During our research of the Nov 8, 2018 modification request, it was found that the Phase I Village Green development did not dedicate any right of way along 1st Ave S. Because the dedication did not occur, the existing 8-foot sidewalk, and most of the 6-foot planter strip remain on the Village Green property. Subsequent to that initial research, and with your recent request, it's been determined that the dedication requirement for Phase I was for 15-feet, for a total of a 45-foot wide right of way on the Village Green side of 1 st Ave S. Subsequent to the development of Phase I, the City adopted a street classification system, with standard street cross -sections developed for each street classification. Under this system, 1 st Ave S was classified as a Minor Arterial, corresponding to Street Section `C', which requires a 72- foot paved roadway, 6-foot planter strips, 8-foot sidewalks and 3-foot utility strips in a 106-foot right of way (53-foot %2—street ROW). After evaluating your request, review of Federal Way Revised Code (FWRC) provisions (Sections 19.135.070 and 19.135.090), and direction provided by the City Council, the Public Works Department hereby approves your request, with the following condition: The owner will be required to dedicate 15-feet for right of way dedication along the Phase I frontage, and the additional 8-feet (to meet current Type C street section) shall be set aside in a Tract `X' for future ROW dedication, at the time that Ist Ave S is improved to meet the Type C \\CFWF[LE I\Applications\CSDC\PROD\docs\save\ 1548 18_78968_02073423,DOC cross-section. The dedication and Tract `X' shall occur prior to final Land Use approval for the current, Phase II, application. The conditions of this right-of-way modification will be applicable for a period of one year. If a Land Use approval is not issued within the one year time period, this waiver will be void, and a new request for modification shall be submitted.
