Mayor Ertel invited City Attorney Wallace to summarize Interloca1 Agreement between King County and the City of Federal Way relating to the processing of certain building and/or land use applications and/or permits. City Attorney Wallace explained contents of the document briefly noting Paragraph 1, Permits in"Exhibit A" are permits to be returned to the City of Federal Way for processing, the City reserving the right to transfer any of those back to BALD for completion of processing. Paragraph 2, Permits and applications that BALD will continue to process with permits set forth in Exhibits A or B to be governed by Paragraph 1. Paragraph 3 is level of services to be provided by the County with respect to the applications and permits in Paragraph 2. Paragraph 4 deals with various unclassified Use Permits and scope of county involvement with respect to approval. They must come back to the Hearing Examiner or Council for final action. Paragraph 5 deals with the agreement before the Council this evening. Paragraph 6 recognizes that the City has adopted SEPA procedures and will act as responsible official to make required determinations. Paragraph 7 Provides for adoption of a County Fee Schedule, the County to collect and retain as the fee for processing application and permits. Paragraph 8. City may remove any application or permit from the agreement upon notification to the County. Paragraph 9. Effective date 2/28/90 with two-year termination unless extended. SWand 325th Greater Federal Way Chamber of Commerce Curene Gustin Jerry Pischel Offer to assist in Planning process (Cont.) Paragraph 10. Both parties (County and City) to make handout available to permittees and applicants. Paragraph 11. County Prosecutor will not provide gratis legal services. Paragraph 12. Indemnification Clause. Paragraph 13. Manager of BALD and City Manager of Federal Way to administer the contract agreement. Paragraph 14. If not specifically mentioned within the agreement representations or understandings are otherwise excluded. Paragraph 15. Recital to specifically provide that nothing in this agreement is to be construed as granting rights of vesting nor shall any provisions prevent any permit or application which was existing (vested) as of the date .of incorporation. MOVED BY STEAD, SECONDED BY WEBSTER, TO AUTHORIZE THE CITY MANAGER TO ENTER INTO THE INTERLOCAL AGREEMENT. MOTION CARRIED. Ordinance of the City of Federal Way, Washington was read adopting certain rules and regulations of King County to permit the processing of applications and/or permits determined by the City to be vested in accordance with applicable state statutes and judicial decisions to the rules and regulations adopted hereby and declaring a public emergency. MOVED BY STEAD, SECONDED BY HANDMACHER, TO SUSPEND THE RULES AND PLACE THE ORDINANCE ON FINAL READING AND ADOPTION. The Ordinance was read. MOVED BY STEAD, SECONDED BY GATES, TO ADOPT THE ORDINANCE AS READ. ROLL CALL VOTE RESULTED IN UNANIMOUS AYES. CARRIED. Mayor Ertel declared a five minute recess at this time having to attend a National Honor Society function. The meeting was turned over to Deputy Mayor Gates. The recessed meeting was reconvened by Counci1member Gates, Deputy Mayor, at 7:30 p.m. MOVED BY WEBSTER, SECONDED BY STEAD, TO APPROVE THE COUNCIL MEETING MINUTES OF 2/6/90 and 2/13/90. Names of speakers misspelled: Pg. 4 Barney Pg. 7, Schow, Pg. 7, Servek, Pg. 8, Burris, Pg. 9, Feutz. H. David Kaplan noted his request to Council for report back in September had been omitted. MOTION WITH CORRECTIONS AS NOTED CARRIED. Letter from Shane Anderson requested 4-way stop sign at 50th Place S.W. and 325th Place. Referred to Public Services Committee and Major Moore, Police Deptt. - Greater Federal Way Chamber of appreciation for long hours of the City for incorporation and land use planning process. It be postponed until after March Council action by the Board of Use Committee. Commerce letter expressed work by Council in preparing offered assistance in the was requested appeal hearing to allow evaluation of Directors. TEMPLETON, TO ADOPT THE CONSENT INTERLOCAL AGREEMENTS King County/City Agreement was presented between King County and the Real Property City of Federal Way relating to the use of city-owned Use and Vacation Real Property. City Manager Locke and City Attorney Permits as regards Wallace outlined the details recommending approval as to rights-of-ways permits involved and designating the County as agent to accept, review, approve or disapprove applications for certain permits, except for moving houses or other structures. Discussion ensued and wording was added and sentences restructured for clarification, to-wit: C. 3rd line, delete semi-colon and wording after easements, "the City". Section D, second line add "if" between words that - these and "not" between are- reviewed, also after 1990, add "they shall expire. Delete remainder of the ,sentence, "aRel-~e-fteRe~-f}e~!:~s' MOVED BY STEAD, SECONDED BY WEBSTER, TO AUTHORIZE CITY MANAGER LOCKE TO ENTER INTO INTERLOCAL AGREEMENT AS AMENDED. Manager Locke explained Special Use Permits involve use of rights-of ways, it for utility lines, Flag City poles along right of way by a private association, or use of property under power transmission areas such as Bonneville and right of way is used for recreation area or trail system, etc. PENDING MOTION CARRIED. AMENDMENT TO CAG 89-10, Federal Way Water and Sewer Dist. to include equipment expense Councilmember Gates, Budget and Finance Committee, reported additional items of expense not previously included in CAG 89-10 for equipment, including computer time among other equipment expenses, the contract for Accounting and Payroll Services. Approval recommended. MOVED BY STEAD, SECONDED BY HANDMACHER, TO AUTHORIZE CITY MANAGER LOCKE TO ENTER INTO AGREEMENT FOR PAYROLL AND ACCOUNTING SERVICES AS OUTLINED. CARRIED.
