The proposed Hwang Short Plat consists of a single parcel (#8732180230) zoned RS7.2 and is a 78,238 square foot (1.796 acres) parcel of land located at 32604 45th Ct SW. The project site is located in the SE Quarter of the NW Quarter Section 14, Township 21 N, Range 3 E, WM, King County, Washington and is shown on the vicinity map below. The proposed project is a 2-lot short plat with the existing home to remain. Minimal clearing and grading will be required for the new proposed lot. Access is via an existing driveway and sewer and water service is available on site. We found no record of any drainage complaints along Joe’s Creek. The existing home will continue to surface flow to the adjacent wetland and stream. The new property is located on soils that are suitable for limited infiltration. See soils information below (Figure 6). Please refer to Figure 3, Existing Site Conditions and Figure 4, Developed Site Conditions. Joe’s Creek crosses Hoyt Rd SW via a culvert and then flows directly into Lorene Lake. Ragnar soil is classified as well drained, SCS Hydrologic Soil Group A. Discharge at the natural location: The southern portion of the site where the existing home is currently drains to the onsite wetland and creek. The drainage from this area will not be affected by this proposal. The northern portion of the site is located where the Ragnar well drained soils are and all surface water appears to infiltrate onsite. Infiltration BMP’s will be utilized for the proposed new lot and residence. 2. Off-site Analysis: A Level 1 off-site review was completed for this project and now downstream issues were noted between the site and Lake Lorene. 3. Flow control: This project creates less than 5,000 SF of new/replaced impervious and is exempt from flow control requirements per the KCSWDM. 4. Conveyance system: Runoff from the developed site will be infiltrated. No conveyance system is proposed. 5. Erosion and sedimentation control: TESC plans will be provided with the civil permit or house plan submittal after preliminary approval. 6. Maintenance and Operations: A Maintenance and Operations manual pertaining to this site will be included with the final TIR provided with the civil/residential permit application. Water Quality: This project proposes less than 2000 SF of PGIS and is exempt from water quality requirements. 9. Section 3 – Off-site Analysis This Level 1 Downstream Analysis is submitted as required by Core Requirement #2, Section 1.2.2, of the 2016 KCSWDM. Core Requirement #2 requires a qualitative analysis of upstream and downstream drainage conditions with an initial project submittal. Based on a site inspection and a review of available data, there are no downstream issues for the short run of Joe’s Creek from this property to Lake Lorene. The project proponent is proposing to subdivide a single lot into two parcels. The project avoids impacts to all critical areas and their buffers, and therefore, will result in no net loss of critical area function. Existing Conditions and Delineation Findings On July 23, 2018, ecologists, Logan Dougherty and Sam Payne, visited the residential property located at 32604 45th Court SW (parcel #873218-0230) in Federal Way, Washington to screen for jurisdictional wetland and streams within a defined study area. Encumbering boundaries to the existing house location were assessed. On January 17, 2019, ecologists Roen Hohlfeld and Grace Brennen re-visited the property to screen for and delineate the remaining critical areas on-site. This letter summarizes the findings of the study and details applicable federal, state, and local regulations. Methods Public-domain information on the subject properties was reviewed for this delineation study and include the following: • USDA Natural Resources Conservation Service, Web Soil Survey (WSS) application • U.S. Fish and Wildlife Service National Wetland Inventory (NWI) maps • Washington Department of Fish and Wildlife interactive mapping programs (PHS on the Web, SalmonScape) • Washington Department of Natural Resources, Forest Practices Application Mapping Tool (FPARS) • Washington Department of Natural Resources, Wetlands of High Conservation Value Map Viewer • King County’s GIS mapping website (iMAP) • Federal Way Critical Area Maps Characterization of climatic conditions for precipitation was determined using the WETS table methodology from the USDA NRCS document Part 650 Engineering Field Handbook, National Engineering Handbook, Hydrology Tools for Wetland Hwang Critical Areas Report Page 3 Identification and Analysis, Chapter 19 (September 2015). The Seattle-Tacoma International AP station as recorded by NOAA from 1981-2010 (http://agacis.rcc- acis.org/) was used as a source for precipitation data. The WETS table methodology uses climate data from the three months prior to the site visit month to determine if normal conditions are present. Wetlands The study area was evaluated for wetlands using methodology from the Regional Supplement to the Corps of Engineers Wetland Delineation Manual: Western Mountains, Valleys, and Coast Region Version 2.0 (Regional Supplement) (US Army Corps of Engineers [Corps] May 2010). Wetland boundaries were determined on the basis of an examination of vegetation, soils, and hydrology. Areas meeting the criteria set forth in the Regional Supplement were determined to be wetland. Soil, vegetation, and hydrologic parameters were sampled at several locations along the wetland boundary to make the determination. Identified wetlands within the property were classified using the 2014 Update to the Western Washington Wetland Rating System (Publication #14-06-029) (Rating System). Streams The study area was evaluated for streams based on the presence or absence of an ordinary high water mark (OHWM) as defined by the Revised Code of Washington (RCW) 90.58.030 and the Washington Administrative Code (WAC) 220-660-030. The OHWM edge was located by examining the bed and bank physical characteristics and vegetation, using recent guidance from the Department of Ecology, Determining the Ordinary High Water Mark for Shoreline Management Act Compliance in Washington State (Publication no. 16-06-029). Onsite streams were classified using the stream typing system established by WAC 222- 16-030, per City of Federal Way regulations. Delineation Findings The subject parcel is within the Joe’s Creek valley just upstream from Lorene Lake in the Twin Lakes neighborhood. Located in the Dumas Bay sub-basin of the Duwamish- Green Water Resource Inventory Area (WRIA 9), waters flow north to the Puget Sound. The Public Land Survey System location is Township 21 North, Range 3 East, Section 14. In addition to an assessment of on-site critical areas, all nearby properties within 225 feet of the subject parcel was visually screened to the extent feasible without trespassing on private property. Wetland A extends to the south as estimated in the attached rating figures. Joe’s Creek continues off-site to the northeast through a culvert. No other wetlands or streams were visible within 225 feet from the subject property. Since screening was limited to the subject property and public lands, not all areas within 225 feet could be screened. Entry into adjoining private property was not granted. Aerial photography and public wetland inventories were reviewed, and no additional critical areas could be confirmed. It is possible that additional wetlands exist to the northeast in association with Joe’s Creek downstream and/or Lake Loreene. However, if wetlands are present, they would be functionally disconnected and separated by Hoyt Rd SW. Hwang Critical Areas Report Page 5 Table 2. Wetland A assessment summary. Joe’s Creek runs through Wetland A, but the area that gets overbank flooding once every two years is less than 10 percent of the wetland size, and the wetland is therefore classified as a depressional wetland. Hwang Critical Areas Report Page 8 Non-wetland areas Areas not delineated as wetland did not meet criteria for hydrophytic vegetation, hydric soils, and wetland hydrology. The house is surrounded by a lawn that extends to the riparian corridor. Riparian vegetation was primarily red alder, big leaf maple, Douglas- fir, Himalayan blackberry, osoberry; a plant community typically found in non-wetland areas. Areas north of the residence were screened for wetlands during the January 17, 2020 visit, and do not meet wetland criteria. The area is dominated by a bigleaf maple canopy and an English holly, Himalayan blackberry, and Robert’s geranium understory. A few patches of reed canary grass and red alder are situated just north of the fence. Soils in this area were investigated and found to not meet criteria for hydric soils or wetland hydrology. Figure 2. Upland area on north end of property. Streams Joes Creek flows north through the subject parcel and exits the property through a culvert, passing a series of lakes, piped sections, and stream valley before finally draining into the Puget Sound at Dumas Bay. It is mapped by online resources as a Type-F (fish bearing) stream, which appears consistent with habitat observed onsite. The stream ranges in width onsite from approximately 4-10 feet and has streambed sediments of primarily fine sediments (sands, silts, clays) with interspersed areas of coarse gravel. Although no fish were observed during the site visit, the stream is sufficient size to support fish habitat and is connected to other Type-F waters including Hwang Critical Areas Report Page 9 Lake Loreen. Joe’s Creek at this location is not mapped as a salmon bearing stream, suggesting that there may be a downstream fish migration barrier. Salmon are documented as being present about ½ miles east of the property at the outlet of Lake Jean. Figure 3. Joe’s Creek. Another stream is mapped by King County (iMAP) flowing through the northernmost end of the site. No other online resources map this stream (Table 1). No stream channel was identified in that area during the January 2020 additional delineation study. Site topography does not support this type of feature- the mapping shows the stream crossing the property and Hoyt Rd SW, however, the site slopes down to the south in this location and not to the east as the mapping would suggest. No evidence of a channel was found, and the area is dominated by upland plants. Local Regulations Critical areas in Federal Way are regulated by FWRC Chapter 19.145 – Environmentally Critical Areas. Wetland A is a category III wetland with a habitat score of 6, which requires a standard buffer of 150 feet. Wetland B and Wetland C are both category III wetlands with a habitat score of 5, which requires a standard buffer of 80 feet. Stream buffers are determined based on the stream type classification. Joe’s Creek meets the criteria of a Type F water. Type F streams require a buffer of 100 feet. Federal Way requires a 5-foot building setback from the edges of all critical area buffers. Building setbacks may contain landscaping, building overhangs, and fences or railings six feet or less in height. Hwang Critical Areas Report Page 10 In order to subdivide properties with critical areas or their buffers, a critical area tract that delineates and protects the critical area must be established (FWRC 19.145.150). Tracts shall be designated and set-aside on the plat, and the City may require that any required critical area tract be dedicated to the City. Proposed Project The applicant proposes to subdivide the parcel into two lots, and therefore, requests authorization for a subdivision. The northern undeveloped parcel is unencumbered by critical areas and their buffers; therefore, no impacts will occur as a result of development. Construction of a house is planned in the undeveloped parcel and a building permit will be sought through a separate application following subdivision. The project does not propose and new development in the southern parcel that is currently developed with a home and associated infrastructure. Mitigation Sequencing Avoidance: The project avoids impacts to all critical areas, buffers, and associated setbacks. Minimization: Not applicable as all impacts are avoided. Rectifying the impact: Not applicable as all impacts are avoided. Reducing or eliminating the impact over time: Not applicable as all impacts are avoided. Compensation: Not applicable as all impacts are avoided. Monitoring: Not applicable as all impacts are avoided. Code Compliance The project proposes no impacts to critical areas or critical area buffers, and therefore fully complies with FWRC Chapter 19.145 – Environmentally Critical Areas. Critical Areas Report Requirements – FWRC 19.145.080 (1) Unless waived or modified by the director in accordance with subsection (4) of this section, an applicant proposing activities where impacts or alteration of a critical area or its associated buffer and/or setback shall submit a critical areas report that adequately evaluates the proposal and probable impacts. The project proposes no activities with impacts or alteration to a critical area or associated buffer and/or setback. A report that meets this code criteria was requested by the City of Federal Way and this is designed to meet all criteria of FWRC 19.145.080. Hwang Critical Areas Report Page 11 (2) The critical area report shall be prepared by a qualified professional, incorporate best available science, and include the following items: (a) The name and contact information of the applicant, a description of the proposal, and identification of the type of approval (use process, subdivision, building permit) requested; A description of the project proposal and type of approval requested is provided in the “Proposed Project” section. Grace is an ecologist with two years of experience working in the natural resources field, including assessing and delineating critical areas and mitigation site monitoring.
