Planning staff has reviewed your single-family building permit for a proposed second story addition with
deck improvements located at the above -referenced address. Staff is unable to permit the deck due to
conflicts with a variance decision issued November 23, 2005, for the original single-family residential
improvements. The applicant will be required to redesign the deck to include gaps between the boards or
abandon the deck proposal for reasons listed below.
HEARING EXAMINER DECISION
Prior to home construction, the applicant received a lot coverage variance as single-family improvements
exceeded the 10 percent maximum for impervious surfaces. The decision was narrowly focused on the
following three impervious improvements: (1) driveway access; (2) parking area; and (3) patio. The
Hearing Examiner granted a lot coverage variance for the driveway due to topographic challenges and
reasonable access for residents and fire/rescue vehicles. The Hearing Examiner denied the variance for
the parking area and patio as he deemed them unnecessary and stated the applicants were capable of
improving such areas with permeable surfaces.
PROPOSED DRIVEWAY CREDIT
The applicant has identified the driveway that was granted the variance is smaller than what was
originally proposed to the Hearing Examiner and therefore proposes to utilize the unused lot coverage
from the driveway and transfer it to the deck. Staff will not allow such a transfer as the variance decision
explicitly stated the impervious patio was unnecessary and would constitute a grant of special privilege,
which conflicts with variance criteria set forth in Federal Way Revised Code (FWRC) 19.45.030(1). The
intent of the Hearing Examiner's decision was to allow increased lot coverage for reasonable access and
life safety concerns. At that time, the applicant was unable to provide evidence that impervious patio/deck
improvements met the variance criteria and therefore the request was denied.
CLOSING
I have enclosed a copy of the Hearing Examiner's decision with highlighted sections relevant to the
current proposal. If you choose to redesign the deck, please show details of the gaps between the deck
