Background Information All property owners, businesses, and residents benefit from the utilities located within the right-of-way. Property owners access their properties through driveways within the right-of-way. City needs to permit use of the right-of-way in a manner where infrastructure is restored and the public is protected. Current FWRC Limited Right-of-Way Use Permits Current Federal Way Revised Code (FWRC) 4.25.090 – Limited Right-of-Way Use Permits May require bonding as outlined in FWRC 19.25. FWRC 19.25 bonding is onerous for standard utility connections and driveway aprons. FWRC 19.25 bonding is more typical for large projects building / impacting extensive right-of-way. No insurance requirements. Proposed FWRC Changes Limited right-of-way use permits will require a simple Street Obstruction Bond (consistent with most jurisdictions). One page standard form.
