We, applicant answer to Technical Comment Letter dated March 10, 2020 per Comments;
COMMUNICATION DEVELOPMENT-PLANNIN DIVISION

ANSWER 1:

• The City accepted “WETLAN DETERMINATION RECONNAISSANT REPORT” prepared by BAI
Inspection Services LLC, dated June 30, 2020. (See Exhibit #001).
ANSWER 3:
The Map is revised on drawing Sheet 1 of 3 and is attached to this report.
ANSWER 4:
The trees are drawn on the map with existing trees and new trees with minimum 20 trees per each lot.
ANSWER 5:
The Open space are more than 10% per each lot. Maximum building coverage area will be 2,000 sq feet
per lot and the coverage ratio is 6 % of the lot area.

The pedestrian and bicycle access will be added and utilized by using 5 ft side walk on 373th Street S and
8th Ave S shown on the final plan.

FINAL ISSUE-LOCAL IMPROVEMENT DISTRICT WAIVER OF PROTEST COVENANT:
Applicant finds that the Modification of Right-of-Way Letter dated July 1, 2020 by the City is not
matched with the existing street conditions (See street plan C-1 Plan) and also, it is a big difference
between P-Type of Street required ON THE FINAL PLAN by the City after subdivision completed.
Modified Right-of-way requires Applicant to install one-foot extension of the current 10 ft street from
the center of the street of 373th Street and 5 ft asphalt sidewalk for 373th Street but the current street
has 2 ft shoulder only and total 6 ft improvement cannot be possible. Also, one ft extension of the
asphalt street and 5 ft crushed sidewalk required for 8th Ave S but the current condition has no space
for a 6 ft distance of these modifications (see C-1 plan). Besides, the current street capacity covers a
full traffic demand even this subdivision approved per Capacity Reserve Certificate (CRC) of the City of
Federal Way (Exhibit #005) dated March 17, 2020. So, the final Right-of-Way to make P-Type Road
needs to be delayed per the City’s construction schedule of the whole line of 373th Street and 8th Ave
S Street.
In conclusion, even the City proposed Local Improvement District (LID) Waiver Protest Covenant
(Exhibit #002) attached the letter of Right-of-Way modification dated July 1, 2020, which is asking
Applicant agreement but the city has no LID program. So, if it is not possible to sign on the sheet of
LOCAL IMPROVEMENT DISTRICT(LID)/WAIVER OF PROTEST COVENANT, Applicant propose a Bond
deposit of $34,440.00 with the Federal Way City’s Amount calculation (Exhibit #003). Please review the
proposed Bond deposit and change the Bond form agreement into the letter dated July 1, 2020. Then,
Applicant will sign it. [END]
