POLICY QUESTION:
Should the Council approve an ordinance
that authorizes the City Attorney to
commence legal proceedings to acquire
the necessary properties for the Pacific
Highway South HOV Lanes Phase V
project by condemnation if the
negotiation process fails?

Background:
• Previously, the City Council authorized staff to
acquire right-of-way for the Pacific Highway
South HOV Lanes Phase V project for fair
market value.
• Staff has sent offer letters and has been working
on negotiating the purchases of the required
strip takes since February 17, 2015.
• A previous ordinance was passed providing an
initial condemnation list.
• This list if the final list of parcels that have not
settled since the initial list for condemnation
was approved by Council.

Background:
• The City will continue to negotiate with parcel
owners to see if settlements can be reached.
• The ordinance authorizes the City Attorney to
commence legal proceedings to acquire the
necessary properties by condemnation if the
negotiation process fails after a reasonable
amount of time, in order to allow the project to
proceed.
• The ordinance lists 10 property owners with a
total of 12 parcels.

1. Approve to send the condemnation ordinance for the

the City Council Meeting on September 15, 2015 for
the second reading.
2. Do not approve to send the condemnation ordinance
for the Pacific Highway South HOV Lanes Phase V
project to the City Council Meeting on September 15,
2015 for the second reading and provide direction to
staff.
