Basis For Criteria The required setback from the property lines for all signs shall be not less than five feet in residential zones and not less than three feet from the subject property line in all other zones, per Federal Way City Code, section 22-1602(B). The required yard setback does not take into account wall mounted signs attached to buildings that may encroach into the sign setback. For example, Office uses and Retail uses permitted in Community Business zones may have buildings with zero setbacks from subject property lines. As such, if a building is setback one or two feet from the subject property line and a wall sign is proposed to be attached to that wall, the wall sign might encroach into the setback by default. Therefore, the Director of Community Development shall set criteria for wall mounted signs to encroach into the required yard setback, when a building would cause the encroachment. Criteria The following setback intrusion shall be permitted for any business in a residential zone or commercial zone which has a building that encroaches within the three or five foot sign setback requirement and which building has been approved by the City of Federal Way or by King County: A wall mounted sign shall be permitted to intrude into the 3 or 5 foot sign setback requirement, provided, however, the sign does not encroach into the public -right-of-way and provided the such sign does not exceed the limits of the subject property line. Rationale It is reasonable and valuable to the business and community at large to allow businesses to have signs placed on their buildings when there is no setback required for the building itself. The setback requirement was intended to regulate location for freestanding signs for the purposes of safety in an effort to avoid clearview zone obstruction and vehicle or pedestrian damage to the sign.
