A RESOLUTION of the City of Federal Way, Washington, declaring a
0.47-acre parcel of real property located at the southeast corner of S.
316th St. and 21st Ave S. as surplus.
WHEREAS, the City of Federal Way ("City") owns real property designated as parcel
number 092104-9057 and legally described as:
PCL A OF FEDERAL WAY LLA 4 03-102586-00 SU REC 4 20040202900009
SD LLA BEING LOCATED IN N 1/2 OF SE 1/4 OF SW 1/4 OF SEC 9-21-4
CONTAINING 20,669 SQUARE FEET, MORE OR LESS
("Property"); and
WHEREAS, the subject property was transferred to the City for the purposes of transit -
oriented development by Central Puget Sound Regional Transit Authority ("Sound Transit") and
identified in the Federal Way Comprehensive Plan as a site intended to be developed with future
transit -oriented development; and
WHEREAS, the Federal Way Link Extension is a light rail extension project that requires
400 parking spaces be developed in the area and building said parking spaces on this location has
been identified as an appropriate location for an extension to their existing parking garage to
construct parking spaces in support of their provision of transit service to the City; and
WHEREAS, Sound Transit has expressed to the City that it will purchase the Property at
its fair market value after consultation with the City about the Federal Way Link Extension; and
WHEREAS, the City published a public notice and news release in the Federal Way Mirror
on July 2, 2021, identifying the Property by means which could be easily understood by the public,
describing the proposed use of the Property, and setting the date, time, and place of a public hearing

to consider the surplus of the Property; and
WHEREAS, the Council held a public hearing on July 20, 2021 to consider whether to
surplus the Property; and
WHEREAS, the City Council has determined that the Property is no longer necessary for
public use and retention does not serve the best interests of the citizens; and
WHEREAS, the Property is surplus to the needs of the City of Federal Way.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY,
RESOLVES AS FOLLOWS:
Section 1. Property Declared Surplus. The Property, legally described as:

SD LLA BEING LOCATED IN N 1/2 OF SE 1/4 OF SW 1/4 OF SEC 9-21-4
is declared surplus to the needs of the City of Federal Way.
Section 2. Execute an agreement. The Mayor and Staff are authorized to execute a purchase
and sale agreement to sell the property to Sound Transit for $723,000 as was determined to be the
fair market value for the property.
Section 3. Severabilily. If any section, sentence, clause or phrase of this resolution should
be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitutionality of any other section, sentence,
clause, or phrase of this resolution.
Section 4. Corrections. The City Clerk and the codifiers of this resolution are authorized to
make necessary corrections to this resolution including, but not limited to, the correction of
scrivener/clerical errors, references, resolution numbering, section/subsection numbers and any
references thereto.

Section 5. Ratification. Any act consistent with the authority and prior to the effective date
of this resolution is hereby ratified and affirmed.
Section 6. Effective Date. This resolution shall be effective immediately upon passage by
the Federal Way City Council.
