The BLA will not change the location or configuration of the WTC or its accessory parking but will adjust the lot boundaries so that the accessory parking will be located on separate lots adjacent to the WTC lot. This is consistent with the requirements of both the current Federal Way Revised Code (“Code” or “FWRC”) and the Weyerhaeuser Company Concomitant Pre-Annexation Zoning Agreement (“CZA”) relating to allowed uses and parking. In the Corporate Park-1 (“CP1”) zone in which the subject property is located, the CZA allows a range of commercial and industrial uses. CZA, Ex. C, Section VII.A.14. The WTC houses uses allowed in the CP-1 zone. The existing parking surrounding it is accessory to the WTC and is allowed to be on separate lots because it is accessory to a permitted use. The Code expressly allows accessory parking on adjacent lots. FWMC 19.130.110(1) states that the required number of spaces shall be provided either on the subject property or “[o]n a lot adjoining the subject property, if that lot is in a zone that permits the use conducted on the subject property.” Here, with the BLA, the parking for the WTC will be located on adjoining lots. As discussed below, the CP- 1 zone in which these lots are located permits accessory parking to be located on lots other than the one on which the principal use is conducted. The CZA allows accessory parking to be located on a different lot than the primary use in the CP-1 zone. Specifically, the CZA expressly allows off-site parking within 800 feet of a development. CZA, Ex. C, Section XIII.B.1. Here, all the parking for the WTC is within 800 feet of the WTC building. Indeed, historically, the parking for the WTC was located on adjacent parcels. This indicates the City’s prior recognition that accessory parking may be located on a separate lot from the principal use. See attached parcel map and aerial from 2015.
