Dear Mr. Sammon:
This letter confirms your oral authorization to provide earthwork observation and geotechnical
testing services at the subject site. Our scope of services on this project will include
provision of on-site observations and monitoring the geotechnical aspects of project
construction. Specifically, our scope will include:
• Verify site drainage measures are as recommended,
• Monitor rockery construction
An engineer from this office will periodically monitor the field technicians' work, review field
data from the project as necessary and will be available to answer any questions pertaining
to the geotechnical aspects of earthwork operations or construction. Upon completion of our
work on the project, we will submit a written final report summarizing our observations.
Please notify us if you require a change in the scope of our services.
ECI shall not be responsible for the following:
1) the means, methods, procedures, techniques, or sequences of construction,
2) the safety on the job site,
3) dimensional measurements, or
4) the contractor's failure to carry out the work in accordance with the
contract documents.
Our work does not include supervision or direction of the actual work of the contractor, his
employees or agents. The presence of our field representative at the site is to provide the
owner a source of professional advice, opinions and recommendations base upon the field

representative's observations of the contractor's work. We will observe the earthwork
construction and inform the contractor or your agent when the required results are not
obtained. Suggestions may be made to assist in obtaining the ultimate project objectives.
Any directives affecting the construction agreement or contract should come from the owner
or general contractor, as appropriate.
All rockery construction should meet with the standard rockery construction guidelines set
by the Associated Rockery Contractors (ARC Guidelines).
We should be provided with all current plans, specifications and documents relating to our
work. We suggest that we be allowed to review the plans prior to construction to verify
that the foundation design is in accordance with our recommendations.
Our fee for the above work and the terms under which our services are offered will be in
accordance with the attached Standard Fee Schedule and General Conditions, which are
made a part of this agreement. These fees will be determined on a time-and-materials basis.
For cost-estimating purposes, our fees will average approximately $250/day for part-time
services and $450/day for full-time (8 hours) services. These figures include the on-site
services of a senior level technician, associated laboratory testing, project reports, a final
report, and project management. Based on this information, we estimate our fee for the
construction-related portion of our services will be on the order of $750. Our fees can be
broken down generally as follows:
• Approximately 1 part/full-time visit to verify that site drainage measures are as
recommended.
• Approximately 2 part-time visits for rockery construction observation.
An invoice for this work will be submitted on a monthly basis to you as our client. Payment
of services performed under this contract acknowledges acceptance of all terms and
conditions of this agreement, including the attached Standard Fee Schedule and General
Conditions.
PLEASE NOTE OUR LIABILITY LIMITATIONS DESCRIBED IN THE ATTACHED
STANDARD FEE SCHEDULE AND GENERAL CONDITIONS. The professional liability
limit of $25,000 or our fees, whichever is greater, can be increased to a maximum coverage
of $1,000,000 for an additional charge of six percent of our fees or a minimum charge of
$500, whichever is greater.
Please verify your oral authorization by signing and returning one copy of the attached
Standard Fee Schedule and General Conditions. Also, please indicate whether or not you
wish to have the professional liability limit raised. We are proceeding on the basis of your
oral authorization with the assumption that the contents of this letter are acceptable. If
these terms are unacceptable, please contact us immediately.
