It is my understanding you have agreed to allow him to move the sign back for the widening of the road and change out the top two signs to agree with the present brand of tires his store carries. Please note we are not going up as high as the existing signs are, (approximately 8' less), and the new signage will give the sign a much cleaner look. Thanks for working with us on this project. It is important for us to coordinate closely on this issue because Federal Way codes will impact the relocation of signs. To assist you in coordination I have assigned Martin Nordby, Code Compliance Officer, to serve as project manager for sign compliance. It is our opinion that the best way to achieve success is to assist you in designing a sign relocation plan. To that end Mr. Nordby is available to meet with appropriate parties as soon as is convenient. Copies of the sign code and other applicable codes are enclosed for your review. I would like to highlight a few of the more pertinent sections for you. Initial review of the Code would indicate the following general considerations: * Portable signs are not currently allowed and so will have to be removed consistent with these existing regulations. * All relocated signs will have to adhere to setback requirements. * All relocated signs will have to comply with sight distance requirements at intersections. More specifically, the following selected Code sections are reproduced for your convenience: FWZC 95. 60 - Location of Signs i. General a. " . . . [E]ach sign must be located on the same lot or property as the use, building, or event with which the sign is associated. " • Page 2 Birney G. Mellor 16th Ave. Widening b. "All signs shall be located outside those areas required in Chapter 115 of this Code to be kept clear of sight obstructions. " 2 . Exceptions c. "Monument signs must be set back at least 5 feet from all property lines. . . . " (Please note, the Sign Code makes no specific provision for pole signs. For that reason all freestanding permanent signs are considered monument signs for purposes of calculating the setback. ) FWZC 95.75 - Prohibited Devices li. " . . . [A]ny portable outdoor sign. " Other related Code requirements include; FWZC 115 MISCELLANEOUS USE, DEVELOPMENT AND PERFORMANCE STANDARDS 115 . 130 - Siaht Distance at Intersection 1. General - " . . . [A] ll intersections including the entrance of driveways onto streets, must be kept clear of sight obstructions. " 3 . Permissible Intrusion in the Area to be Kept Clear of Sight Obstruction a. General - "Except as stated in paragraph 3 .b. of this Section or unless specifically approved by the Public Works Director, no structure. . .may be within the area that must be kept clear of sight obstructions between 3 feet and 8 feet above the elevations of the pavement edge of each intersecting street or driveway where that street or driveway meets the point of the triangle, that forms this area, furthest away from the intersection. " b. Exceptions 1. "Any structure erected before the effective date of the Code. " 3 . "Any number of tree trunks and sign or utility poles if the Public Works Director determines that adequate visual access is available between the tree trunks or poles. " Measurements for the sight distance triangle are found in the charts in FWZC 115 . 130 by type of intersection and posted speed. • Page 3 Birney G. Mellor 16th Ave. Widening FWZC 165 - NON-CONFORMANCE 165. 25 Immediate Compliance with Certain Provisions Required 1. General - "Regardless of any other provision of this Chapter, the following non-conformances must be immediately brought into conformance with the applicable provisions of this code: " k. "Non-conformance with the provision in Chapter 95 of this Code regarding portable outdoor signs. " It is also significant to note that under FWZC 165. 35. 5e all permanent signs will be required to fully conform to the Sign Code by March 1, 1995 . It may be to the advantage of many businesses to bring their signs into complete compliance while being relocated. An awareness program should be initiated to give them an opportunity to take appropriate action. It may save them time and expense. Mr. Nordby is also available to assist in this effort.
