indicated all of council is committed to supporting both Police and Human Service Organization; but they are unable to satisfy every need. She also spoke regarding the Open Public Meeting Act and how that applies to online social platforms. 4. CITIZEN COMMENT Mayor Ferrell announced Item 7a, Resolution Fee Schedule had been pulled from the agenda and will be discussed at the November 27 FEDRAC Meeting prior to Council consideration. Tony Pagliocco spoke in support of the Police Department and their budget. He wants to make sure public safety officials are supported and have ample resources as they take care of the citizens and businesses within the city. TaShawna Nash with the Save Weyerhaeuser Campus Board expressed sincere gratitude to their growing group of supporters and asked for ongoing support during the ongoing permitting process. Deanna Anthony asked the Council to consider the unintended consequences of the budget change made at the last City Council Meeting. She reminded Council of the Light Rail coming to the city which she believes will bring added citizens and crime. Tim Lookakaugh expressed concern regarding the proposed transitional care center at Light of Christ Church. He wanted remind council that the zoning is for single family and while the church is allowed as a conditional use, this proposal is not typical for a religious institution. Federal Way City Council Regular Minutes Page 3 of 12 November 20, 2018 Ron Campbell, president of Grouse Point HOA(72 homes), spoke against the Light of Christ Center Transitional Housing proposal. He is concerned on the affect this will have on property values and quality of living. Karen Brugato spoke regarding the Admissions Tax.She shared her proposed changes to the Admissions Tax and requested amendments be made. Bill Rowe, resident of Grouse Point, is concerned with the Light of Christ Center proposal. He has 24 years of experience as an architect and does not believe the transitional housing should fall under monastery housing as it is not similar in nature. Jackie Rein declined to speak. Anne Cutting expressed disagreement with the proposed FUSION project at the Light of Christ Church. She is upset King County Council appropriated $3 million to help fund this project without contacting the Mayor or Council. Art Cutting indicated he is appalled that King County would allocate this money without having standards and/or requirements placed on this facility. Lindy Harvey shared that she has managed multi-family properties throughout the county for 40 years. She spoke regarding the misperception multi-family developments bring increased crime. She suggested an advisory group of multi-family managers be brought together to assist the city. Evan Nelson spoke in support of funding for the Federal Way Youth Action Team (FWYAT). He reminded Council the group assists at-risk youth in setting positive and attainable goals which include staying in school and learning trades. Dana Hollaway spoke in support of returning reallocated funds to the Police Department. While important, she feels FWYAT violated the process for requesting funding. Jeff Oldright spoke as a self-storage owner and developer. He spoke about fees proposed in the fee schedule and appreciates it is being sent back to committee for additional review. He has been involved in the discussion and has felt heard and respected. Bruce Judson is retired from the City of Steilacoom and provided suggestions for creating a balanced budget. Cindy Flannagan requested the city rescind the MDNS and request an EIS for the IRG site. This would result in a full assessment of a significant site and allow for cumulative effects to be understood. Richard Pierson shared that IRG has a good track record of brownfield development and pointed out the proposed project is outside their usual scope. His review of the project concluded that one-third of the forest is proposed to be clear-cut with over 20,000 trees removed. Michael Brown believes it is sacrilege for IRG to do what they are proposing and compared the proposal to removing Central Park from New York. Debra Hansen stated she has read the formal comments for SEPA and believes the consensus is clear regarding appropriate and lawful path forward: an EIS is a must. Federal Way City Council Regular Minutes Page 4 of 12 November 20, 2018 Lori Sechrist thanked Councilmember Moore for the proclamation as adoption has enhanced her family. She shared she is committed to protect the environment near North Lake and Weyerhaeuser for future generations. She also wants an EIS on the full property. Jennifer Cox advocated for funding of the FWYAT; she believes this program will help youth become high contributors to society. Doug Baxter,former chair of the Violence Prevention Coalition Steering Committee(VPCSC), expressed appreciation for their inclusion of VPCSC items in the Legislative Agenda. Chris Leavitt remarked that the highest priority for city government is the security of individuals, schools, and businesses. He requested that the Police Department receive the funding needed to do their job as well as protect themselves. Cynthia Ricks-Maccotan applauded the Council for looking at creative ways to show youth that the city cares about and supports violence prevention. She believes the non-personnel funding being allocated from from Police to prevention is wonderful. Trisha Lindstrom spoke on behalf of the Eagle Manor development near the proposed FUSION project. The neighbors are concerned that the process to date has secretive and are concerned about potential theft, drug exposure, definition of transitional, and property value. Anna Patrick supported returning funds to the Police Department Budget as she believes in consequences for drug users and criminals. She supports the FWYAT but asked Council to find a different source of funding. Scott Chase lives behind Quad Shopping Center and is concerned about the uptick in crime. He requested Council hire additional police officers. Lamont Styles advocated for the FWYAT indicating that police are not the only solution. He wants the city to work in collaboration with others. Veasna Hoy, FWYAT Program Director, spoke regarding the purpose, direction, and outcomes of the FWYAT. She asked for the funding be considered an investment in our youth. PUBLIC HEARING At 10:23 p.m. Mayor Ferrell opened the public hearing. a. 2019/2020 Biennial Budget & 2019 Property Tax Levy Public Hearing...continued from November 6, 2018(required by RCW 35.34) Continued Public Hearing at 10:23 p.m. • Citizen Comment Dana Hollaway spoke regarding the increase of crime and impact homelessness has on the community; she requested Council not take money from the Police Department budget. Scott Chase provided a chart to Mayor Ferrell and each council member highlighting the collection and usage of Proposition 1 Tax Levy since 2006. The proposition was to enhance police officer ratio which is no longer taking place. Betty Taylor commended the hard work of citizens who came to this meeting and those who have conversations on Facebook. Written comments from Nancy Rice were read into the record by the Deputy City Clerk. • Council Questions/Deliberations Councilmember Johnson thanked those who spoke on both sides of the issues. He indicated the council is listening and working to come to a decision regarding what is best for the community. Due to the fact he sits on the board of the Federal Way Youth Action team, he recused himself from the vote. DEPUTY MAYOR HONDA MOVED TO RESCIND THE PREVIOUSLY ADOPTED ACTION THAT MODIFIED THE MAYOR'S PROPOSED BUDGET TO FUND SOUTH KING COUNTY HOUSING AND HOMELESSNESS PARTNERS BY REMOVING $26,000 PER YEAR FROM THE POLICE DEPARTMENT BUDGET; COUNCILMEMBER JOHNSON SECOND. Councilmember Assefa-Dawson thanked those who attended and shared their convictions and indicated she does not want to compromise safety. She is excited to partner with other cities to address issues such as homelessness and asked how the funds currently reallocated from the Police Budget for South King County Housing and Homelessness Partners (SKCHHP) would impact the work of the Police. Chief of Police Hwang stated that while these funds were moved from non-personnel budget line items,these funds are there to support the officers. There will be operational impact, but they are dedicated to continuing to responding to requests. Council discussed and inquired as to whether funding could be pulled from other areas of the budget. Councilmember Duclos questioned whether these groups are raising other funds or solely depending upon the city. Councilmember Koppang reminded council of the additional police training requirements as approved at the state level by voters through Washington State Measure 940. He questioned reallocating funds when additional funds may be needed to be in compliance. Councilmember Tran spoke regarding the enormity of the budget and that expressed concern that funding could not be located to support both SKCHHP and FWYAT. Deputy Mayor Honda questioned if there may be fund balances from 2018 that could be utilized for these agencies. Councilmember Koppang expressed his appreciation to FWYAT for their commitment and efforts Federal Way City Council Regular Minutes Page 8 of 12 November 20, 2018 and is pleased to earmark budget dollars for this project. Councilmember Dulcos spoke about her experience running a non-profit organization and acknowledged the importance of fundraising from various sources. She expressed that the first priority of the city is to protect citizens and to do so properly fund the police. Deputy Mayor Honda expressed interest in gathering various agencies in the area that work to help our youth to ensure all youth are being supported. Councilmember Moore agreed that more needs to be done and reminded council of both the stories and pleas for help that have been heard. Councilmember Assefa-Dawson understands and indicated that FWCAT has funding from King County through July which allows time for other options. Councilmember Tran reiterated that this situation is not a competition and that the funds allocated came from accounts which were not fully utilized for the past three years. He believes this shows the reallocation is appropriate. Concern was expressed regarding the delay in funding and the results it would have on the programs run by this group as well as the statement it makes regarding the level of commitment from the Council. Responses included advocating alternate means of addressing violence and a commitment to allocate funding in the future. COUNCILMEMBER DUCLOS CALLED THE QUESTION; COUNCILMEMBER KOPPANG SECOND. ORDINANCES First Reading a. Council Bill #747 Abandoned Shopping Carts Regulations AN ORDINANCE OF THE CITY OF FEDERAL WAY, WASHINGTON, RELATING TO SHOPPING CART REGULATION;AMENDING FWRC 07.03.020 AND 07.03.040,AND ADDING NEW CHAPTER 07.25 FWRC. (Amending Ordinance Nos.09-596; 10-669;and 12-715) Community Development Director reviewed the circumstances which led to the need for this ordinance as well as the research that has gone into its development. This included a meeting with local retailers to receive input. Councilmembers asked questions regarding the similarities of this program to nearby jurisdictions, implementation of the program, and if fees could be changed in the future to more fully cover the costs associated with cart retrieval. Deputy City Clerk Jennifer Marshall read the Ordinance Title into the record. Council Bill #748 Complete Streets Policy Revisions AN ORDINANCE OF THE CITY OF FEDERAL WAY, WASHINGTON, RELATING TO COMPLETE STREETS POLICY REVISION TO BUILD STREETS FOR ALL USERS AND TRAVEL MODES; AMENDING FWRC 19.135.205(Amending Ordinance No. 12- 718) Traffic Engineer Erik Preston provided a brief presentation regarding the Complete Streets Policy Revisions. It was indicated that this policy is codifying a procedure that is already in place and is a method by which public street standards will become uniform across the city. Councilmember Koppang clarified that this will establish street width requirements as well as sidewalks and bike lanes.
