A RESOLUTION of the City of Federal Way, Washington, authorizing
execution of Local Agency Agreements with the Washington State
Department of Transportation regarding: (1) Military Road S — S 320th
Street to South City Limits Preservation Project; (2) Pacific Highway
Non -Motorized Corridor — 16th Avenue S — S 308t' Street to S 288'
Street; (3) Citywide Pedestrian Safety; and (4) 27th Avenue S at SW
344th Street Compact Roundabout in the City of Federal Way,
Washington.
WHEREAS, the City of Federal Way applied for federal funds from the Puget Sound
Regional Council for the purpose of the construction of the Military Road S — S 320th Street to
South City Limits Preservation Project within the City; and
WHEREAS, the City of Federal Way applied for federal funds from the Puget Sound
Regional Council for the purpose of the construction of the Pacific Highway Non -Motorized
Corridor —16th Avenue S — S 308th Street to S 288th Street Project within the City; and
WHEREAS, the City of Federal Way applied for federal funds from the Washington State
Department of Transportation for the purpose of the construction of the Citywide Pedestrian Safety
Project within the City; and
WHEREAS, the City of Federal Way applied for federal funds from the Washington State
Department of Transportation for the purpose of the construction of the 27th Avenue SW at SW
344th Street Compact Roundabout Project within the City; and
WHEREAS, Puget Sound Regional Council agreed to grant the City of Federal Way
federal funds in the total amount of Six Hundred Thousand and no/l00 Dollars ($600,000.00) for
the construction of the Military Road S — S 320th Street to South City Limits Project provided

that the City Council authorizes the Mayor to enter into the required Local Agency Agreement;
WHEREAS, Puget Sound Regional Council agreed to grant the City of Federal Way
federal funds in the total amount of Seven Hundred Twenty -Five Thousand and No/100 Dollars
($725,000.00) for the construction of the Pacific Highway Non -Motorized Corridor —16th Avenue
S — S 308th Street to S 288th Street Project provided that the City Council authorizes the Mayor
to enter into the required Local Agency Agreement; and
WHEREAS, Washington State Department of Transportation agreed to grant the City of
Federal Way federal hinds in the total amount of One Million Two Hundred Forty Thousand and
No/100 Dollars ($1,240,000.00) for the construction of the Citywide Pedestrian Safety Project
provided that the City Council authorizes the Mayor to enter into the required Local Agency
Agreement; and
WHEREAS, Washington State Department of Transportation agreed to grant the City of
Federal Way federal funds in the total amount of Six Hundred Ninety -Five Thousand and No/l00
Dollars ($695,000.00) for the construction of the 27th Avenue SW at SW 344th Street Compact
Roundabout Project provided that the City Council authorizes the Mayor to enter into the required
Local Agency Agreement.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY,
RESOLVES AS FOLLOWS:
Section 1. Receipt of Federal Funds. The Mayor or his designee is hereby authorized to
accept the federal funds in the amount of Six Hundred Thousand and No/100 Dollars
($600,000.00) for the construction of the Military Road S — S 320th Street to South City Limits
Project; Seven Hundred Twenty -Five Thousand and no/100 Dollars ($725,000.00) for the

construction of the Pacific Highway Non -Motorized Corridor — 16th Avenue S — S 308th Street to
S 288th Street Project; One Million Two Hundred Forty Thousand and No/100 Dollars
($1,240,000.00) for the construction of the Citywide Pedestrian Safety Project; and Six Hundred
Ninety -Five Thousand and No/100 Dollars ($695,000.00) for the construction of the 27th Avenue
SW at SW 344th Street Compact Roundabout Project.
Section 2. Execution of the Local AgenU AAgreements. The Mayor or his designee is
hereby authorized to execute Local Agency Agreements regarding the Military Road S — S 320th
Street to South City Limits Project; the Pacific Highway Non -Motorized Corridor — 16th Avenue
S — S 308th Street to S 288th Street Project; the Citywide Pedestrian Safety Project; and the 27th
Avenue SW at SW 344th Street Compact Roundabout Project in the City of Federal Way,
Washington and any other required documents.
Section 3. Matching Funds. Pursuant to the terms of the Local Agency Agreements, the
City commits matching funds of up to Six Hundred Thousand and no/100 Dollars ($600,000.00)
for the construction of the Military Road S — S 320th Street to South City Limits Project; up to One
Hundred Fifteen Thousand and No/100 Dollars ($115,000.00) for the Pacific Highway Non -
Motorized Corridor — 16th Avenue S — S 308th Street to S 288th Street Project; up to Three -
Hundred Twenty Thousand and No/100 Dollars ($320,000.00) for the Citywide Pedestrian Safety
Project; and up to Fifteen Thousand and No/100 Dollars ($15,000.00) for the 27th Avenue SW at
SW 344th Street Compact Roundabout Project.
Section 4. Severability. If any section, sentence, clause or phrase of this resolution should
be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitutionality of any other section, sentence,
clause, or phrase of this resolution.

Section 5. Corrections. The City Clerk is authorized to make necessary corrections to this
resolution including, but not limited to, the correction of scrivener/clerical errors, references,
resolution numbering, section/subsection numbers and any references thereto.
Section 6. Ratification. Any act consistent with the authority and prior to the effective date
of this resolution is hereby ratified and affirmed.
Section 7. Effective Date. This resolution shall be effective immediately upon passage by
the Federal Way City Council.
