Background
Seattle recently implemented a graduated income tax
for its residents.
The income tax was struck down by the courts, partly
because the tax was not uniformly applied to all
citizens.
Some lawyers have read the analysis of the case done
by the court of appeals in a way that seems to support
the idea that a local income tax applied to all would be
legal. This is not settled law at this time.

The agenda setting committee requested that a
resolution be prepared wherein City Council can
express its opposition to the idea of imposing a local
income tax in the City of Federal Way.
There are no current plans or requests to actually
impose such a tax, and the legality of such a tax
remains an open question.

Mayor’s Recommendation
Approve the proposed Resolution opposing the
imposition of a local income tax.
