The trees are within an unclassified stream buffer; therefore, removal does not qualify as an exempt action listed in Federal Way Revised Code (FWRC) 19.120.030. The department issued Interpretation #10-01 on January 28, 2010, which provides clarification of the proper procedure, application materials, and decisional criteria for vegetation removal within identified critical areas. DECISION Removal of the three trees utilizing hand tools and/or hand powered tools is hereby approved per the findings and conclusions provided below. BACKGROUND An adjacent property owner, Miguel Benitez, has expressed concern of hazardous trees within the SWM parcel that have fallen onto his property recently and the likelihood of additional trees that may threaten his property in the future. A site visit by Parks and Facilities Manager Steve lkerd concluded that one of the identified trees contained a crook in the stem that would eventually break during a storm event and two neighboring trees were significantly leaning toward parcels south of Mr. Benitez's property. Mr. Ikerd recommends the trees be removed due to risk of failure and possible damage to private property. Due to the limited scope of the proposal and dense vegetative cover that will remain following removal, a vegetation maintenance plan will not be required. DECISIONAL CRITERIA Planning Division staff reviewing your request has provided a bulleted response to each of the director's decisional criteria below. 1. The proposed activity will not adversely affect water quality. • Scope of tree removal is limited to three trees. Remaining canopy will provide adequate erosion protection to downstream flows. Further, the decision has been conditioned to allow removal via hand tools only and no earth moving equipment causing potential harm to onsite stream will be utilized. 2.
