WHEREAS, the City of Federal Way is a welcoming community and is fortunate to have such a
diverse population, including citizens who identify as lesbian, gay, bisexual, transgender,
transsexual, queer, questioning, intersex, asexual, allies, pansexual; and
WHEREAS, the Mayor of the City of Federal Way proclaimed Federal Way as a Welcoming
City in March 2017 and stated that Federal V/ay fosters a welcoming environment for all
residents and visitors regardless of race, ethnicity, place of origin, or sexual orientation or
identity; and the Mayor and City Council recognized June as "Pride Month" in2019; and
WHEREAS, Washington State and King County have led the nation in protecting the civil rights
ofour lesbian, gay, bisexual, transgender, transsexual, queer, questioning, intersex, asexual, allies
and pansexual neighbors, co- workers, friends, and family members; and
\ryHEREAS, in the movement toward equal rights for LGBTTQQIAAP people, an historic
turning point occurred on June 28,1969, in Manhattan, New York City, which is often cited as
beginning the LGBTQ rights movement in the United States; and
WHEREAS, while further progress is needed, it is important to recognize and celebrate the
substantial gains that have been achieved; and
WHEREAS, the City of Federal Way recognizes the need for the community to work together to
promote equal rights for all, regardless of sexual orientation or gender identity;
NO\ry, THEREFORE, I the undersigned Mayor of the City of Federal Way hereby proclaim the
month of June 2020 as "Pride Month" and will fly the "Pride Flag" at City Hall. The City of
Federal Way affirms its support and acceptance for children, adults, parents, families, and allies
within the LGBTTQQIAAP community.

anticipated that the Federal Way Public Schools will need to adjust the
school day to slow the spread of the virus. This project will provide full-day
youth development services to ensure youth have a safe place to go
throughout the day with academic and social-emotional supports and to
allow families to return to work.

Dear Governor Inslee and Executive Constantine:
As the Mayor and the City Council of the City of Federal Way, we share the disappointment of
many of our citizens that our City, along with all other cities in King County, will not be able to
completely proceed safely to Phase 2 of the “Safe Start Washington” plan on June 1. We are
grateful for the option that will allow King County to apply to have some businesses to open under
the new “Safe Start—Washington” plan, called Phase 1.5. However, we would like consideration
of a proposal as we are concerned that it does not go far enough so that cities and “sub-areas” be
allowed to proceed in an accelerated fashion into Phases 2, 3 and 4.
We commend both of your efforts in guiding our region and state through the last four months.
We are well aware that both of you sympathize with citizens who have not been able to work since
the “Stay at Home” took effect March 25. Phase 1.5, once King County applies and the State
approves, allows the safe reopening of personal services, professional and office-based services,
in-store retail, pet grooming and other small businesses and activities. However, while this phase
allows for outside seating for restaurants, it leaves this important business sector in critical shape.
Through the extraordinary and ongoing efforts of our citizens to socially distance, the heroic efforts
of our healthcare institutions and workers, and notably, the guidance of King County Public Health
and State Department of Health, together we have made continued progress to contain the COVID-
19 outbreak.
The health of our citizens, especially our vulnerable populations, healthcare workers, and first
responders, comes first. The measurements being used by both the State and the County have
provided guidance and have been successful in lowering the risk to our citizens. However, it is
time to re-examine the geographical application of the measurements as many individual
communities in areas of our large county have succeeded in qualifying for subsequent phases.
As you know, King County’s population is so vast that it would be the 36th largest state in our
nation. Unfortunately, the individual hotspot areas on the county dashboards are holding back

communities that are ready to move on to Phase 2 and beyond. Of note is the fact that if the
positive cases from the locked down long-term care facilities are taken out of the equation, many
areas of King County would qualify for moving on to Phase 2. Therefore, we propose that it is
time to adopt a regional, “sub-area” and city by city approach to the opening of King County.
To quote President Lincoln, now is the time to “Think anew and act anew.” As you are aware,
Snohomish and Pierce counties are moving forward with applications to proceed to Phase 2. We
call on the King County Executive to immediately convene a joint emergency meeting of the King
County Council and the King County Board of Health to discuss and adopt a regional “sub -area”
city by city focus and apply to the Governor to let those areas of the county apply to proceed to
Phase 2.
In addition, we are asking the member cities of the Sound Cities Association to join in advocating
for this effort to adopt this sub-area and city approach versus the current “one-size-fits-all”
rationale that would allow them to proceed to Phase 2, 3 and 4.
We are also asking that the Governor carefully consider modifying your “county approach" and
consider acceptance of a county “sub-area” and city approach so that many more areas may safely
proceed to Phase 2 of the “Safe Start Washington” plan that would allow more affected citizens
and businesses begin the task of safely rebuilding their lives and livelihood.

RESOLUTION NO. 20-790
A RESOLUTION of the City of Federal Way, Washington, temporarily
allowing shared parking for outdoor restaurant activity.

WHEREAS, the outbreak of the novel coronavirus (COVID-19) and its rapid progression in
Washington state continues to threaten the life and health of its people as well as the economy of the
state; and
WHEREAS, on February 29, 2020, the Governor of the State of Washington proclaimed a
State of Emergency due to COVID-19; and
WHEREAS, on March 9, 2020, Mayor Ferrell issued a Proclamation of Emergency No. 20-
01 in response to COVID-19; and
WHEREAS, on March 11, 2020, the Governor issued Proclamation 20-08, which found that
COVID-19 spreads easily from person to person and may result in serious illness or death, and
continues to spread in the state with cases expected to double every five to seven days, without any
expectation to end soon; and
WHEREAS, on March 11, 2020, the Centers for Disease Control and Prevention (CDC)
issued CDC’s Recommendations for the next 30 days of Mitigation Strategies for Seattle-King,
Pierce, and Snohomish Counties based on current situation with widespread COVID-19
transmission and affected health care facilities, which recommends “extensive community
mitigation activities” to slow the spread of, and minimize morbidity and mortality caused by
COVID-19; and
WHEREAS, on March 13, 2020, the President of the United States declared a national
emergency due to the COVID-19 pandemic; and

WHEREAS, on March 23, 2020, the Governor issued an order to require every
Washingtonian to stay home and, banned all gatherings for social, spiritual, and recreational
purposes, and close all businesses; and
WHEREAS, on May 29, 2020, the Governor announced variance to the stay at home rule to
permit, with limitations, some activities, including outdoor restaurants, to provide food to the public
to be consumed on the premises under strict limitations; and
WHEREAS, the local restaurant community is suffering unprecedented hardship due to
closures, loss of supply, and reduced patronage due to the Governor’s stay-at-home order, and
allowing restaurants to serve food outside the restaurant building can mitigate this hardship to some
extent; and
WHEREAS, some restaurants can provide outdoor meal service if allowed to use parking
areas normally required under the city code to be repurposed as outdoor dining areas; and
WHEREAS, City parking requirements do not allow businesses to share required parking
spaces with other businesses, thereby, limiting the amount of parking space that can be converted to
use for outdoor restaurant seating; and
WHEREAS, the City Council seeks to mitigate some of the economic impacts to restaurants
by making a temporary change to the Federal Way Revised Code to t relieve such shared parking
restrictions to increase available space for outdoor seating of customers during this emergency.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY,
RESOLVES AS FOLLOWS:
Section 1. Due to the ongoing national health emergency caused by the COVID-19 outbreak,
and consistent with the Governor’s limited variance towards re-opening businesses and subject to
Resolution No. 20-790 Page 3 of 4
any private contractual obligations that may exist with a landowner, the City hereby suspends
enforcement of off-street parking requirements of Federal Way Revised Code 19.130.120 until
January 1, 2021, during which time restaurants may use parking spaces immediately and directly
adjacent to their place of business to expand serving areas for patrons seated at safe social distances
during COVID-19 restrictions. Such use of parking spaces shall not expand into internal traffic
circulation areas so as to impede the safe passage of vehicular, bicycle, and pedestrian traffic.
Section 2. Severability. If any section, sentence, clause or phrase of this resolution should be
held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitutionality of any other section, sentence,
clause, or phrase of this resolution.
Section 3. Corrections. The City Clerk and the codifiers of this resolution are authorized to
make necessary corrections to this resolution including, but not limited to, the correction of
scrivener/clerical errors, references, resolution numbering, section/subsection numbers and any
references thereto.
Section 4. Ratification. Any act consistent with the authority and prior to the effective date of
this resolution is hereby ratified and affirmed.
Section 5. Effective Date. This resolution is necessary to respond to an ongoing emergency
and shall be effective immediately upon passage by the Federal Way City Council.
