Should the City Council prohibit marijuana -related businesses?

Earlier this year the City Council enacted medical and
recreational marijuana moratoriums that will expire in May 2o16.
Subsequently, there have been changes in State law (HB 2136
and SB 5052) and the Federal Way advisory vote pertaining to
marijuana -related businesses.
Federal Way
Advisory Proposition No. 1 was a non -binding advisory vote
that allowed residents to inform the City Council whether they
were for or against marijuana -related businesses locating
within the City of Federal Way.
A "Yes" vote meant the voter was in favor of marijuana -
related businesses locating within the City of Federal Way. A
"No" vote meant the voter was against marijuana -related
businesses locating within the city.
Advisory Proposition No.1 did not pass, with 61% voting "No".

Senate Bill 5052 (CannabisPatient Protection Act)
Establishes regulations for the formerly unregulated medical
marijuana system and brings it under the existing regulations of
recreational marijuana.
As of July 1, 2o16, medical and recreational marijuana can only be
purchased at state licensed retail stores.
House Bill 2136 (Comprehensive Marijuana Market Reform)
Contains many provisions to ensure a regulated and taxed marijuana
market.
Federal Way
The ordinance to prohibit marijuana -related businesses includes
both recreational and medical marijuana businesses because
the regulation of medical marijuana will be merged with the
recreational system.
Medical marijuana cooperatives are not a business and are not
affected by the prohibition.
This would also not preclude a qualified patient or designated
provider from growing marijuana at home or in a cooperative.

The ordinance would prohibit marijuana -related businesses
and repeal the recreational marijuana moratorium (Ord. No. 15-
788).
The ordinance would take effect and be in force 3o days after
its passage and publication.

MAYOR'S RECOMMENDATION:
Adopt the ordinance to prohibit marijuana -related businesses
and repeal Ordinance No. 15-788.
SUSPENSION OF COUNCIL RULE: Staff f is requesting that Council suspend
Council Rule 2.2(8) to allow first reading and enactment in the same
meeting.
1ST READING AND ENACTMENT (DECEMBER 1): "1 move approval of the
proposed ordinance."
