In that letter, it was noted that the critical areas peer review does not address the proposed utility stream crossing. The Wetland and Drainage Corridors Evaluation & Delineation Report & Conceptual Wetland Mitigation Plan for Reasonable Use Exception submitted April 2, 2021, was peer-reviewed by the city’s wetland consultant, Landau Associates. Notable comments are listed below. - Submit a complete mitigation plan per Federal Way Revised Code (FWRC) 19.145.140. - Confirm delineation of the ordinary high-water mark (OHWM) of Stream B. - Update the Stream B classification from Type F to Type N. - Satisfy all of the evaluation criteria provided in FWRC 19.145.080(2). - Update the project evaluation for the stream crossing criteria per FWRC 19.145.320(2). Please address all of the technical comments in the enclosed June 7, 2021, letter from Landau. CLOSING Please resubmit an updated wetland report accompanied by the completed “Resubmittal Information Form” for each file and a letter indicating how the above comments have been addressed. According to FWRC 19.15.050, if an applicant fails to provide additional information to the city within 180 days of being notified that such information is requested, the application shall be deemed null and void and the city shall have no duty to process, review, or issue any decisions concerning such an application.
