Background
Plaintiff's minor child was struck by a motor vehicle driven
by a third party while crossing ist Ave S using a City
crosswalk.
Minor child suffered a compound leg fracture and was
transported by helicopter to Harborview resulting in more
than sioo,000 in medical bills.
The driver of the vehicle had the minimum insurance
mandated by state law.
Plaintiff alleges the City is jointly and severally liable.

The parties attended mediation.
The parties agreed upon a settlement of $350,000
pending council approval.
$250,000 of this total will be paid by the City (with
credit for to -date expenditures).
The City's insurance carrier will pay the balance of
$1001000.
The City admits no liability in this matter as part of
this settlement.
The driver's insurance will pay an additional $50,000.
Mayor's Recommendation
Approve the settlement in the matter of Rich a City of
Federal Way.
