The city comments in Italics with a detailed response below in bold are indicated below. COMMUNITY DEVELOPMENT – PLANNING DIVISION FOREST PRACTICES – TREE REMOVAL • The Tree Retention Plan demonstrates removing 33 trees of merchantable timber. If the anticipated tree removal volume is equivalent or larger than 5,000 board feet, a Class IV Forest Practices Permit is required. In a memo dated 1/11/21, Layton Tree Consulting, Inc. has completed a 100% timber cruise and determined the tree removal volume exceeds 5,000 board feet. A Class IV Forest Practices application has been completed and included in this submittal. 1. Please have a certified arborist or forester determine whether 5,000 board feet or more of merchantable timber will be harvested. If more than 5,000 board feet of merchantable timber is removed, then SEPA review of the entire proposal is required. A SEPA checklist will need to be completed, signed, and submitted with a Master Land Use Application (MLUA, both enclosed). Below outlines the subsequent process: • Applicant submits the SEPA checklist, MLUA, and SEPA fee to city’s permit center. • The City of Federal Way will review the proposed Class IV-General Forest Practices in conjunction with SEPA review, and review of associated City of Federal Way development permits or approvals. Forest practices are reviewed subject to the requirements of Federal way Revised Code (FWRC) Chapter 19.120, “Clearing, Grading, and Tree and Vegetation Retention.” Refer to the “Clearing and Grading Regulations” and “Tree and Vegetation Retention Requirement” (enclosed) handouts for more information. • A copy of the forest practices application form is also routed to the Washington State Department of Revenue (DOR), as forest practices are subject to a forest City of Federal Way Department of Community Development Kislyak Short Plat – 34402 24th Place SW 07/23/2021 Page | 2 excise tax at time of harvest. For more information about the forest excise tax, contact the DOR Forest Tax Program at 1-800-54808829, or http://dor.wa.gov. • Forest practices are approved as part of the applicable building or land development permit. No forest practices can commence prior to engineering approval of the proposed clearing, grading, and tree and vegetation retention activities (which include all forest practices) and issuance of the official “Notice to Proceed.” The city determines readiness to proceed based on a number of criteria that can be found in FWRC 19.120.060(2). A SEPA checklist and Land Use application have been completed. These will be submitted to the permit center. A Forest Practice application has been completed and included in this submittal. LANDSCAPING 1. Tree credits are not counted for trees planted within the stormwater tract. FWRC 19.115.050(6)(b)(2) is for commercial service and institutional facilities and does not apply in single-family residential zones. Trees within the stormwater tracts will not count towards meeting the required tree credits. A tree unit density worksheet has been completed meeting the guidelines in FWRC 19.120.130. The landscaping plan has been updated to meet the required tree unit replacement requirements. 2. Provide a minimum width of three to five feet of a landscaping strip in a separate landscape tract to be owned by the HOA (for pond screening is required between the drainage tract), and the public right-of-way. This nominal landscape screen is required by the city in order to meet the Federal Way and state platting statutes to protect the public health, safety, and welfare. Revise the short plat map, labeling, and depiction of the required landscape screening tract strip. Tract C, a three foot wide landscape screening tract has been added to the plan to meet this requirement. CONTENT & FORM OF APPLICATION Please provide the following applicable items as identified in Bulletin #010, and content requirements of FWRC 18.30.030, on the short plat document: 1. Add the city file number (19-105850-000-00-SU) in the space provided in the title block on all sheets. This city file number has been added in the space provided in the title block on all sheets. 2. The vicinity map is incorrect. The vicinity map locates the property on 21st Place SW, not 22nd Place SW. The vicinity map has been updated and now shows the site location. Please clarify whether the short plat lots will be served by sewer or septic? • If the parcels will be served by sewer, please remove the King County Health Department block. • If the short plat lots will be served by septic, revise the site plans to accurately accommodate for the septic system and retain the King County Health Department Block. The proposed and existing lots will be served by sewer; therefore, the King County Health Department block has been removed. 4. A stormwater tract does not qualify as open space. Please provide a statement explaining how open space shall be provided. All residential subdivisions are required to provide an open space in the amount of 15 percent of the gross land area of the subdivision site per FWRC 18.55.060(2). The stormwater tract label has been revised to show that it does not qualify as open space. A note on Sheet 1 in the plat information notes has been included which states “Open Space 11,369 S.F. (Required), Fee in Lieu Requested”. 5. If the required space will not be provided on site, a fee-in-lieu payment may be made to satisfy open space requirements at the discretion of the Parks Director. The fee-in-lieu of open space shall be calculated on 15 percent (minus any landscape buffer credit) of the most recent assessed value of the property at the time of plat recording, and paid prior to recording the short subdivision. A written request to Parks Director John Hutton must be submitted if the open space shall be paid as a fee-in-lieu, pursuant to FWRC 18.55.060(2). A written request is being prepared and will be submitted to the parks director. 6. The tract A stormwater cannot be designated as an open space. The stormwater tract label has been revised and is no longer identified as open space. 7. The short plat map must identify ownership and maintenance of the Tract A drainage facility, see the Public Works comment below regarding ownership and maintenance. The stormwater tract label has been revised to show private ownership and notes add that Tracts A, B & C will be privately owned and maintained. 8. The building setback lines should be revised and included. a. Pursuant to FWRC 19.200.010, required yard setbacks for single-family dwelling unit are 20 feet front yard and 5 feet side and rear yards. Please indicate where the driveway/primary vehicular access will be located on lots 1 and 2. Establish the setbacks accordingly for all lots on the short plat drawing to depict five-foot side and rear yard setbacks. PUBLIC WORKS – DEVELOPMENT SERVICES SHORT PLAT 1. Add the city file number in the space provided on the short plat title block. This city file number has been added in the space provided in the title block on all sheets. 2. The city requires that all vertical (contour/elevation) data is to be on NGVD-29 datum. The surveyor and engineer will need to revise the drawings to reflect this datum (no conversion factors allowed). This was noted in the preapplication summary letter from January 2018. Per an email correspondence with Kevin Peterson on 7/21/2021, the plans will be updated prior to final engineering and for this resubmittal that datum conversion factor remains on the cover sheet. 3. Per City of Federal Way Development Standards and policies, stormwater pond tracts for short plats will be privately owned and maintained by the plat owners. Revise the note on Tract A to reflect this to be a private tract. A note should be added to Sheet 1 to indicate the stormwater pond is to be owned and maintained by all owners of the plat. The stormwater tract label has been revised to show private ownership and notes add that Tracts A, B & C will be privately owned and maintained. ENGINEERING AND LANDSCAPE PLANS 1. See comment #2. Per an email correspondence with Kevin Peterson on 7/21/2021, the plans will be updated prior to final engineering and for this resubmittal that datum conversion factor remains on the cover sheet. 2. Comments on the street section shown on Sheet 2: • Shows a one-foot utility strip behind the sidewalk. City standards require a three- foot utility strip behind the sidewalk; • There’s an additional 6.67 feet of unimproved right of way shown on the north side of the road. It appears the improvements can be moved further north so that the three-foot utility strip can be provided without the need to take additional property for the right-of-way, and • The four-foot plantar strip is measured from the face of curb, not from the back of curb as shown. The street section (shown on Sheet 2) and the street design (shown on Sheet 1) have been revised per this comment. A three-foot utility strip behind the sidewalk has been added. The four-foot planter strip has been adjusted to begin at the face of curb. A Right-of-Way Modification request has been submitted for the project requesting a narrower utility strip. Currently, some details shown on Sheet 9 are City of Bothell. The details have been revised to the City of Federal Way standards and the 2016 King County Surface Water Design Manual standards. 4. The pond bottom shall be seeded with a seed mix identified in the 2016 King County Surface Water Design Manual (KCSWDM). A note has been added to Sheet 8 stating “Stormwater Detention Pond designed per Section 5.1.1 of the 2016 King County Surface Water Design Manual”. The Detention pond now has a stormwater wetland beneath the detention portion of the pond and the required landscaping has been added to the landscape plans. 5. Street trees in the planter strip shall be 2.5-inch caliper. This comment has been noted. TECHNICAL INFORMATION REPORT 1. Section I (Developed Site Conditions), and Section IV (Performance Standards): • The site is located in the Hylebos Creek Drainage Basin, not the Dumas Bay Basin. • The site lies within a Conservation (Level 2) Flow Control Area; however, due to a conveyance restriction downstream of this site, the project is required to meet the Level 3 flow control criteria. The TIR has been revised to reflect this comment. INFORMATION ONLY 1. For final engineering, a street-lighting plan is required for the new roadway. All street light systems shall be per city standards, and should consider existing street lights on adjacent streets that may affect light locations on this new plat roadway in an effort to ensure a uniform lighting distribution. A street lighting plan will be included with Final Engineering. 2. The stormwater pond retaining walls will need to be designed by a structural engineer. The city required third-party review of the structural design; paid for at the expense of the applicant. Structural design for the pond retaining walls will be included with Final Engineering. PUBLIC WORKS – TRAFFIC DIVISION 1. Comments will be forwarded when received by Planning Division. At a minimum, the following comment must be addressed. The comment is in a December 19, 2019, email from Jim Harris to Ed Mecum and Mecum’s December 20, 2019, response. This item will need to be addressed by the applicant to further evaluate the short plat application. City of Federal Way Department of Community Development Kislyak Short Plat – 34402 24th Place SW 07/23/2021 Page | 6 • “More information is required regarding the subject parcel’s access rights, and those of future subdivided lots to SW 344th Place, which is a private road in a tract.” I do not see that this was addressed in the application submittal, and I know this will be a significant and important issue with this proposal. Please provide me information on this subject identifying how the subdivided parcels have rights to the private roadway. This was not received by January 7, 2020, and no may result in delay to the project review. This information was requested in the preapplication summary and has not been addressed. Per the attached plat of Virginia Hills, It appears that Lot 11 (Kislyak Short Plat property) was intended to have access to 24th Place as part of the overall plat based on this information, we feel that the connection should be allowed as it provides better emergency vehicle access for both sites. SOUTH KING FIRE & RESCUE WATER SUPPLY 1. Fire Flow – A Certificate of Water Availability shall be requested from the water district and provided at the time of the building permit application. A Certificate of Water Availability has been requested from the water district and will be provided at the time of the building permit application. 2. Fire Hydrants – The existing fire hydrants on SW 344th Place and 24th Place SW will be sufficient for this project. Fire hydrants shall be in service prior to and during the time of construction. This comment has been noted. EMERGENCY ACCESS 1. Fire apparatus access roads shall comply with all requirements of Fire Access Policy 10.006: http://southkingfire.org/DocumentCenter/Home/View/24. This comment has been noted. 2. Fire apparatus access roads shall be installed and made serviceable prior to and during the time of construction. This comment has been noted. FIRE SPRINKLER SYSTEM 1. The need for an NFPA 13D fire sprinkler system will be determined at the time of the building permit submission. This comment has been noted. LAKEHAVEN WATER & SEWER DISTRICT 1. Regarding the city’s application completeness review for the subject application/project, the applicant has completed and submitted to Lakehaven an application for Certificate(s) of City of Federal Way Department of Community Development Kislyak Short Plat – 34402 24th Place SW 07/23/2021 Page | 7 Availability, and Lakehaven issued those certificates on September 6, 2019. However, no other application has been submitted to Lakehaven that is necessary to be able to determine the applicant’s specific requirements for connection to Lakehaven’s water and sewer systems to serve the subject property. As previously noted, the applicant will need to apply for either a Developer Pre-Design Meeting, or Developer Extension Agreement, for Lakehaven to formally commence the water and sewer plan review process. Lakehaven encourages owners/developers/applicants to apply for Lakehaven processes separately to Lakehaven, and sufficiently early in the pre-design/planning phase to avoid delays in overall project development. A Developers Extension Agreement application for water and sewer are being prepared and will be submitted to Lakehaven in the near future.
