Just to confirm, the applicant, my client, will not rent/advertise the extended living area as a second dwelling
unit and there will not be lockable doors/wall separating the extended area from the main house; there is an
existing pocket door that has no lock.

With that said, may we continue with our application and submittal for the Building permit not as an ADU and
as submitted? Or should I add the first paragraph above to the application notes to aid the planning reviewer
during their review.

David,
Based on the drawings you provided, the proposal is to convert existing space into additional living space. There are no
regulations that state a house cannot have two kitchens, but the extended living area cannot be rented/advertised as a
second dwelling unit and there cannot be lockable doors/wall separating the extended area from the main house. The
proposed additional living space is larger in size than is allowed by the zoning code for an ADU.
Another option to eliminate the appearance of an ADU is to remove one of the features of living, sleeping, cooking, or
sanitation, see definition below.
Should you want to proceed with getting ADU approvals, please review the following and the attached information:
Accessory Dwelling Units (ADUs) are defined as:
Federal Way Revised Code (FWRC) Section 19.05.010:
“Accessory dwelling unit (ADU)” means either a freestanding detached structure, excluding outdoor storage
containers and similar structures used or designed to be used as living facilities, or an attached part of a
structure which is accessory to the main or primary dwelling unit located on the subject property, providing
complete, independent living facilities exclusively for one single housekeeping unit, including permanent
provisions for living, sleeping, cooking and sanitation. See FWRC 19.265.020. ADUs include:
(1) “ADU, attached” means an accessory dwelling unit that has one or more vertical and/or horizontal walls in
common with or attached to the primary dwelling unit.
(2) “ADU, detached” means a freestanding accessory dwelling unit that is not attached or physically connected
to the primary dwelling unit.
Accessory dwelling units require a land use application and a building permit, in that order. Please see the links below
and the attached information and let me know if you have any questions after review. All application submittals go
through the Permit Center, who can provide fee information as well; see submittal note below.

Dear City of Federal Way Planning,
I left a voicemail regarding the project in question, but wanted to follow up with an email.
I am in the process of submitting drawings for a remodel project that has an existing daylight basement. As
part of the remodel, the owner wants to add a kitchen, bedroom, and a bathroom in this downstairs
bathroom. The owner plans on using the downstairs kitchen and downstairs bedroom for her once a year pig
roast party where she has guests from all parts of the country gather. Also, the owner wants to use this lower
downstairs basement area for a future care giver space when it is needed, as she plans to live at the home
until the end of her life. The owner does not want or intend to rent this space out to a tenant.
Since this remodel looks like an ADU, the Electronic Submittal team flagged this as an issue with the need to
submit a permit for an ADI and recommend that I discuss with a planner on how to proceed before formally
submitting.

Hello David –
While working on your intake a couple of things came up. First, we require that single family permits include
plumbing and mechanical work on the building permit, so we will need the fixture counts and valuations for
both. Second, though it is not the intent to use the caregiver quarters as a rental, if it meets the criteria for a
second dwelling unit you may need to go through the Accessory Dwelling Unit application process. We
strongly encourage you to discuss this with a planner now rather than have it come up during plan review. They
can be reached at 253-835-2655 or planning@cityoffederalway.com.
Otherwise, your electronic submittal intake is complete. Attached is an invoice for the submittal fees. Once we
receive payment, we will forward the documents to the reviewer. Please call 253-835-7001 to make a payment
over the phone. Alternatively, you can send a check to the address in the signature block.

questions regarding the review, please contact the reviewer directly.
When it has been approved, you will receive an e-mail notifying you of any outstanding items and fees
necessary to issue the permit or approval. Once all items are resolved and fees are paid, you will receive an e-
mail with a link where you can download the approved documents. For permits, these will need to be printed
and made available to the inspector at the job site.
