CONDITIONS:
1. street must be widened to 20' pavement width prior to final inspection. A right-of-way permit and Public
Works inspection is required.
2. No building shall encroach onto any building setback line or easement shown or not shown.
Maximum building height is 30 feet above the average building elevation as per Federal Way City Ordinance
#90-51.
3. Building setbacks are: 20 feet front; 5 feet side; 5 feet rear.
4. Per Federal Way City Code section 22-1133(4), eaves, chimneys or awnings, and similar elements of a structure
that customarily extend beyond the exterior walls of a structure may extend up to 18 inches "MAXIMUM" into
the required yard setback. Additionally, the total horizontal dimenslons of the elements that extend into a
required yard, excluding eaves, may not exceed 25% of the length of the facade of the structure from which the
elements extend.
5. This decision shall not waive compliance with future City of Federal Way codes, policies, or standards relating
to the subject proposal.

Dear Mr. Miller:
Pursuant to Federal Way City Code Section 22-1477; I am seeking a waiver of any and all
street improvements for the project referenced above.
There are no existing sidewalks, curbs, or gutters in the neighborhood, and as such "the
improvement as required would not be harmonious with existing street improvements, would
not function properly or safely or would not be advantageous to the neighborhood or City as a
whole."
Furthermore, fire department access to the property can be accomplished without leaving the
existing public roadway at 9`h Ave. S.W. and S.W. 295`" Street.
