Section 10.4 and Exhibit N of the Federal Way Link Extension Development Agreement (GA-0015-18; AG 19-117) lists the pre -approved haul routes within the City and indicates that "in the event that the Design -Build Contractor proposes the use of alternate routes to Sound Transit, Sound Transit shall obtain the City's approval prior to accepting the Design -Build Contractor's proposal." The Design -Build contractor has proposed the addition of a portion of S Star Lake Road as further outlined in green in Attachment A. Sound Transit has directed the Design -Build contractor to monitor and maintain the eco-blocks on -site, channelization markers and functionality during use of this haul route. The City concurs with this change subject to the conditions on its right of way use permit and subject to restoration in accordance with Section 10.7 and Section 10.8 of the Development Agreement and the following conditions. After the roadway section of S Star Lake Road is no longer needed as a haul route and prior to the required restoration, the City shall be provided the opportunity to inspect the road for structural damage. The City will determine whether a pavement analysis is required and/or if structure repairs are needed. No additional improvements, such as landscaping or sidewalks, beyond those required by Federal or State Law, such as ADA, to complete the restoration will be provided through this agreement. Pre -construction surveys will be coordinated with the city inspector and Highline Water District to document the impact of the ongoing waterline 20-1 project in this area. This is the City's approval of an alternate haul route as contemplated by Section 10.4 of the Development Agreement and is consistent with the Development Agreement. This concurrence does not modify any provisions of the FWLE Development Agreement and those provision shall remain in full force and effect.
