After evaluating the existing conditions along SW 295`h Street, review of Federal Way City Code (FWCC) provisions (Sections 22-1477, 22-1524 and 22-1496), and the direction provided by the City Council, the Public Works Department hereby modifies the requirements for street improvements applicable to your permit application, as discussed below. FWCC Section 22-1477 Modification of Improvements Along Property Frontage - This code section allows the Pub,"'lic Works Director to grant a request to modify, defer, or waive the required street improvements only after consideration of four specific reasons. The reason most applicable here is "(1) The improvements as required would not be harmonious with existing street improvements." SW 2950' Street currently has an approximate paved width of 15 feet. The City of Federal Way Comprehensive Transportation Plan standards require 20 feet of pavement, an eight -foot -wide ditch, a five -foot -wide sidewalk, and streetlights. Streets in this neighborhood do not include ditch, sidewalk, or streetlights. Installation of these improvements would not be harmonious with the existing street improvements and would not function properly. The pavement width, however, must be increased to a minimum of 20 feet along the property frontage on SW 295`h Street and 9`h Avenue SW to meet current minimum safety standards. The new street section shall be a minimum of 0.25' Class B asphalt concrete, 0.17' crushed surfacing top course, and 0.42' crushed surfacing base course. A right of way permit will be required. Construction must be completed and approved by the Public Works Inspector prior to the final building inspection for the building permit. In addition, a Local Improvement District Waiver of Protest Covenant must be signed and notarized. This document will be prepared and sent to you for signature within the next two weeks.
