Wong and Chu: Thank you for your request regarding any required land use process in order to locate a fast food (take-out)restaurant at the above address. The subject site is a 350-foot tenant space, and is one of six existing retail units located on the southern portion of the Coffee Europa site. As described to staff,the proposal will involve interior tenant improvements only, with no exterior improvements except signage. It was also noted that the business will involve a delivery service to the immediately surrounding area. City staff have reviewed the request and determined that no land use process is required, based on the following findings. (1) The proposed fast food restaurant is permitted in the Community Business(BC)zoning district pursuant to"Federal Way City Code"(FWCC) Sec. 22-753. (2) The proposal is defined as a tenant improvement pursuant to FWCC Sec. 22-1, and is exempt from a land use permit pursuant to FWCC Sec. 221-32(2). (3) The proposal is exempt from environmental review under the State Environmental Policy Act(SEPA)because it does not represent a change in the previous retail use of the tenant space and is consistent with the previous environmental review' conducted for the Coffee Europa site. This determination of consistency between the previous and proposed use is based on comparable hours of operation;traffic generation, no`exterior improvements or changes to general appearance, and parking requirements. Chu December 28, 1999 Page 2 With respect to parking, it should be emphasized that the city code establishes different requirements depending on the specific type of retail sales or service. For example,the code requires more parking for fast food restaurants(one stall per 80 square feet of gross floor area) than for general retail (one stall per 300 square feet of gross floor area). Inclusion of the fast food restaurant with other site uses requires a total number of 37 on-site parking stalls. Thirty-six(36) stalls are currently provided,which is considered comparable and sufficient to meet the parking demand for the fast food restaurant and other approved uses of the site. The delivery aspect of the fast food business and its off-peak hours of operation additionally support this. Additionally, it should be noted that any future conversion of existing tenant spaces on the site to another approved retail use,and particularly fast food,may be required to provide additional parking. Such a conversion,depending upon the proposal and applicable code requirements, may trigger a land use and/or environmental review process. In any case, future tenants on the site are subject to a review and determination of any such applicable requirements by the city. Also, be advised that the interior improvements are subject to a city-approved building permit, business license, and sign permit(if applicable). The applicant is also responsible to identify and obtain any outside agency permits and licenses required for the proposed use, e.g.,the King County Department of Public Health.
