RES 20-800 - Setting 2021 Property Tax Levy RESOLUTION NO. 20-800 A RESOLUTION of the City of Federal Way, Washington, making a finding of substantial need for purposes of setting the limit factor for the 2021 property tax levy. WHEREAS, the City Council of the City of Federal Way has met to consider its budget for the biennial 2021/2022; and WHEREAS, under RCW 84.55.005(2)(c), the limit factor for a taxing jurisdiction with a population of 10,000 or more is the lesser of 101 percent or 100 percent plus inflation; and WHEREAS, the City of Federal Way has a population greater than 10,000; and WHEREAS, "inflation" as defined as the percentage change in the implicit price deflator for personal consumption expenditures for the United States for the most recent twelve-month period is .60152 percent; and WHEREAS, RCW 84.55.0101 provides for use of a limit factor of 101 percent instead of 100 percent plus inflation with a finding of"substantial need" by a majority plus one of the City Council; and WHEREAS, City Council of the City of Federal Way has determined that due to continued increasing operational expenses and declining revenues from fees and other taxes, there is a substantial need to set the levy limit at one hundred one percent (101%) for the budget year 2021. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, RESOLVES AS FOLLOWS: Section 1. A finding is made of substantial need under RCW 84.55.0101, which authorizes the use of a limit factor of 101 percent for the property tax levy for 2021. Resolution No. 20-800 Page 1 of 3 Section 2. y��a9� P ty, If any section, sentence, clause or phrase of this resolution should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause, or phrase of this resolution. Section 3. Corrections. The City Clerk and the codifiers of this resolution are authorized to make necessary corrections to this resolution including, but not limited to, the correction of scrivener/clerical errors, references, resolution numbering, section/subsection numbers and any references thereto. ection 4. Ratification. Any act consistent with the authority and prior to the effective date of this resolution is hereby ratified and affirmed. Section 5. Effective Date. This resolution shall be effective immediately upon passage by the Federal Way City Council.
