Direct fill in wetlands is proposed with mitigation through the purchase of credits from the King County In Lieu Fee Program. Stream and wetland buffer modifications are proposed. The Project includes the construction of a new outfall into a stream at the upper limits of the buffer. Note: Buildings A and B were permitting separately with the City of Federal Way, so there are 2 SEPA decisions, one per building. The stormwater was designed for both projects, and the outfall was permitting with the City through the Building A permitting process. The Building A SEPA decision was appealed. The appeal was processed and the Project was allowed to proceed. Minor mitigation measures were added to the Project as a result of the appeal. See appeal decision. Buildings A & B were permitted together for the USACE, until the USACE determined that none of the wetlands onsite were Waters of the US. See the USACE AJD decision, attached. The Project is currently under final review with ECY for issuance of an administrative order. A draft AO has been prepared and is under internal review. PROVISIONS 1. This STANDARD Hydraulic Project Approval (HPA) is issued for: A. Stream and wetland buffer modifications; 1. Direct fill of wetlands, including approximately 14,000 SF of impacted wetland and stream buffer area; 2. Clearing of vegetation for development of commercial buildings, parking lots, and a stormwater retention pond; B. Installation of a new stormwater outfall structure; C. Mitigation including replanting with native vegetation, wetland and stream buffer enhancement. TIMING - PLANS - INVASIVE SPECIES CONTROL 2. TIMING LIMITATION: You may begin the project immediately and you must complete the project by December 15, 2026. 3. APPROVED PLANS: You must accomplish the work per plans and specifications submitted with the application and approved by the Washington Department of Fish and Wildlife, entitled, "20-101386-Civil Plan Set-04-22-2021-V3.pdf," dated November 10, 2021; and all supporting documents and communications uploaded to the Aquatic Protection Permitting System (APPS) project file; except as modified by this Hydraulic Project Approval. You must have a copy of these plans available on site during all phases of the project construction. INVASIVE SPECIES CONTROL: Follow Method 1 for low risk locations (i.e. clean/drain/dry). Thoroughly remove visible dirt and debris from all equipment and gear (including drive mechanisms, wheels, tires, tracks, buckets, and undercarriage) before arriving and leaving the job site to prevent the transport and introduction of invasive species. For contaminated or high risk sites please refer to the Method 2 Decontamination protocol. Properly dispose of any water and chemicals used to clean gear and equipment. NOTIFICATION REQUIREMENTS 5. PRE- AND POST-CONSTRUCTION NOTIFICATION: You, your agent, or contractor must contact the Washington Department of Fish and Wildlife by e-mail at HPAapplications@dfw.wa.gov; mail to Post Office Box 43234, Olympia, Washington 98504-3234; or fax to (360) 902-2946 at least three business days before starting work, and again within seven days after completing the work. The notification must include the permittee's name, project location, starting date for work or date the work was completed, and the permit number. The Washington Department of Fish and Wildlife may conduct inspections during and after construction; however, the Washington Department of Fish and Wildlife will notify you or your agent before conducting the inspection. 6. PHOTOGRAPHS: You, your agent, or contractor must take photographs of the job site before the work begins and after the work is completed. You must upload the photographs to the post-permit requirement page in the Aquatic Protection Permitting System (APPS) or mail them to Washington Department of Fish and Wildlife at Post Office Box 43234, Olympia, Washington 98504-3234 within 30-days after the work is completed. 7. FISH KILL/ WATER QUALITY PROBLEM NOTIFICATION: If a fish kill occurs or fish are observed in distress at the job site, immediately stop all activities causing harm. Immediately notify the Washington Department of Fish and Wildlife of the problem. If the likely cause of the fish kill or fish distress is related to water quality, also notify the Washington Military Department Emergency Management Division at 1-800-258-5990. Activities related to the fish kill or fish distress must not resume until the Washington Department of Fish and Wildlife gives approval. The Washington Department of Fish and Wildlife may require additional measures to mitigate impacts. STAGING, JOB SITE ACCESS, AND EQUIPMENT 8. Stage all equipment landward of the ordinary high water line (OHWL). 9. Equipment used for this project may operate waterward of the ordinary high water line, provided the drive mechanisms (wheels, tracks, tires, etc.) do not enter or operate waterward of the OHWL. 10. Check equipment daily for leaks and complete any required repairs in an upland location before using the equipment in or near the water. 11. Use environmentally acceptable lubricants composed of biodegradable base oils such as vegetable oils, synthetic esters, and polyalkylene glycols in equipment operated in or near the water. CONSTRUCTION-RELATED SEDIMENT, EROSION AND POLLUTION CONTAINMENT 12. Work in the dry watercourse (when no natural flow is occurring in the channel, or when flow is diverted around the job site). 13. Protect all disturbed areas from erosion. Maintain erosion and sediment control until all work and cleanup of the job site is complete. 14. Straw used for erosion and sediment control, must be certified free of noxious weeds and their seeds. 15. Stop all hydraulic project activities except those needed to control erosion and siltation, if flow conditions arise that will result in erosion or siltation of waters of the state. 16. Prevent project contaminants, such as petroleum products, hydraulic fluid, fresh concrete, sediments, sediment- laden water, chemicals, or any other toxic or harmful materials, from entering or leaching into waters of the state. 17. Route construction water (wastewater) from the project to an upland area above the limits of anticipated floodwater. Deposit waste material from the project, such as construction debris, silt, excess dirt, or overburden, in an upland area above the limits of anticipated floodwater unless the material is approved by the Washington Department of Fish and Wildlife for reuse in the project. 19. Deposit all trash from the project at an appropriate upland disposal location. CONSTRUCTION MATERIALS 20. Store all construction and deconstruction material in a location and manner that will prevent contaminants such as petroleum products, hydraulic fluid, fresh cement, sediments, sediment-laden water, chemicals, or any other toxic or harmful materials from entering waters of the state. 21. Use only clean, suitable material as fill material (no trash, debris, car bodies, tires, asphalt, concrete, etc.). OUTFALL 22. To prevent scouring, protect the watercourse bank and bed at the point of discharge using biotechnical techniques, including installation of an appropriately sized rock splash pad. Install native plantings adjacent to the splash pad area, such that the root system can grow and lock the rock splash pad in place. Examples of preferred native plant species include red-osier dogwood (Cornus sericea) and willow (Salix spp.). 23. The downstream end of the outfall structure must be located at least 4 feet landward of the OHWL, and a rock pad must be used to dissipate the energy of flowing water exiting the outfall. 24. The angular rock must be large enough and installed to withstand the 100-year peak flow. 25. To prevent the entry of adult or juvenile fish, construct the outfall structure according to the approved plans and specifications. 26. The outfall must have a T-diffuser energy dissipater located upland of the OHWM. 27. Isolate the excavation pit from the wetted perimeter. DEMOBILIZATION AND CLEANUP 28. Seed areas disturbed by construction activities with a native seed mix suitable for the site that has at least one quick-establishing plant species. 29. Replant the job site with the plant species composition and planting densities approved by the Washington Department of Fish and Wildlife. 30. Complete replanting of riparian vegetation during the first dormant season (late fall through late winter) after project completion per the approved plan. Maintain plantings for at least three years to ensure at least eighty percent of the plantings survive. Failure to achieve the eighty percent survival in year three will require you to submit a plan with follow-up measures to achieve requirements or reasons to modify requirements. 31. Remove temporary erosion and sediment control methods after job site is stabilized or within three months of project completion, whichever is sooner. 32. Upon completion of the project, remove all materials or equipment from the site and dispose of all excess spoils and waste materials in an upland area above the limits of anticipated floodwater. 33. This project will be utilizing the King County In-Lieu Fee Program (KCILFP) for offsite mitigation. Upon agency review, including a complete site inspection, it was determined that the onsite mitigation included with this project, combined with off-site compensatory mitigation through KCILFP will be sufficient to address the impacts of this project. This Hydraulic Project Approval does not require additional compensatory mitigation for this project. The U.S. Army Corps of Engineers (Corps) issued its jurisdictional determination on July 27, 2021. The site is located at 33663 Weyerhaeuser Way South, Federal Way, Section 16 & 21, Township 21N, Range 4E, King County, and WRIA 10: Puyallup-White. The project proposes to construct approximately 439,050 square feet of new building space with associated infrastructure, parking, and stormwater facilities. The purpose of the project is to provide large commercial facilities to serve as warehouse storage and distribution centers. During construction of the facilities, nine depressional, Category III wetlands will be permanently filled. This Administrative Order authorizes 0.228 acres (9, 922 square feet) of Category III wetland impacts at the project location. Mitigation for this proposal will consist of the purchase of 13.5262 King County In-Lieu Fee credits and all other actions as proposed in the In -Lieu Fee Use Plan dated March 2, 2020. For purposes of this Order, the term “Applicant” shall mean Federal Way Campus, L.L.C., and its agents, assigns, and contractors. A.5 Nothing in this Order waives Ecology’s authority to issue additional orders if Ecology determines further actions are necessary to implement the water quality laws of the state. Further, Ecology retains continuing jurisdiction to make modifications hereto through supplemental order, if additional impacts due to project construction or operation are identified (e.g., violations of water quality standards, downstream erosion, etc.), or if additional conditions are necessary to further protect the public interest. A.6 The Applicant shall ensure that all appropriate project engineers and contractors at the project site have read and understand relevant conditions of this Order and all permits, approvals, and documents referenced in this Order. B. Notification Requirements: B.1 The Applicant shall provide written notification to Ecology in accordance with condition A.2 above for the following activities: a. At least seven (7) days prior to conducting work activities in wetlands. b. Immediately following a violation of the state water quality standards or any condition of this Order. c. Within seven (7) days of completing work activities in wetlands. C. Wetland Mitigation Conditions C.1 The Applicant shall mitigate wetland impacts as described in In-Lieu Fee Use Plan (hereafter called the “mitigation plan”) prepared by Talasaea Consultants, Inc., dated March 2, 2020 or as revised and approved by Ecology. C.3 The Applicant shall obtain a Statement of Sale from the Sponsor as documentation of purchase of 13.526 credits for this impact project (see A.2). The Applicant shall submit a copy of the Statement of Sale to Ecology (see A.2) before impacting wetlands and within 60 days of receipt from the Sponsor. 1. Documentation from the Sponsor shall include: a. Ecology’s Order number, b. Order issuance date, c. Description of mitigation credits purchased, d. Signatures from the Sponsor and the Applicant. C. 4 The Applicant shall complete the purchase of credits before the impacts to wetlands occur, or Ecology may require additional compensation to account for additional temporal loss of wetland functions. The Corps project manager (Kristin McDermott) met onsite with an additional Senior Corps project manager, Corps student trainee, and agent (Jennifer Marriott) on April 5, 2021. Site Description: The site consists of two parcels, totaling 32.31 acres, currently owned by Federal Way Campus, LLC. The approximate address is 336633 Weyerhaeuser Way South, Federal Way, Washington. The site is bound to the north and east by Weyerhaeuser Way South, by Weyerhaeuser Road to the west, and State Route highway 18 to the south. The site is currently undeveloped except for existing service roads, a passive recreational trail system, and a maintained landscape materials yard that has been used for the entire Weyerhaeuser property over the past several decades. The majority of the site is a Douglas fir forest with an understory dominated by salal. The site was developed as residential areas in the 1950's but the area has revegetated naturally and the houses were removed sometime between 1969 and 1980. Thirteen (13) wetlands, one (1) stream and three (3) ditches were identified on site. The channel is located at the toe of the slope of a utility easement which traverses the study area. Hydrology is supported by precipitation and surface water flows from the surrounding uplands. Stream EA is not subject to tidal ebb and flow and has no potential to be used in interstate or foreign commerce. Some sources report Stream EA is intermittent and others report Stream EA is ephemeral in a typical year. However, we have established that it contributes surface water flow to an unnamed tributary to Hylebos Creek south of Highway 18, an (a)(2) water. For the purposes of this AJD we did not need to confirm the flow regime of Stream EA since the stream does not meet other requirements of a Tributary. Stream EA is an artificial feature (even though named a "stream") constructed sometime between the year 2000 and 2015. Historic topographic maps from 1949 and 1956 indicate a natural tributary located more than 500 feet south of the existing Stream EA, but historic aerials from 1955 and 1969 do not indicate the natural tributary or other water feature extended to Stream EA's location. Based on review of USGS historic topographic maps, NETRonline historic aerials, grading plans for the Weyerhaeuser Campus construction dated 1969 and as- built drawings for the utility corridor construction dated 1999, no natural tributary was present at the current location of or in the vicinity of Stream EA prior to construction of Stream EA. Therefore, Stream EA did not relocate a tributary and was not constructed in a tributary. The as-built drawings for the utility corridor construction dated 1999 indicate two wetlands, "Wetland F" and "Wetland E", were present in the area where the construction of Stream EA occurred. The wetlands, filled as part of the utility corridor construction, were in the vicinity of a culvert directed south under Highway 18 which discharged into an unnamed tributary to Hylebos Creek. However, there is no stream like feature indicated north of the culvert in the as-built drawings, USGS historic topographic and soil survey maps, or historic aerial photographs. Because these wetlands were filled in the past, it is difficult to determine the flow regime but it is likely that the wetlands did not contribute enough flow to create any channel or tributary. Therefore, Wetland F and Wetland E would not have been an adjacent wetland at the time of Stream EA construction. Based on this information, Stream EA is a ditch that did not relocate a tributary, was not constructed in a tributary, and was not constructed in an adjacent wetland. Wetland DQ, DR, EB, EE: The subject wetlands are Category III palustrine forested or scrub-shrub wetlands ranging from 300 square feet to 3,240 square feet in size. They receive hydrology from direct precipitation, surface sheet flow and/or receive flows from upland excavated ditches. The subject wetlands contribute flow to an (a)(2) water through non-jurisdictional features. Water flows through a series of ditches from Wetland EE to Wetland DR then to the outfall of Wetland EB where water discharges into the Weyerhaeuser Way stormwater drainage network. Wetland DQ directly discharges into the Weyerhaeuser Way stormwater drainage network via Ditch DQ. The ditches which direct the surface waters off-site were not determined to be (a)(2) waters (see Ditch EE-DR, Ditch DR-EB, Ditch DQ). No (a)(1)-(a)(3) waters were identified on-site, therefore, the subject wetlands do not abut, are not physically separated by a natural or artificial feature and are not inundated by flooding from an (a)(1)-(a)(3) water. Wetland DT: The subject wetland is a 2,430 square foot Category III palustrine scrub-shrub wetland. Wetland DT receives hydrology from direct precipitation and surface sheet flow. The subject wetland contributes flow to an (a)(2) water through a non-jurisdictional feature. In direct response to precipitation water flows south of the subject wetland through a constructed drainage swale along Weyerhaeuser Way South. The drainage swale converges with Stream EA prior to the culvert under Highway 18 (see Drainage Swale). They receive hydrology from direct precipitation, surface sheet flow and/or receive flows from an underground french drain system. The subject wetlands contribute flow to an (a)(2) water through non-jurisdictional features. Water flows through a french drain from Wetland ED and Wetland EF to Wetland EC where water discharges into Stream EA via a french drain, a (b)(2) excluded water. No (a)(1)-(a)(3) waters were identified on-site; therefore, the subject wetlands do not abut, are not physically separated by a natural or artificial feature, and are not inundated by flooding from an (a)(1)-(a)(3) water. Wetland DP: The subject wetland is a 300 square foot Category III palustrine forested wetland. Wetland DP receives hydrology from direct precipitation, surface sheet flow and high flows from the Drainage Swale. Wetland DP is an isolated depression that does not contribute flow to an (a)(2). A natural berm separates Wetland DP from the drainage swale; however, during high flows the drainage swale will flood into Wetland DP. The drainage swale converges with Stream EA prior to the culvert under Highway 18 (see Drainage Swale). A gravel pedestrian path separates Wetland DP from Stream EA. No (a)(1)-(a)(3) waters were identified on-site; therefore the subject wetland does not abut, is not physically separated by a natural or artificial feature and is not inundated by flooding from an (a)(1)-(a)(3) water. Wetland DU, DW, DX, DZ: The subject wetlands are Category III palustrine forested or scrub-shrub wetlands ranging from 59 square feet to 446 square feet in size. They receive hydrology from direct precipitation and surface sheet flow. The subject wetlands are isolated depressions that do not contribute flow in a typical year to an (a)(2) water. Topography gradually slopes from Wetland DU towards the southwest towards Wetland DW, Wetland DX, and Wetland DZ. No (a)(1)-(a)(3) waters were identified on- site; therefore, the subject wetlands do not abut, are not physically separated by a natural or artificial feature and are not inundated by flooding from an (a)(1)-(a)(3) water. Ditch EE-DR and Ditch DR-EB: The subject ditches are typically dry through the summer and fall but convey surface water flow during heavy rain events in the winter. Hydrology is supported by precipitation and surface water flows from the surrounding uplands and abutting wetlands. The subject ditches are not subject to tidal ebb and flow and have no potential to be used in interstate or foreign commerce. The subject ditches are ephemeral in a typical year and likely contribute surface water flow through non- jurisdictional features to an (a)(2) water, Mill Creek. Water outfalls from Wetland EE through a culvert into Ditch EE-DR and discharges into Wetland DR. Ditch DR-EB begins at the outlet of Wetland DR and discharges flow into a culvert at the outfall of Wetland EB. The culvert is directed east under Weyerhaeuser Way South and discharges into a stormwater pond. The stormwater pond releases water into a stream that flows east on the northside of Highway 18 and likely discharges into Mill Creek. The ditches are artificial features constructed in uplands as a result of development. Historic topographic maps from 1949 and 1956 indicate a natural tributary located at least 0.35 of a mile south of the existing subject ditches, but historic aerials from 1955 and 1969 do not indicate the natural tributary or other water feature extended to or was in the vicinity of the subject ditches locations. The stormwater pond releases water into a stream that flows east on the northside of Highway 18 and likely discharges into Mill Creek. The ditch is an artificial feature constructed from uplands as a result of development. Historic topographic maps from 1949 and 1956 indicate a natural tributary located at least 0.35 of a mile south of the existing subject ditch, but historic aerials from 1955 and 1969 do not indicate the natural tributary or other water feature extended to or was in the vicinity of the subject ditch location. Historic topographic maps from 1949 and 1956 indicate a natural tributary located at least 500 feet south of the existing subject swale, but historic aerials from 1955 and 1969 do not indicate the natural tributary or other water feature extended to or was in the vicinity of the subject ditch location. Based on review of USGS historic topographic maps, NETRonline historic aerials, grading plans for the Weyerhaeuser Campus construction dated 1969 and as-built drawings for the utility corridor construction dated 1999, no natural tributary was present in the location of or in the vicinity of the constructed Drainage Swale. Therefore, the Drainage Swale did not relocate a tributary and was not constructed in a tributary. However, the as-built drawings for the utility corridor construction dated 1999 indicate two wetlands, "Wetland F" and "Wetland E", were present in the area where the construction of Stream EA occurred. The wetlands, filled as part of the utility corridor construction, were in the vicinity of a culvert directed south under Highway 18 which discharged into an unnamed tributary to Hylebos Creek. However, there is no stream like feature indicated north of the culvert in the as-built drawings, USGS historic topographic and soil survey maps, or historic aerial photographs.
