The radio tower and antenna E'-pperties, ructures is placed to minimize its sibility from adjoining while still permitting efctive operation; 2) The Y,adio tower and antenna structure -,_does not extend higher than reasonably necessary to operate effectively; and 3) The use of the ant-,nna will not materially interfere with radio and television reception on nearby properties. In making its decision on the application, the City shall take into consideration the strong federal interest in promoting amateur communications and the rules adopted by the Federal Communications Commission regulating such facilities. If the City approves the radio tower and antenna structure, it may impose limitations to mitigate or eliminate any adverse impacts. This may include, but is not limited to, requiring the use of a telescoping antenna, which would only be extended during limited periods when the antenna is in use. 115.65 Home occupations and Other Accessory Components of Residential Uses 10 1. General - The regulations of this Section apply to every residential use within the City. 2. Purpose - The purpose of this section is to allow commercial occupations incidental to residential uses to be located in residences while providing protection to all residents 1. A required front yard, may not exceed 20 feet in width and may not be closer than 5 feet to any side property line. 2. Exception - A driveway and/or parking pad in a required front yard may exceed 20 feet in width if - a. It serves a 3-car garage; b. The subject property is at least 60 feet in width; and C. The garage is located no more than 40 feet from the front property line. In addition, a driveway may flare at the front property line to a maximum width of 30 feet. b. Attach.e.d_ and Stacked Dwelling Units in Residential Zones - The regulation of this paragraph apply to driveways and parking ares for stacked and attached dwelling units in residential zones. 1) Parking areas may not be located in required yards. 2) Driveways must be setback at least 5 feet from each property lines, except the portion of any driveway which crosses a required yard to connect with an adjacent street. c. Other Uses - Parking areas and driveways for uses other than those specified in paragraphs 5.b. and 5.b of this section, may be located within required setback yards. d. Shared Parking - If parking serves two adjacent uses, the parking area may be anywhere in the required yard between those uses. 115.120 Rooftop Appurtenances, Required Screening 1). General - Except as specified in paragraph 2 of this section, vents, mechanical penthouses, elevator equipment and similar appurtenances that extend 115 - 26 above the roof line must be surrounded by a solid sight obscuring screen that meets the following criteria: a. The screen must be integrated into the architecture of the building. b. The screen must obscure the view of the appurtenances from adjacent streets and properties. 2. Exemptions - a. Rod, wire and dish antennas allowed under Section 60 of this Chapter are exempt from the requirements of this Section, if the screening would interfere with the effective operation of the antenna. b. A painted appurtenance is exempt from the requirements of this Section if the Planning Official determines that painting will be as effective in minimizing rooftop clutter as would a solid sight obscuring screen. 115.125 Rounding of Fractions of Dwelling Units In ,,any zones, the number of dwelling units allowed on the subject property is determined by dividing the area of the subject property by the number of square feet this Code requires per unit. When this results in a fraction, the number of permitted dwelling units will be rounded up to the next higher whole number of units if the fraction is at least 2/3. If the fracture is less than 2/3, the number of permitted dwelling units will be rounded down to the next lower whcle number of units. 115'.130 Siaht Distance at Intersection 1. General - This Section establishes that areas around all intersections, including the entrance of driveways onto streets, must be kept clear of sight obstruction. The extent of these areas depends on a number of factors. Listed in paragraph 2 of this Section are a number of types of intersections and the regulations applicable to each. The proposal is for two outdoor garden sales areas to be located on the east side of the Fred Meyer building. A southern enclosure is proposed to be 28' by 60 ', and a northern enclosure is 28' by 901. This southern enclosure includes a proposed sunshade. The enclosures are proposed to be in place six months out of the year. They are proposed to occupy an area currently approved as parking, eliminating 12 parking spaces and the adjacent sidewalk. The two enclosures would add 4200 square feet of floor area. To review the application, the Federal Way Zoning Code chapter 115 (Miscellaneous Use, Development and Performance Standards) is referenced. Chapter 115.105 contains outdoor use, activity and storage standards and development requirements, while 115.105.3 details commercial and industrial uses. According to 115.105.3, site plan submittal must include locations and dimensions of all structures and fences on the subject property, all parking and driving areas, existing and proposed outdoor uses, activities or storage areas, existing landscaping and buffering, the nature of the outdoor use and the duration of the use. The submitted proposal meets this requirement. Standards are placed upon outdoor storage use or activity. Chapter 115.105.3.c details these: 1) Outdoor uses, activity or storage must comply with required buffers for the primary use. The buffer requirements for outdoor sales/storage would conform to the primary use of a retail establishment as noted in the Federal Way Zoning Code chart 45-9. The landscape category is D, and the sign category is E. 2) A minimum 6 foot high solid screening fence or other appropriate screening approved by the Planning Official is required around the outside edges of the area devoted to the outdoor use. An 8' high chain link fence has been proposed. While the proposed height is acceptable, the chain link material does not produce the DRAFT necessary solid screening effect. A masonry or solid wood fence provides the appropriate solid screening effect. Any fence over 6 foot tall would require a building permit. The outdoor use is also subject to buffering standards as outlined in the landscape section of the code. As the adjoining property is zoned low density (RS-7.2, residential single family), the Federal Way Zoning Code landscaping category D states that the use must comply with sections 90.15, 90.20 and 90.25.1. Code section 90.15 deals with significant trees. 90.20 deals with supplemental planting standards applied to the project. 90.25, buffering standard 1 applies to the proposed use. That standard requires the applicant to provide a 50 foot wide planted landscape strip planted as follows: A) 114 staggered rows of trees, each row planted eight feet on center along the entire length of the strip. No more than 30% of the required trees may be deciduous. At the time of planting, deciduous trees must be at least 2" in diameter as measured 6" above the top of the root ball and coniferous trees must be at least 5' in height." B) "Shrubs, 18 inches high, planted to attain a coverage of at least 80% of the strip within 2 years." The applicant shall provide the required buffer along the entire common border between the subject property and the adjoining property or the street, as the case may be, as stated in 90.25.4. 3) In all cases, the height of items stored outdoors shall not exceed six feet above finished grade. This requirement would be placed on the proposed outdoor sales/storage area. 4) The outdoor use activity or storage may not inhibit safe vehicular and pedestrian movement to, from and on the subject property. The Uniform Building Code, Chapter 33, defines exit as a contiguous and unobstructed means of egress to a public way and includes intervening aisles, doors, doorways, corridors, exterior exit balconies, ramps, stairways, smokeproof enclosures, horizontal exits, exit passageways, exit courts and yards. UBC Section 3301.(c) states that obstructions shall not be placed in the required width of an exit except projections permitted by the chapter. UBC Section 3303.(b) states that the maximum exit width required from any story of a building shall be maintained. The outdoor sales/storage area, as proposed, would inhibit exit from the sales area to the exterior of the building. The blocked doors are identified on site plans as doors number 21, 48, and 50. This egress obstruction is in violation of the Uniform Building Code, and would not be permitted without further exit width analysis of the entire property. The proposed sales area would replace existing parking and sidewalk areas. With no sidewalk, pedestrians must use the street to gain building access. Safe pedestrian access must be provided between building exits, parking areas, and sidewalks. The eliminated sidewalk must be replaced along the east side of the proposed outdoor storage/sales area. A pedestrian corridor should be provided from the outdoor sales area to the sidewalk along 19th SW. 5)... An outdoor use, activity or storage area will be used in calculating the gross floor area of a use or development if this area will be used ... at least two months out of every year. The proposed outdoor sales/storage areas is to be in operation from March through August. The use adds 4200 square feet of additional floor area to the Fred Meyer Building. Under Federal Way Zoning Code Chart 45-9, (BC Zone), 1 parking space for each 300 feet of floor area is required. The added floor area requires 14 parking spaces. Additionally, the proposed outdoor sales/storage area eliminates 12 parking spaces for up to 6 months out of every year. These parking spaces must also be provided for on site. These 26 new parking spaces would have to meet landscaping and buffering requirements detailed in the Federal Way Zoning Code Chapter 105. (Parking and Parking Areas, Vehicle and Pedestrian Access and Related Improvements.) In 105.70, (Parking Area Design, Landscaping), "the applicant shall arrange the parking spaces so that there are no more than 8 contiguous spaces in each parking row. An island or peninsula of the same dimensions as the adjacent parking stalls must separate adjacent groups of spaces from any adjacent driveway which runs perpendicular to the row. This island or vertical curb must be surrounded by a 6" high vertical curb and must be landscaped with at least one deciduous tree, 2" in diameter as measured at least 6" above the top of the root ball, or a coniferous tree 5' in height and with ground cover planted to attain a coverage of at least 60 percent of the island or peninsula within 2 years." summary The proposed use of a seasonal fence for outdoor sales and storage, while permitted under the Federal Way Zoning Code, decreases parking availability at the site.
