Dear Ms. Pehrson:
During our phone conversation last month, we discussed outdoor garden supply storage
needs for the Fred Meyer site. You inquired into the installation of a temporary chainlink
fence to accommodate outdoor garden sales and storage area from April to July. A
screened outdoor sales and storage area was approved by the city last year; however, Fred
Meyer corporate officials have told you that they do not wish to construct this sales area
because of the "screening impact".
The following responds to your inquiry about requirements for a temporary chainlink fence
for April to July outdoor sales of plants and garden supplies.
a) A temporary fence can be used for outdoor sales and storage up to two
months. After that time, the area would be considered permanent addition of
gross floor area, and must be surrounded by a six foot high solid screening
fence in accordance with Federal Way City Code (FWCC) Division 8, Outdoor
activities and storage, section 22-1 1 1 1(e). Your proposed timeline would not
meet temporary fencing requirements.
b) Per FWCC section 22-1 1 1 1(g), Modification, you may apply for a modification
to the screening requirements under the provisions of Use Process Il. The city
may approve the request if: (1) the modification will not create a greater impact
on any nearby residential use than would be created without the modification;
(2) the modification would not detract from the character of any use; and (3)
the modification will not be injurious to public health, safety, or welfare.
Under Use Process II, a Hearing Examiner conducts a public hearing and issues a
determination on the modification request, Use Process 11 fees are $2,163.00.

The Fred Meyer store opened in the fall of 1991 . The building permit, approved by King
County, did not include provisions for outdoor sales or storage, yet retail items have been
stored in the east parking lot since 1991 . An approved outdoor sales area is required in
order to bring the Fred Meyer site into compliance with Federal Way outdoor screening
requirements.
Following a notice of violation on February 24, 1992, a request to build a 6400 square foot
screened outdoor sales area was reviewed and approved under the following permits:
SEP93-0020, SPR92-0008, and BLD94-0395. The building permit, approved June 6, 1994,
has never been picked up and the required outdoor storage screening has not been
constructed. Outdoor sales and storage are still conducted in violation of Federal Way code
requirements.
In order to bring resolution to the on -going violation, a formal request to modify the
screening requirements in accordance with FWCC section 22-1 1 1 1 (g) must be submitted
With applicable fees, or the approved building permit must be picked up and construction
of the approved outdoor storage facility must'be begin before April 12, 1 995. If no
action has occurred by April 12, 1995, the matter will be turned over to a City Code
Compliance Officer and the City Prosecutor for enforcement action.
