2020-10-15 Council Minutes - Special'k CIT V;L%� Federal Way CITY COUNCIL SPECIAL MEETING MINUTES Remote Meeting October 15, 2020 — 5:30 p.m. 1. CALL MEETING TO ORDER Mayor Ferrell called the meeting held remotely to order at 5:31 p.m. City officials in attendance: Mayor Jim Ferrell, Council President Susan Honda, Councilmember Lydia Assefa-Dawson, Councilmember Greg Baruso, Councilmember Hoang Tran, Councilmember Martin Moore, and Councilmember Linda Kochmar. City staff in attendance: City Attorney Ryan Call and City Clerk Stephanie Courtney. 2. PLEDGE OF ALLEGIANCE Mayor Ferrell led the flag salute. 3. CITY COUNCIL FINAL INTERVIEWS FOR VACANT POSITION 5 Mayor Ferrell overviewed the process indicating each applicant would be given three (3) minutes to introduce themselves and provide their background. Following introductions, each applicant would be asked one question from each Councilmember and Council President with a limit of two (2) minutes per response. EXECUTIVE SESSION 5:35 p.m — 6:05 p.m. 6:10 p.m. — 6:40 p.m. 6:45 p.m. — 7:15 p.m. 7:20 p.m. — 7:50 p.m. 7:55 p.m. — 8:25 p.m. • Evaluate Qualification of Individual for Appointment to Elected Office pursuant to RCW 42.30.110(1)(h) At 8:23 p.m. Mayor Ferrell announced the Council would recess into Executive Session for the purpose of discussing qualifications per RCW 42.30.110(1)(h); anticipated duration was forty-five (45) minutes. At 9:07 p.m. Mayor Ferrell announced the Council Executive Session would be extended an additional twenty-five (25) minutes Federal Wav City Council Special Minutes Page 1 of 4 October 15, 2020 The Mayor reconvened the meeting at 9:36 p.m 5. COUNCIL BUSINESS Appointment to fill vacant City Council position 5 Mayor Ferrell read through process from Council Rules of Procedure and opened the floor for nominations. No second is required. Councilmember Moore nominated Jack Dovey. Councilmember Tran nominated Leandra Craft. Mayor called for additional nominations, hearing none he asked for a motion to close nominations COUNCILMEMBER BARUSO MOVED TO CLOSE NOMINATIONS; COUNCILMEMBER KOCHMAR SECOND. The motion passed unanimously as follows: Council President Honda yes Councilmember Tran yes CouncilmemberAssefa-Dawson yes Councilmember Moore yes Councilmember Baruso yes Councilmember Kochmar yes The Councilmembers spoke to their nominations. COUNCIL PRESIDENT HONDA MOVED TO EXTEND THE MEETING PAST 10:00 P.M.; COUNCILMEMBER BARUSO SECOND. The motion passed unanimously as follows: Council President Honda yes CouncilmemberAssefa-Dawson yes Councilmember Baruso yes Council discussion continued. Councilmember Tran yes Councilmember Moore yes Councilmember Kochmar yes The City Clerk conducted a roll call vote by position order as follows: Councilmember Assefa-Dawson Craft Councilmember Baruso Craft Councilmember Tran Craft Councilmember Moore Dovey Councilmember Kochmar Dovey Council President Honda Dovey The Mayor declared a tie -vote COUNCILMEMBER MOORE MOVED TO RECESS TO EXECUTIVE SESSION TO FURTHER DISCUSS QUALIFICATIONS (PURSUANT TO RCW 42.30.110(1)(h)J. Motion died for lack of a second. Mayor Ferrell announced at 10:23 p.m. the Council would take a brief five (5) minute recess The Council returned at 10:34 p.m. Councilmember continued to debate candidates. The City Clerk conducted a roll call vote by position order as follows Councilmember Assefa-Dawson Craft Councilmember Baruso Craft Councilmember Tran Craft Councilmember Moore Dovey Councilmember Kochmar Dovey Council President Honda Dovey Mayor Ferrell declared a tie -vote. COUNCILMEMBER MOORE MOVED TO RECESS TO EXECUTIVE SESSION TO FURTHER DISCUSS QUALIFICATIONS [PURSUANT TO RCW 42.30.110(1)(h)]; COUNCILMEMBER KOCHMAR SECOND. Motion failed 4-2 as follows: Council President Honda no Councilmember Tran no CouncilmemberAssefa-Dawson no Councilmember Moore yes Councilmember Baruso no Councilmember Kochmar yes Due to the apparent lack of consensus, the City Council members suggested the option of adjourning the meeting and calling an additional special meeting next week. COUNCILMEMBER MOORE MOVED TO ADJOURN THE MEETING AND CALL FOR A SPECIAL MEETING ON MONDAY, OCTOBER 19; COUNCIL PRESIDENT HONDA SECOND. Multiple Councilmembers stated their disagreement for an additional meeting and expressed their desire to move to the next phase of the process. Council President Honda suggested a friendly motion to amend the date to Tuesday, October 20, prior to the Finance Committee meeting. Councilmember Moore accepted the friendly amendment. The motion failed 3-3 as follows: Council President Honda yes Councilmember Tran no CouncilmemberAssefa-Dawson no Councilmember Moore yes Councilmember Baruso no Councilmember Kochmar yes Mayor Ferrell called for a third vote. The City Clerk conducted a roll call vote by position order as follows: Councilmember Assefa-Dawson Craft Councilmember Baruso Craft Councilmember Tran Craft Councilmember Moore Dovey Councilmember Kochmar Dovey Council President Honda Dovey Mayor Ferrell declared a tie -vote and announced as the Council has exhausted debate and it appears there is no movement towards consensus, he invokes his right to break a tie -vote. Mayor Ferrell cast a vote for Leandra Craft. Federal Way Cir); Council Special Minutes Page 3 of 4 October 15, 2020 With a 4-3 vote, Mayor Ferrell congratulated Councilmember Leandra Craft. 6. OATH OF OFFICE City Clerk Stephanie Courtney administered the Oath of Office virtually to Councilmember Craft and congratulated her. 7.
