In the event such claims, losses, damages, or expenses are caused by the joint or concurrent negligence of Trend Homes and the Owners, they shall be borne by each party in proportion to that negligence. 6. Trend Homes and/or its successor in interest in the Property agree to perform any reasonably necessary repair or maintenance work to the retaining wall for a period of five (5) years from execution of this Agreement, provided that such repair or maintenance work arises from the negligent acts or omissions of Trend Homes or anyone directly or indirectly employed by Trend Homes. Such work shall be done at the sole cost and expense of Trend Homes and/or its successor in interest in the Property. In the event that any repair or maintenance work is needed to the retaining wall, the Owners agree to allow Trend Homes and/or its successor in interest in the Property to enter upon the Owners' Property so that Trend Homes and/or its successor in interest in the Property can perform any such reasonably necessary repair or maintenance work on the retaining wall. 7. The Parties and their successors, heirs, and assigns, hereby waive and release any and all claims against the City of Federal Way arising from or relating to the constructed retaining wall situated on or about the common boundary line. 8.
