D.I.R.E. Richard Burris, P. O. Box 4586, Federal Way, President of D.I.R.E. Inquiry submitted letter expressing concern regarding operation of the Water /Sewer Federal Way Water & Sewer District, especially as to proposed District expansion of sewer facilities to area East of Interstate - 5 to Operation accommodate a large apartment complex, any such expansion to impact density, and tax and overburden the sewer facility. The Council was urged to take over the operation of the Federal Way Water and Sewer District. Tree Planting Lisa Grimes, 2120 South 279th Street, Federal Way, on behalf of Ceremony the Federal Way Community Council announced 4/11/90 tree planting ceremony at city hall at 2:00 p.m., donated by the Oriental Garden Center, this to begin opening events of Earth Rally and spring cleanup event. PUBLIC HEARING This being the date set and proper notice being published and SW 344th Street posted according to state and local laws, Mayor Ertel declared Extension the public hearing on the extension of S.W. 344th Street open for public comment. Campus Crest Pursuant to King County E.I.S., four alternates were proposed. Project - The proposals were reviewed by the Land Use Committee and con - Polygon sultants. C)= Community Council was requested to consider hiring or current staff Development Block member to be designated for representation on the Community Grant Program Development Block Grant program, contract negotiations for 1990 -91 underway and discussion with Human Services Round Human Services table to commence. Organization chart now being completed Round Table and if possible a position needs to be scheduled to take on those responsibilities in event the city joins Round Table as proposed in the latter part of the year. Land Use and Councilmember Handmacher, Chairman of the Land Use and Trans - Transportation portation Planning Committee, reported presentation by Les Planning Com- Schwab Tire Center representative regarding zoning code amend - mittee ment, the committee advising zoning code amendments to be re- viewed in future planning cycle with Planning Commission. Planning Staff Greg Moore, Land Use Manager, advised of vast volume of permit applications more than 80 issued and fees in excess of $200,000 New Planner hired generated. A new Planner is hired and another coming on staff a second scheduled in April or May. Priority of hiring Zoning Code Enforcement April or May Officer was discussed concensus of committee to move ahead Zoning Code with this position immediately. Goodwill Games Chairman Handmacher reported requests were reviewed from the Banner requests school district, Goodwill Games Committee and Summer Fest School District, Committee to place banners throughout the city for Goodwill Goodwill Games Games. The zoning code allows public service message banners Committee to be placed by the city the school district likely valid, the Summerfest Goodwill Games group to be notified if they want to raise the money and donate it to the city for installation of the banners the city could undertake that task and that would conform to the zoning code, Planning staff to notify the requesting party. Mike Delles was requested to prepare Scope of Plan Work for Transporation Plan for committee review next Monday. Hearing Examiner Councilmember Templeton inquired regarding hiring of a City Hearing Examiner, City Manager Locke responding that temporary contracting contemplated Sam Jacobs and Ron McConnell services possible to be utilized to end of 1990, Council to sit as interim hearing body for city projects otherwise. Public Services Councilmember Marks, Pubic Services Committee Chairman, reported Committee March 30 meeting with briefing by Major Moore, Police Commander Major Moore Precinct 5, Federal Way, regarding various police department review of police programs for goodwill games, reserve officer and community programs and 1991 program requests received for committee considera- tion. The committee also reviewed proposed right-of-way Ordinances - Right ordinance and modified fireworks ordinance. Meeting was of Way and Fireworks scheduled for 4/13/90 with Jerry Graham to discuss recycling, Vendor Contracting- also street sweeping proposal and other public works functions Recycling/Public which might be contracted. Water & Sewer district operation Works Contracting Water /Sewer Dist. and Stan Smalley, Vendor contracting, other items under study. Facilities and Councilmember Stead, Chairman of the Facilities and Personnel Personnel Committee, reported next meeting scheduled for 4/11/90 at Committee 7:30 a.m. City vehicle needs were discussed this a.m. and City Vehicles City Manager Locke authorized to purchase three vehicles authorized from Hertz and two new cars through state bidding process. The committee also reviewed site planners design for the New site for Seatac Executive Building, Financial Center plan to be re- city hall City Logo study viewed and report to council forthcoming. COMMITTEE REPORTS Parks & Recreation Councilman Webster, Chairman of the Parks & Recreation, Cultural Arts Cultural Arts Committee, announced meeting April 4, 1990 Committee at 7:30 a.m. to hear presentation by Director of the Brooklake Community Club and then finalization of the Acquisition and Comprehensive Planning program for Parks & Recreation in Management of the City of Federal Way, request for authorization to Open Space Bond proceed will be submitted to council next week. Also, Issue Properties regarding the open space project referred to as the 363rd project, the appraisal is nearing completion on the two Meeting 4/4/90 Hylebos projects, the interlocal agreement being prepared 7:30 a.m. by the City Attorney,the Washington State Parks & Recreation Dep't staff to proceed with title reports & appraisals, negotiations to follow thereafter. Once acquired those properties would be in ownership of the city and a_manage- ment agreement advisable with the State Parks & Recreation Commission for management. The Spring Valley and Adelaide Lakota project title reports are in process, strategy to be reviewed regarding hiring of appraisal firms and acquisi- O % tion. Goodwill Games Land & Water Mayor Ertel reported attendance at Land & Water Stewardship Stewardship Conference in King County, sponsored by WSU Extension.:. as to Conference resources and contacts and information on how to purchase, reclaim and preserve properties. Representative from the Trust for Public Lands will meet with council or community. Retreat date & Discussion with new City Manager McFall,who will begin work Facilitators on 4/16/90, regarding need for a retreat was reported, dates tentatively proposed and facilitators, council requested to look at calendars. Vice -Officer Major Moore, 5th Precinct, Police Department, introduced Testimony - Sergeant Frank Kinney, Supervisor of a vice - gambling unit who Adult entertain- testified regarding the adult entertainment and iW.assage ment /massage parlor parlor businesses operating in Federal Way, outlining the businesses in arrests and violations. He noted one adult entertainment Federal Way establishment in Federal Way,history and background explained; the City Clerk responsible for the city ordinance licensing, the police the enforcing agency who can go in undercover and monitor the activities; There are ten licensed practitioners those operating from residences not evidencing problems but 5 of the establishments having histories of arrests. The City will need a regulatory officer to monitor compliance with city code provisions, the County Police having some capability as undercover agents but licensing division checking as to the licensing requirements and sanitation they the criminal activity. Educational requirements of the state RCW and King County help to control that business activity. After some questions and answers it was noted the city ordinance adequately covers the various business activities. The Mayor will select panel of five to serve in this capacity. Lease Agreement City Manager Locke outlined provisions of the lease on present city agreement for use of present fire station site. Also, council confirmation was requested as to agreement with right -of- way width of 84 feet and slope not to exceed 12Z on portion going through the Polygon property. Donna Meixner, 33719 32nd Ave. SW., Federal Way, representing • non- profit organization planning to sell fireworks in the city expressed disapproval of proposed requirement dealing with enforcement of "not under 16" as they can go across the street to illegal stand and purchase also, date of 7 /1_for - discharge prevents demonstrating what the item does when the other stand can do so June 28. -8- FEDERAL WAY CITY COUNCIL Regular Meeting April 3, 1990 AUDIENCE COMMENT (Cont.) Logo for City Lisa Grimes, 2120 South 279th Place, Federal Way, commented that Logo is needed, however much greater public input than five persons as proposed deemed to be advisable and that members of the general public choose a final design rather than the city council members. Hearing Examiner H. David Kaplan, 30240 27th Avenue South, Federal Way, who is not expressed hearing examiner and building in Federal Way associated with sentiment and wanted record to show several considerations King County regarding hearing examiners working for or with King County advisable objectionable, much unhappiness due to discretionary hearing examiner decisions of King County. SESSION The council reconvened in regular session at 9:30 p.m. New Seattle Times Leon Espinoza, Seattle Times reporter, was introduced. He Reporter present replaces Michelle Flores. Leon is from Riverside, CA and has watched several cities incorporate also watching litigation proceedings.
