Dear Mr. Anderson:
Thank you for your comments on the State Environmental Policy Act (SEPA) decision for the above-referenced
subdivision proposal. Several comment letters were provided to the city in response to the Determination of
Nonsignificance (DNS) issued on July 3, 2020. Your comments were related to the environmental impact
statement for wetlands, road study, and traffic issues on 304th Street; street cleaning; water pressure issues;
contact with the Autobahn Society; building setbacks; fencing; open space; and trees/forested areas. The city
will prepare a staff report to the hearing examiner that will address several of your comments. Prior to the
hearing, you will receive a copy of the staff report as well. A copy of your letter was forwarded to the
applicant and will be included as an exhibit in the staff report to the hearing examiner.
The city appreciates the comments provided. After careful consideration of the comments; however, the city
is retaining the DNS as issued and will not be modifying the DNS. An environmental impact statement is not
required for this property containing wetlands because no significant impacts to the environment are
proposed. The Federal Way Revised Code (FWRC) adequately addresses impacts to the critical areas, and the
city’s consultant, ESA, verified all wetland buffer impacts meet code requirements. Documents submitted for
this project, including applicant responses to previous comment letters and a Traffic Impact Analysis (TIA),
can be found using the following link, https://www.cityoffederalway.com/node/1962. Any appeal of the
DNS must be received by August 7, 2020, and include a filing fee.
In regards to the next steps, the city’s hearing examiner will be holding a public hearing on the proposed
subdivision. Notification of the upcoming public hearing will be provided through mailing to all parties of
record, and to each property owner within 300 feet of the site; posting of the site and public places; and
publication of a legal notice in the newspaper. A date for the public hearing has not been set.
