07-16-2019 General ElectionPro and Con Committees General Election November 5, 2019 City Council Meeting July 16, 2019 Advisory Proposition No. 1 Retail Marijuana RCW 29A.32.380 requires the City Council to appoint a Pro and Con committee Council interviewed volunteers last night and tonight Resolution appoints 3 individuals for each committee Options Approve resolution as proposed Amend the proposed resolution Take no action and give further direction to staff Citizen Initiative No. 19-001 Rental Requirements for Landlords and Rental Rights for Tenants Received citizen initiative on June 27, 2019 Proposed Council resolution authorizes placing the measure on the ballot contingent upon finding of sufficiency by King County that the petition has the required number of signatures Timeline July 16 - Council passes Resolution adding measure to ballot contingent on a finding of sufficiency from King County July 16 – Council passes Resolution directing staff to advertise for volunteers to be committee members July 19 – Advertisement for volunteers is published July 22-26 – City accepts requests from volunteers to participate on pro/con committees July 30 – Council interviews and then appoints members of pro/con committees at a special meeting TBD – City Clerk and City Attorney brief the pro and con committee members on their duties August 13 – Statements of committees due to King County Elections August 15 – Rebuttal statements due to King County Elections Resolutions presented July 16, 2019 – Staff presents two resolutions: Establishes a ballot title for the citizen initiative and directs the City Clerk to transmit the resolution to King County Elections contingent on the County certifying the petition has the required signatures Directs staff to advertise for volunteers for the pro and con committees to create summary statements for the ballot Ballot question RCW 29A.36.071 requires the City Attorney to formulate a concise description and question. Both are limited in length Must be a true and impartial description of the measure’s essential contents and to the extent reasonably possible not create prejudice for or against the measure Ballot TitleCity of Federal Way Initiative No. 19-001  City of Federal Way Citizen Initiative No. 19-001 concerns enacting rental requirements for landlords and rental rights for tenants. This citizen initiative would enact an ordinance to amend the Federal Way Revised Code to require landlords to comply with existing rental laws; to establish obligations and duties for landlords, and defenses and rights for tenants, regarding: requirements that landlords must meet before evicting tenants, retaliatory actions, rental agreements, and rental agreement renewals; to create classes of tenants afforded additional rental rights; and to adopt penalties for landlords and procedures to enforce the measure. Should this citizen initiative be enacted into law? YES NO Effect of Resolution Upon the approval of the proposed Resolution and certification of sufficiency from King County, the City will submit the Ballot Title and Explanatory Statement to King County Elections. City Clerk will advertise for Pro and Con Committee volunteers. Submission of the initiative petition to the City Clerk triggered the prohibition within RCW42.17A.555 that states no public facilities may be used for the promotion of or opposition to any ballot proposition. Public comments regarding the initiative will not be permitted until after the general election on November 5. Questions?
