CALL TO ORDER Chair Bronson called the meeting to order at 6:30 P.M. MINUTES Commissioner Patrick read changes/updates to the minutes (attached) and moved to have the September 1, 2021, minutes amended to include them. Commissioner Elder seconded. Commissioner Carlson commented that the minutes haven't been verbatim and Commissioner Patrick's amendment is basically a verbatim rendering of that portion of the meeting. If we start doing that amount of detail, we should do so for all. However, it would be burdensome to city staff. Chair Bronson commented the Commission needs to decide to have verbatim minutes, or agree on the amount of detail. Director Davis encouraged the Commissioners to read the city council minutes in order to understand their level of detail. Commissioner Noble-Gulliford asked if the Commission's zoom recording is posted? Director Davis responded that currently they are not posted due to staffing of IT. Planning Commission is one of a dozen commissions and it would be a burden to post all on the website. He noted one can always request the recording through our public records process. The vote was held and the motion to accept the minutes as amended was carried. PUBLIC COMMENT None COMMISSION BUSINESS Discussion, Proposed Code Amendments: Public Transportation Facilities — Senior Planner Rogers delivered the staff presentation of the amendment to allow light rail in Commercial Enterprise (CE) and City Center - Core (CC-C) zones. The proposed amendment will apply more specific controls on development, including a requirement for parking. The City Council will hold the public hearing on this issue. Commissioners asked some clarifying questions. Issues were about parking and included how will the patronage be limited to those using Sound Transit? Would it be possible to have underground parking and are there any incentives for it? Will the parking be paid or free? Will the city implement design criteria? Planning Commission Minutes Page 1 September 15, 2021 Chair Bronson opened the public hearing. Public Hearing, Bally's Fitness Center Site Specific Request — Associate Planner Kamieniecki delivered the staff presentation. Staff will present this issue in two hearings, tonight and October 6, 2021. The request is for a comprehensive plan amendment and rezone of Bally's Fitness Center, located south of South 328"' Street and east of I" Avenue South, from Office Park (OP) to Multi -Family Residential. The existing site is vacant with an unoccupied building. Surrounding land use consists of multi -family to the north, south, and east, with neighborhood business to the west. She discussed utilities, public services, critical areas, drainage, and access and traffic as it relates to the site. Commissioner O'Neil stated he would like more information on infrastructure i.e., traffic, schools, police, etc. Adding this many people will put more of a strain on these. He requested City Traffic Engineer Rick Perez attend the October 6th meeting to discuss the effect on traffic in the area. Commissioner O'Neil doesn't see a conflict with zoning in the area (he feels the proposed is consistent with surrounding zoning) but is concerned with the possible effect on infrastructure. Planner Kamieniecki commented that this amendment is just for the zoning and not a specific development, so any discussion on infrastructure will be more general in nature. She also stated the city has had discussions with a developer who is interested in a townhome type of development on the site. A more comprehensive review will be done on any proposed development. Commissioner Patrick asked if there have been any public nuisance complaints on the property. Planner Kamieniecki replied there have been nuisance complaints and the owners have hired 24-hour security to deal with this issue. In addition, the building is currently being used to house building materials for another project and therefore, there is someone on the site every day, which has cut down the nuisance complaints. Commissioner Noble-Gulliford noted that West Campus was developed as a planned unit development back in the 70s. Has staff found any information/requirements from this planned unit development that may affect the proposed amendment? Planner Kamieniecki replied that staff didn't find an overlay that would be applicable. Commissioner Noble-Gulliford clarified that she is concerned that any mitigation for traffic, open space, and surface water was done at the time of the planned unit development and the proposed amendment would double up on any mitigation already done by the property owner. City Attorney van Alstyne commented that once the city incorporated, anything not recorded at that time is no longer relevant. Chair Bronson opened the hearing to public testimony. Debbie Call expressed her concern with traffic safety issues with additional traffic, school capacity for more students, parking, and increased crime. Jan Barber expressed her concern with traffic safety issues with additional traffic, surface water runoff, and garbage at the vacant site. Eric LaBrie is with ESM and the agent for the applicant. They have worked closely with staff to resolve nuisance complaints (and noted a vacant blinding serves no purpose). Recent studies have shown the city needs more housing. He is happy to answer any questions. Chair Bronson lost his connection and Vice -Chair O'Neil took place as the chair of the hearing. Commissioner Medhurst commented that he supports something being done with the property, but wants to hear from traffic and stormwater before deciding. He asked what is the threshold that must be met in order to make changes to the intersection? Planning Commission Minutes Page 2 September 15, 2021 Commissioner Patrick would like staff to provide information on the spacing capacity for nearby schools; and the names of those schools. Vice -Chair O'Neil continued the hearing to October 6, 2021. Kang Shik Kim stated he is against rezoning this site. He feels the site is already at its "best use" as office space. There is other land available for multi -family and feels office use would be better for the neighborhood. Jan Sidlo agrees with the last comments. She is very upset with the up zone. It will increase traffic and would be bad planning for the city. It was zoned office park for a reason. More multi -family will just overcrowd our city. She noted her neighbors are against it. Nancy Justice feels letters are being ignored. Holding meetings by zoom does not give citizens the ability to share as they would like and they are being shut out. This is not just about apartments, but about the new state legislation (HB 1220) and being scared about what will go into our back yard. Ronna Hazel feels like a plan is already in place and is confused about what is going on. What is the process? Planning Manager Niven gave an overview of the process. Nancy Justice commented she sent a letter that wasn't read at the meeting and therefore, she wasn't totally heard. Why not do this in person and not on zoom? Planning Manager Niven stated that all written comments will be provided to the Planning Commission; if not already, then at the October 6, 2021, hearing. All comments are part of the official record. STAFF BUSINESS Manager's Report — An open house for the Housing Action Plan will be held at the Performing Arts and Event Center (PAEC) on Sept 16th. The HB 1220 code amendment went to City Council on September 21St Staff will apply for grants in order to explore different design solutions for pedestrian / bike crossings for downtown on 320t'' Commissioner Noble-Gulliford would like to see the staff work on zoning to implement the Twin Lakes Subarea Plan. CITY OF '/ Federal Way MEMORANDUM Community Development Department DATE: September 29, 2021 TO: Planning Commission FROM: Natalie Kamieniecki, Associate Planner SUBJECT: Planning Commission Public Hearing 2021 Comprehensive Plan Amendment — Bally Total Fitness (20-103733-00-UP) 32818 1" Avenue South, Parcel Number 172104-9038 ADDITIONAL INFORMATION Section 2 of the September 8, 2021, staff report, identified the criteria for evaluation includes Federal Way Revised Code (FWRC) 19.80.140, 19.80.150, and 19.75.130(3). The staff report errantly omitted the criteria and evaluation for 19.75.130(3). (You may review the September 8, 2021, staff report here htt 2s:Hdocs.cityoffederalwgy.com/WebLinkBrowse.aspx?id=866556&dbid=0&repo=cityoffederalway, starting on page 16 of the agenda packet.) The following criteria and evaluation are provided for the consideration of the Planning Commission: FWRC 19.75.130(3)(a), Recommendation by the Hearing Examiner' — After considering all of the information and comments submitted on the matter, the Hearing Examiner shall issue a written recommendation to the city council.2 The Hearing Examiner shall use the following criteria for quasi- judicial rezones: (a) The city may approve an application for a quasi-judicial nonproject rezone only if it finds that: (i) The proposed rezone is in the best interest of the residents of the city; and The change in designation and zone would allow for the property to be reused as multifamily residential or any of the listed uses in FWRC 19.205. The property does not contain any know critical areas and is served by urban infrastructure and services that can support the proposed designation and uses. According to data provided by King County, since 2006 the city has added housing units at 65 percent of its needed pace to meet its housing growth target. Changing this parcel to multifamily would help the city to better meet its housing growth forecast. (ii) The proposed rezone is appropriate because either: (A) Conditions in the immediate vicinity of the subject property have so significantly changed since the property was given its present zoning and that, under those changed conditions, a rezone is within the public interest; or 1 In this instance, through the consolidated review process of FWRC 19.15.060, the Planning Commission applies the criteria listed in FWRC 19.75.130(3)(a) instead of the Hearing Examiner. 2 As explained above, because this application is utilizing the consolidated review process of FWRC 19.15.060, the Planning Commission will forward a recommendation to the City Council as provided under FWRC 19.80.240. Bally's Fitness Center Site Specific Request 20-103733-00-UP Follow -Up Memorandum Page 1 of 2 (B) The rezone will correct a zone classification or zone boundary that was inappropriate when established; Under (ii)(A), the vacant building was devalued by the King County Assessor from a high of $2.8M in 2000 to $1, 000 in 2016 It is currently being assessed at this value. The building remains vacant and aesthetically detracts from the aesthetic quality of this neighborhood, as does the lack of on -going maintenance of the property. This condition will worsen if the property continues in its vacant condition. Under current conditions, the market has not delivered a replacement tenant for this building for five years. (iii) It is consistent with the comprehensive plan; This parcel is a stand-alone Office Park parcel with multifamily residential located immediately north, east, and south. (iv) It is consistent with all applicable provisions of the title, including those adopted by reference from the comprehensive plan; and The requested rezone of Office Park to Multi Family is appropriate at this location and is consistent with surrounding residential multi family land uses and the accompanying underlying zone classification and comprehensive plan designation. (v) It is consistent with the public health, safety, and welfare. The rezone would allow the property to return to a functional use through redevelopment. The active use and redevelopment of the property would add to property values and neighborhood stability and is in the general welfare of the public. FEDERAL WAY PUBLIC SCHOOLS (FWPS) Public comment received on the proposal included impacts to the school system. Notice of the application and environmental review was forwarded to FWPS during the comment period and no comment was received. As a follow up to the public hearing, an additional attempt to contact the schools for comment was sent via email with no comment or response. School impact fees are collected at the time of the building permit issuance to offset impact to school systems. POLICE AND FIRE SERVICES Police, fire, and medical services are available at the site. Future development will submit a Crime Prevention Though Environmental Design. Please read at the next Planning Commission/Land Use meetin DENY REZONING As a resident living directly behind the old Bally's property, I am 100% against the current landowners plan to request rezoning in order to build large, multistory, multifamily housing. The builder only wants to line his pockets with money and destroy the character of our neighborhood. That being said, if rezoning was permitted for housing, that housing should reflect what is currently the standard in our neighborhood, i.e., no taller than TWO units high. Anything larger than that would create a traffic nightmare, increase the noise level of the neighborhood, and totally destroy the ambiance of the area. Case in point, the high-rise living situation across the street from Safeway on 320th. Since that was been built, the character of the area has totally changed. Traffic is a nightmare, we have all kinds of people crossing the street illegally (not in a crosswalk), and the numbers of people who just hang out at Safeway have increased such that shopping there is no longer viable. The area is unsafe, dirty, congested, and frankly unsightly. Federal Way is not a cosmopolitan city. Every attempt to make it look like a "real" city has turned it into an eyesore. The "heart" of Federal Way and the surrounding transit center is an epicenter of crime, homelessness, and filth. I do not want my little slice of Federal Way to end up with the same fate. As taxpayers, we should be able to continue our current quality of life and enjoy walking in our neighborhood without fear of being overwhelmed by too may cars and people. Keep Federal Way a bedroom community and away from monstrous multistoried tenements that destroy neighborhoods and lives. There is nothing wrong with making money (the builder) but that should not come at the expense of the people living in the area. I have recently become aware of the request by the land owner of Bally's old property at 32818 1st Avenue in Federal Way for a reclassification and zoning change. I live in the Colonial Forest Condo across 328th from the facility in question and wanted to voice my concerns. My first concern has to do with the increased traffic along 328th. Currently, 328th is used as a bypass to escape waiting for the lights at S 320th and 1st S. Many people use it in both directions to bypass this busy intersection and it is already creating issues with leaving our back gate at 2nd Place South and S 328th Street. It is difficult to see approaching traffic orjudge the speed being traveled as they seem to disregard the 25 MPH speed limit set by the city. In addition to that, the addition of more units in the Bally's property could create parking issues along S 328th that do not exist at this time. Creating issues for the current neighbors around the property. My second concern has to do with what kind of zoning will be allowed. With the possibility of many additional living units there is a concern for the transient nature of apartments. Crime is bad enough but adding additional units in the area could create some issues for current neighbors of the property. It is my understanding that the current owner is asking for this property to be rezoned to "Residential use" from "Commercial use". I am asking the Planning Commission to DENY this request as we DO NOT need more traffic, more crime, more litter, more drug use, just to name a few negative issues, in our neighborhood. Until the city can gain control of the increased crime and drug use, how can we expect to be kept safe by adding more multifamily units in our city. Federal Way is OUT OF CONTROL NOW and with the state mandates taking effect in the near future, what guarantees are there that this area will not become a drug and crime infested area which will highly impact the nearby businesses and neighborhoods. I no longer feel safe in Federal Way and do not go out after dark and am constantly "watching my back" during the day hours. Sadly, I am considering leaving the area that I have lived in for 30 years. I do not WANT to move, but with the drug and crime issues in this city, for my safety, it is becoming a HAVE to move situation. TRAFFIC on 1st AVE: 326th has a left turn signal to control turns. The light at 325th PI that leads into Colonial Forest does not have a left turn signal. There are accidents and near accidents all the time with people making left turns onto 325th PI and not seeing oncoming cars in outside lanes. With 1000 more potential residents, 1st ave is going to get hit hard with more traffic. We are already seeing increased traffic, fast cars and hearing police chases on 1st ave. WITHOUT TAXES Residents - WHO will pay for the left hand signal at 325th in all directions so we do not have head on collisions? Landowner/developer since he/she is the cause of the increased traffic? 2. PARKING: With the increase residents in the area, means more cars to park - we are already seeing multi - families living in 1 unit which is causing cars double parked, parked up and down the street. There will be increased parking issues on 326th street. WHAT IS THE PLAN FOR THIS? and the effects of increase car exhaust on the environment. 3. How are they going to fit in 145 units in a 6 acre lot and still have parking, open spaces etc that are required. They can only go UP. Condos and apartments in the area are only 3 stories high - A "highrise" apartment/townhouse design or ONE LARGE building complex DOES NOT fit in with our community and will take away from us feeling like we live in OWNED homes. Rather then being in the heart of the CITY. 4. IMPACT ON SCHOOLS. I have worked in the Federal Way School System for 25 years. I worked in 2 of the 1st buildings to be rebuilt (Valhalla Elementary and Lakota Middle School). Buildings during the planning/construction time are based on the current population, not the POTENTIAL. During the time that Valhalla was built, we had already outgrown it. What was supposed to be a computer lab, turned into a classroom. Recent years, the teachers lounge was used as a classroom, and portables were brought in i because the new school could not take INFLUX. I also had colleagues tell me that Lake Dolloff and Seqoyah were bursting at the seams when Park 16 was built. Schools do not plan for future development. MIRROR LAKE ELEMENTARY is being rebuilt right now, this would be where the elementary kids will be going if living in a unit on this property. The school was built based on who lives in the area now, not on what will be coming. 5. CRIME: we have seen an increase in homeless and crime happening in the SAFEWAY area off 320th with the building of the apartments across the street. PLEASE reconsider rezoning to a multi -family unit in this area. Where there is an increase of people, MRrdTs-arn increase of problems(sad to say). We are already seeing an increase in car breakends at Colonial Forest (Condos North of property) and the Quad complex already gets hit with crime, PLEASE make sure infrastructure is in place and looked at when considering rezoning (do we have more of a Police presence?). Please be reminded that CRIME at Lowes and Home depot increased exponentially after Park 16 was build. Police could not go into Park 16 without a back up. BY rezoning Bally's to Multi-familiy units, we are increase the number of people in the area which inevitably brings in more crime. 6. QUESTION on zoning for multi -family units - ARE THEY REQUIRED TO HAVE A NUMBER OF UNITS AS LOW INCOME SECTION 8? No one will answer this question for me. 7. If townhouses, will it be required that those living in it are the OWNERS as it is at Coloniel Forest. I am against Rental units and high rise complexes. I'M against rezoning and hope that something that would attract people to WANT to live in our community could be put there, I have lived in Federal Way for 25 years and I've seen how the multi -family apts that are rental units have caused Federal Way to be known as something other than a nice place to live.
