Box 130, Bellevue, WA 98009, representing Quadrant, West Campus Development, 348th St. and 1st Avenue So., noted problem to be created in event of limitation in store size, the proposed zonIng B-N, drafted by Wilsey/Ham/Pacific, not allowing stores in excess of 10,000 sq. ft. The West Campus Project, nearing completion is a planned community, the intent being that people working there can also live there, shop there and play there and not have to drive else- whe~e for their shopping needs. A 10,000 sq. ft. limitation makes drug or grocery stores impossible. The site is surrounded by roads and cannot grow any larger. It was proposed the matter of limitation be studied further and that the zoning remain Commercial Business. (CBl Letters submitted from Western Securities, FlA. Limited, along with map of the area, recommended the Zonin~ Code designation B-N exempt drug and grocery stores from the 10,000 sq. ft. requirement- the grocery store to require 45,000 sq. ft. and the drug store 22,00Osq.ft., those major essentials deemed necessary for the success of the smaller shops. jack McCullough, Land Use Attorneys, Foster, Pepper, Shefelman, 1111 Third Avenue, #3400, Seattle, WA 98101, representing Richard Burrell, Western Securities WA., Limited, advised of zoning and map change problems resolved with Mill Creek and urged the Council to keep the needs of the developer in mind. West Campus has been planned as a mixed type of development with retail shopping components and opportunity for people to shop in the area in which they live. The problem is the 10,000 sq. ft. limitation, the intended use for grocery and drug stores as well as smaller shops. Should keep C-B zoning or redesignate as N-B to allow a center to serve the needs of the residents as proposed. (Horns of the dilemma.) David Kaplan, Federal Way Community Council, wanted to acquaint the Council with position of the Community Council regarding Soroptomist International of Federal Way's request for support of it's Flag Display project for the Goodwill Games. The matter did not go to vote and no action was taken. Alfred Frank, 29635 2nd Pl. S.W., Federal Way, noted proposed Fred Meyer Development at 1st Avenue and 320th, another at 1st and 348th, also near the Wetlands and still others looking for a site. He feels stores should be out on the freeway, outside the development areas. The Planning Proposals do not reflect the congested corner of 320th at 5:00 p.m. and it is going to be even more congested. The people would rather keep stores out on 99. Councilmember Gates, Finance Committee Chairman reported Committee review and approval of vouchers nos. 50955-61, $10,028.00, 50731-33, 36, 38, 42, 50744-45 and 50908-16, $30,904.06 Certification as to receipt of merchandise and/or services received; Council approval for payment was recommended. MOVED BY STEAD, SECONDED BY GATES, TO AUTHORIZE PAYMENT 0F VeUCHERS AS SUBMITTED. CARRIED. Counci1member Handmacher, Chairman of the Land Use & Transportation Planning Committee advised of Forest Practice Application to Clear Cut pending before King County. The Surface Water Management Division has opposed that and is asking that the application not be granted. The Committee recommended Council take the same position and instruct the attorney to take the necessary action to prevent the ~lear t'ut,a,pproval. The Clearing and Grading Ordinance to be adopted so property cannot be cleared until development plan is in place. The Land Use Committee has a landscape Ordinance as part of the Zoning Code which requires retention of significant trees. -2- FEDERAL WAY CITY COUNCIL REGULAR MEETING 1/16/90 1MMITTEE REPORTS: LJdnd Use/Trans. Committee "Clear- Cut Application" (cont.) The clear cutting should be stopped, not only esthetically as regards trees but in terms of surface water. The County Stream Ecologist writing the report was concerned with erosion, (another 37 acres of clear cut proposed), , additional rains could be a problem. MOVED BY HANDMACHER, SECONDED BY TEMPLETON, TO REFER THE MATTER TO THE CITY ATTORNEY TO INVESTIGATE AND REQUEST THE COUNTY NOT TO GRANT CLEAR CUTTING PERMIT. CARRIED.
