Council MIN 11-28-1989 Special November 28, 1989 MINUTES CALL TO ORDER ROLL CALL STAFF PRESENT PRESS ATTENDANCE FEDERAL WAY CITY COUNCIL SPECIAL MEETING (To Consider Tax Ordinances) Municipal Building Council Chambers Mayor Debra Ertel called the special meeting to order at 7:00 P.M. Councilman Webster led the Pledge of Allegiance to the Flag. DEBRA ERTEL, MAYOR; MARY GATES, JAMES JAMES HANDMACHER, JOEL MARKS, ROBERT STEAD, LYNN TEMPLETON, JAMES WEBSTER. ALLEN LOCKE, CITY MANAGER; ASSISTANT CITY MANAGER. PAT FLOYD, KURT HERZOG, Federal Way News (Official City Newspaper); MICHELE FLORES, Seattle Times; JOE TURNER, Morning News Tribune. Mayor Ertel noted special meeting was called for the purpose of final reading and adoption of tax ordinances as follows. ADOPTION OF ORDINANCES ORDINANCE NO. 89-5 Idemnification of Employees and Ordinance was read establishing a new Chapter 2.25, Idemnification of Employees and Officers, relating to Officers legal actions brought against employees, providing for legal representation for conduct, acts and omissions on behalf of the city within the scope of their service or employment; providing for the terms, conditions and exceptions from such representation and indemnification; specifying the circumstances under which claims against city officials and employees will be paid by the city; and fixing a time when the same shall become effective. MOVE BY MARKS, SECONDED BY TEMPLETON, TO ADOPT THE ORDINANCE AS READ. ROLL CALL VOTE. ALL AYES. CARRIED. Proposed ordinance was placed on final reading imposing a one-quarter percent excise tax on real estate sales authorized by RCW 82.45 and 82.46, said tax being at the same rate as imposed by King County. Land Use Planning Committee Chairman Webster reported meeting with Keith Artz and representatives of property under developer pressure. The City and County are proceeding with acquisition based on the adoption of the bond issue. The County will secure a title report and appraisal, 25 acres of 57 acres total involved. Owners/developers will proceed along path of the permit process. Mr. Artz will meet with them when appraisal is complete. Also discussed was the process for implementation of the other project located in Federal Way. The County will prepare Interlocal agreements to turn funds over to the City for project implementations. Federal Way City Council Minutes Special Meeting ANNOUNCEMENTS Land Use and Transportation Committee PUBLIC COMMENT Request for City to Sponsor Puyallup Christmas Parade Entry Federal Way Chamber of Commerce of Commerce Offer to Assist in Land Use Planning Process Fire Service Page 3 Chairman Handmacher reminded council of meeting, November 29, 1989, at 7:00 p.m. to discuss road projects with the King County Public Works Director. Diane McMahon advised of horse and wagon entry in Puyallup Christmas parade, requesting use of city's name and sponsorship, $250.00 cost anticipated. Discussion ensued regarding liability created in sponsorship, Also as to setting of precedent without an established policy. The council declined sponsorship at this time. Jerry Pischel, Chairman C.I.D.C., Greater Renton Chamber of Commerce, read a communication from the Chamber lauding council actions in lifting of development moratorium by March 11, 1989. It was deemed essential to capitalize on the opportunity for commercial projects to support the economic health of the new city. Acceleration of lifting of the moratorium was urged. Mr. Bob Heunich inquired regarding fire service and related problems urging prime priority of response time, equipment and personnel secondary.
