Background
In 1996, an OEA was entered into to control the rights and
responsibilities of the property owners to develop and
operate a cohesive shopping center.
The City owns property encumbered by the OEA.
The OEA is incompatible with most of the uses envision by
the City.
The Council authorized condemnation litigation
after several years of negotiations stalled with the
other property owner, Hillside Plaza Associates,
LLC.
The parties continued to negotiate during
litigation and have reached the following
settlement pending council approval.
New reciprocal easement to cover road maintenance,
utility access and pedestrian access if the property is
redeveloped.
Payment of $600,00o to extinguish the prior OEA.
Mayor's Recommendation
Approve the settlement in the matter of City of Federal
Way a Hillside Plaza Associates, LLC.
