17-105489-Resubmittal Extension Letter-09-10-2021-V1 September 10, 2021 Job No. 1886-001-016-0016 Mr. Jim Harris Senior Planner City of Federal Way 33325 8th Ave S Federal Way, WA 98003 RE: Woodbridge Business Park (City File #17-105489-UP and 17-105490-SE) Request for Extension of Resubmittal to Technical Review Comments Dear Mr. Harris: On behalf of Federal Way Campus, LLC, ESM Consulting Engineers is requesting a 60- day extension to the deadline noted in the Technical Review Comment letter from Lisa Klein dated March 19, 2021. The closing paragraph of that letter states: “Pursuant to FWRC 19.15.050, if an applicant fails to provide additional information within 180 days of being notified that such information is requested, the application shall be deemed null and void and the City shall have no duty to process, review, or issue any decisions with respect to such an application.” Assuming that the 180 days is calculated based on calendar days and not working days, we calculate the deadline for resubmittal to be Tuesday, September 14th. As you know, the comments provided by the city and their team of consultants are quite extensive (over 79 comments) and with a project of this size, they have caused some redesign that ripples through the entire consulting team. In addition, one specific comment provided is dependent upon the City’s design process and another consultant, which are out of the applicant’s control. Specifically, comment #39 states: “The proposed northerly driveway must meet separation distance from the future S 324th St and Weyerhaeuser Way S intersection. Please coordinate with the City Center Access Study team to determine the future intersection and S 324th Street alignment.” The applicant has promptly and fully cooperated with the City Center Access Study team; however, their design of the future intersection of S 324th Street and Weyerhaeuser Way S has changed multiple times over the course of the last 180 days and to this day it remains undesigned. Based upon the last meeting held with the team on August 24th, we understand that another preliminary design may be presented in the near future, from which we may be able to confirm our driveway will meet intersection spacing requirements.
