In considering your request, Public Works' staff have evaluated the existing conditions along South 299th Place, reviewed Federal Way City Code(FWCC) Sections 22-1473-1477, and considered past direction provided by the City Council. FWCC Section 22-1477 "Modification of Improvements • Along Property Frontage" allows the Public Works Director to modify, defer, or waive required street improvements only after consideration of four specific reasons. The following responds to your request: The reason most applicable to your request is FWCC 22-1477(1) which states: "improvements as required would not be harmonious with existing street improvements, would not function properly or safely or would not be advantageous to the neighborhood or city as a whole". Staff Response and Decision: The proposed development is a second story addition to a existing, single family home, with 80 feet of frontage on South 299th Place. Applicability of required improvements at this time would not create improvements that are harmonious with the existing street system consisting of a 28-foot paved roadway, asphalt curb both sides, and a 60-foot right of way width. Additionally, construction of required improvements would not serve the neighborhood in an advantageous manner. The City hereby grants a waiver of the required improvements. The property owner must sign a No Protest Local Improvement District Agreement (LID) covenant in the event that a future LID is formed to make street improvements. The enclosed LID agreement has been prepared for the owner's signature and must be notarized and returned to the city with a $9.00 check for recording fee made payable to King County Records and Elections, prior to the issuance of a building permit.
