crews who maintain safe work environments and for Human Resources who manage the
program. He also recognized the importance of good leadership from the Mayor and Council
in promoting safe work environments.

to provide remarks regarding the importance of recognizing Black History and celebrating
the Black Community every day, and not just one month a year.
0 State of the City Address
Mayor Ferrell announced the annual State of the City Address will be held on
February 25 at 6:00 p.m. He noted due to the restrictions from COVID-19, the
event will be held virtually via Channel 21, YouTube and Facebook Live. He is
excited to highlight the past year of accomplishments and share what is to come.
Emergency Manager Ray Gross provided an update on the current vaccine
distribution and vaccination phase. He highlighted the King County Dashboard
which has various COVID-related information and noted the vaccine distribution
is being handled through multiple partners including public health clinics, pop-
up mobile sites, high volume retail sites and long-term care facilities. He also
provided the information specific to Federal Way.
Councilmembers thanked Mr. Gross for the information and asked clarifying
questions regarding the use of the King County Aquatics Center for testing and
future vaccination and if private testing sites are reporting results to the county.
It was also noted that the senior community appreciates hearing COVID-19
updates during the meetings. Other questions were related to the percentage of
total vaccine distribution in Washington State and the status of the Johnson &
Johnson vaccine currently in testing.

Mayor Ferrell reported on the drive-thru Food Drive held on January 30 1 support
of the Federal Way Senior Center. Councilmember Baruso noted this event
typically is hosted at five or six stores, but it was to ensure all safety precautions
were managed. He announced they were able to collected 1,500 pounds of food
and $282 in cash donation. Councilmember Baruso thanked Chris Brown, Jeri -
Lynn Clark, and the city Diversity Commission for their support in organizing the
event which maintained social distance by allowing donations to be collected
from cars.
The Mayor reported on the most recent African American Community Quarterly
Meeting which was held on January 27, 2021 via Zoom. He noted the
conversation was very honest and emotional at times; he thanked all that
attended and spoke as he appreciates hearing the voices in our community. He
also thanked the Councilmembers who were able to attend.
Communications and Government Affairs Coordinator Steve McNey noted the
city's longtime contracted lobbyist recently ended his contract with the city as he
accepted a position with the Washington Tribes. Mr. McNey acknowledged the
difficult timing related to the legislative session however, the Mayor has pivoted
and has secured short term contract through the end of the session with two
reputable lobbyists. He indicated he will provide a more thorough once this
transition has been finalized and his belief the city is lucky to be working with the
new team and will see project funding this session.

Councilmembers thanked Mr. McNey for the information and the Mayor for
quick action on finding a new lobbyist.

Begy TaAo spoke in concern over landlord/tenant issues and would like to see a new
ordinance in Federal Way which provides more protection for tenants by requiring an
independent inspection prior to moving in a rental unit. She thanked the Mayor and City
Council for listening and being responsive to her concerns.
Nlison Fine asked the city to review traffic light timing and overall safety on South 348 th
Street near WinCo. She spoke in concern over a recent video of a young girl being detained
by police elsewhere in the country using drastic measures. She would like to make sure
there are procedures in place to prevent the same happening in Federal Way.

printer maintenance contract. He noted due to timing this contact did not go through the
FEDRAC Committee. This contract is with Copiers Northwest who has worked with the
city since 2011 and has a great service history.

Councilmember Baruso supports Councilmember Assefa-Dawson's suggestion of supporting local
black businesses this month for Black History Month.
Councilmember Craft wished everyone a Happy Lunar New Year and also acknowledged Black
History Month. She thanked Councilmember Assefa-Dawson and Councilmember Baruso for their
call to action and would like to encourage the community to attend any of the number of virtual
events this month celebrating Black History. She was happy to assist with the drive-thru food drive
where she was able to engage with the community.
Councilmember Moore encouraged everyone to celebrate the black community 365 days a year
and not just one month a year. He thanked Councilmember Baruso for his leadership with the drive
which supported the Senior Center Food Bank. He also thanked Jeri -Lynn Clark and the Diversity
Commission for the assistance in planning the event. He recently attended the African American
Quarterly meeting and felt it was an authentic meeting and appreciates the powerful voices in our
community. He supports a rental inspection program and feels tenants should be able to come to
the city for an inspection.
Council President Honda reported on her attendance at the Public Health Meeting with Director
Patty Hayes. She noted everyone should make sure they are wearing a properly fitted mask,
maintain social distancing and get the vaccination if able. She is concerned the phases may get
rolled back and emphasized supporting local businesses and restaurants who are struggling. She
noted there are many things to celebrate this month including Black History Month, Valentine's
Day, and the anniversary of the city's incorporation.

FINANCIAL IMPACTS:
The cost to the City for the 2021 Asphalt Overlay Project was included within the approved budget under the Public
Works Department Arterial Street Fund (Fund 102). In accordance with the approved budget, this item is funded by
Fuel Tax Revenue, which is a restricted funding source, and Solid Waste Utility Tax, which is also a restricted fundi
source. Upon completion of the 2020 Asphalt Overlay Project, no other ongoing costs are anticipated. I
BACKGROUND:
Six bids were received and opened on January 19, 2020 for the 2021 Asphalt Overlay Project; please see attached Bid
Tabulation Summary. The lowest responsive, responsible bidder is Tucci and Sons Inc., with a total bid of
$1,494,630.70
AVAILABLE FUNDING:
The available budget for the 2021 Asphalt Overlay Project is $1,901,000 and is comprised of the following -
a Motor Vehicle Fuel Tax (Fund 102) $599,000

Prior to release of retainage on a Public Works construction project, the City Council must

Mr. Kurt Mayer owns water front property adjacent to 53rd Avenue SW. Mr. Mayer wishes to
extend this lease agreement for an additional 5 years. The only access to the property is through a
dirt path on the unopened portion of 53rd Avenue SW and a tram system constructed by
Mr. Mayer on a leased portion of the unopened 53rd Avenue SW.
The original lease was approved by the City Council on March 15, 2005, extended to March 23,
2015 and again to March 23, 2020. The total right of way leased by Mr. Mayer is 3,426 sq. ft.
Original cost of annual rent of $1.00 per square foot per year for a total of $17,130.00 for the
first five years plus 12.84% leasehold excise tax.

roadway, provide ADA upgrades, and pavement markings.
City Council approved applying for the Pacific Highway Non -Motorized Corridor — l6th Avenue
308th Street to S 288th Street Project grant to PSRC on March 17, 2020. The S 288th Street —
16th Ave S to 34 1h Ave S project will consist of a trail that for portions of the alignment will be
parallel to Pacific Highway S and for portions of the alignment will be located within the (partially
unopened) right-of-way for 16th Avenue S. The project will include pedestrian -scale lighting, signal
modifications at S Dash Point Road, ADA facilities, walls, and landscaping.
City Council approved applying for the Citywide Pedestrian Safety Project grant to WSDOT on
February 4, 2020. The project will construct crosswalk improvements at 8 locations includinii
Rectangular Rapid Flashing Beacons, median refuge islands, overhead mounting across 5-lan�-�
streets, illumination, and ADA facilities.
City Council approved applying for the 27th Avenue SW at SW 344 th Street Compact Roundabout
Project grant to WSDOT on February 4, 2020. The project will construct a compact roundabout with

In May of this year staff informed former Elevator Services Contractor, Thyssen Krupp,
that we were terminating our agreement at the conclusion of the 5-year term at both City
Hall and the FWCC. Over the years, there was a lack of communication and customer
service that frequently left staff feeling frustrated due to unresponsiveness or the lack of
communication.
In 2019, Facilities staff reached out to Thyssen Krupp in regard to elevator upgrades.
Thyssen Krupp provided modernization estimates that were not reasonable and more
than double the available budget. After trying to work with our account representatives
on three separate occasions they continued to push modernization upgrades that staff
did not feel was necessary and was over our budget; Thyssen Krupp was unwilling to
reduce their scope or meet the scope that best fit the City.
At this point, staff decided it was time to research our options for a new Elevator
Services provider. Staff met with Otis and Eltec, both on state contract, to discuss the
specifics of entering into a new Elevator Services Contract. In these conversations,
Eltec was the only company that has sourcing to service our existing elevator controls.
Both Thyssen Krupp and Otis were not able work with existing controls and insinuating
that we need to fully replace the control system, which is very costly and not necessary.
We met with Eltec and that discussion left staff feeling like they were the best contractor
fit for our needs. Additionally, some of the services provided in their contract are
charged as extras by the other two providers. Although, the monthly rate is a little more,
we will be saving money on these additional services the other two providers charge
additional for or that we had to sub -contract. Over the term of the contract we will be
money ahead with Eltec, as opposed to the other providers.

1. TERM. The term of this Agreement shall commence upon the effective date of this Agreement, which shall be the date
of mutual execution, and shall continue until the completion of the Work, but in any event no later than December 31, 2026
("Term"). This Agreement may be extended for additional periods of time upon the mutual written agreement of the City and
the Contractor.
2.1 Work. The Contractor shall provide goods, materials or services and otherwise perform the work more

3. TERMINATION. During each contract year that this Agreement is in existence, Owner agrees that its right to
and testing of the equipment. Prior to each year's annual inspection, either party may terminate this Agreement with or without
cause, upon 30 days' written notice. Nothing herein shall impact Owtier's right to terminate this Agreement for cause.
4.1 Amount. In return for the Work, the City shall pay the Contractor an amount not to exceed a maximum amount
and according to a rate or method as delineated in Exhibit "B," attached hereto and incorporated by this reference. The
Contractor agrees that any hourly or flat rate charged by it for its services contracted for herein shall remain locked at the

payment of any taxes imposed by any lawful jurisdiction as a result of the performance and payment of this Agreement.
4.2 On a monthly basis, the Contractor shall submit a voucher or invoice in the form specified

any hourly labor charge rate for such personnel. The Contractor shall also submit a final bill upon completion of all Work.

5. INDEMNIFICATION.
5.1 Contr . The Contractor agrees to release indemnify, defend, and hold the City, its elected
officials, officers, employees, agents, representatives, insurers, attorneys, and volunteers harmless from any and all claims,

5.2 .1bdustfial Insur, ce, Act WaiVet� It is specifically and expressly understood that the Contractor waives any
immunity that may be granted to it under the Washington State industrial insurance act, Title 51 RCW, solely for the purposes
of this indemnification. Contractor's indemnification shall not be limited in any way by any limitation on the amount of
damages, compensation or benefits payable to or by any third party under workers' compensation acts, disability benefit acts or
any other benefits acts or programs. The Parties further acknowledge that they have mutually negotiated this waiver.
5.3 Iry Indemnification. The City agrees to release, indemnify, defend and hold the Contractor, its officers,
directors, shareholders, partners, employees, agents, representatives, and sub- contractors harmless from any and all claims,

5.4 Survival. The provisions of this Section shall survive the expiration or termination of this Agreement with
respect to any event occurring prior to such expiration or termination.
6. INSURANCE. The Contractor agrees to carry insurance for liability which may arise from or in connection with the
performance of the services or work by the Contractor, their agents, representatives, employees or subcontractors for the

6.3. Additional Insured Verification� The Citv shall be named as additional insured on all commercial general
liability insurance policies. Concurrent with the execution of this Agreement, Contractor shall provide certificates of
insurance for all commercial general liability policies attached hereto as Exhibit "C" and incorporated by this reference. At
City's request, Contractor shall fumish the City with copies of all insurance policies and with evidence of payment of
premiums or fees of such policies. If Contractor's insurance policies are "claims made," Contractor shall be required to

7. CONFIDENTIALITY. All information regarding the City obtained by Contractor in performance of this Agreement

public disclosure request.

• The City agrees to maintain proper code compliance throughout the term of this agreement. The contractor
reserves the right to suspend service for outdated code report completion items or other inspections in the event
that the City disregards the Contractor's advice.
• Possession or control of the equipment shall remain exclusively yours as owner, lessee, possessor or
custodian.
• The City's responsibility includes, but is not limited to, instructing or warning passengers in the proper use
of the equipment, taking the equipment out of service when it becomes unsafe or operates in a manner that might
cause injury to a user, promptly reporting to the Contractor any accidents or any condition which may need
attention and maintaining surveillance of the equipment for such purposes. Nothing in this clause relieves the
Contractor of its duty to conduct regularly scheduled inspections and follow commercially reasonable practices
in those inspections.
• The City will provide the Contractor unrestricted access to the equipment, and a safe workplace for our
employees, but it shall be the Contractor's responsibility to supervise its employees and follow legally required
safety procedures and provide safety equipment for its own employees.
• The City agrees that it will keep the pits and machine rooms clear and free of water and trash and not permit
them to be used for storage; and provide supply power of proper voltage and free of aberrations.
• The City agrees that it will not permit others to make changes, adjustments, tests, additions, repairs or
replacements to the equipment.
• The City will provide the Contractors with wiring diagrams, operation and maintenance manuals and any
other original manufacturer information and equipment necessary to maintain the machinery.
• The City will ensure that machine rooms are properly ventilated, and humidity and temperature controlled in

Background:
The Human Services Commission is comprised of nine (9) voting members and up to three (3) alternates who are
appointed by the City Council to serve three-year terms (per FWRC 2.55.020). There are currently four (4) vacant
voting positions due to to expirations and one (1) vacant alternate position. Seven (7) applications were received
in response to the City Clerk's recruitment process.
At their February 16, 2021 Special Meeting the Council interviewed seven applicants seeking appointment to the
Human Services Commission (Katherine Festa, Jack Walsh, Eric Owen, and Grace Ssebugwawo Namagga as well
as Betty Taylor, Sofia Mayo, Joseph Franco who are current alternates seeking appointments to voting positions).

Financial Impacts:
This code amendment requires 4 new signs, costing under $500, which will be charged to the
Lakota Safe Routes to School Capital project.
Speed limit sign maintenance is included in Public Works Department Traffic Division operating
budget.
Background Information:
As part of the grant application submitted for the current Lakota Middle School Safe Routes to
School project, staff proposed to lower the speed limit from 40 mph to 35 mph on SW Dash
Point Road between 2 1 st Avenue SW and 16th Avenue SW. This coincides with the new school
zone and an increase in turning conflicts compared to the rest of the 40-mph zone to the east. As
part of the project review, since SW Dash Point Road is a state highway, Washington State
Department of Transportation requires us to conduct an analysis justifying the reduced speed
limit and have ordinance language adopting it.
